1957, between TOWN OF SOUTHOLD, in the, Courity of Suffolk and
State of. New York, by a majority of its duly elected Trustees
and by virtue of Chapter 615 of the Laws of the State of New
Yorks passed in 1893 , and pursuant to a written resolution
adopted by a majority of the Boarit of Trustees of said Torn
of Southold, at a meeting- held pursuant to notice duly given
to all the members thereof, on the ' 24th day - of September, 195
party of the first part, and
1697 Corporation, S. Roy 'French, President, party of
the second part,
WITNESSETH, the party of the first part in consideration
of the sum of $10.,00, duly paid to the''party of the first
part before the delivery.. hereof, the. receip.t whereof. is here-
by duly acknowledged, has granted and does hereby grant unto
the said party of the second part , the heirs , successors , and
assigns of the parties of the second part forever , permission
to dredge in Haywater Cove- about three feet in 'depth at
Cutchogue, in the Town .of' Southold, Suffolk County, New York,
in accordance with -the plans submitted..
Subject', however, to the -public right 6f' navigation and
subject also to the right of the public to pass and repass
- along that portion of the beach° between low and high water
mark. On condition, however, that the parties of the second
part will--hold the said Trustees and the Town of Southold
harmless and free from any and all damages and claims arising
under or .by virtue of said dredging.,
