TERMS and. CONDITIONS
The Permittee Dana -P. Fox

part of the consideration for the issuance of the Permit does understand and prescribe to the fol-
lowing: 1 . That the Southold Trustees Permit must be prominently
displayed on the premises -effected thereby during the period of �
,''• That the said Board of Trustees and the Town of Southold are released from any and work
all damages, or claims for damages, of suits arising directly or indirectly as a result of any oper- uncle
• 13tion performed pursuant to this permit, and the said Permittee will, at his or her own expense, the

with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold
3- That this. Permit is valid for a period of 19 mos. which is considered to be the
sufficient time required to complete the work involved, but should circumstances warrant, request
for an extension may be made to the.Board at a later date.
4.; That this Permit should be retained indefinitely, or as long as the said Permirtee wishes
°'- -:to maintain the structure or project involved, to provide evidence to anyone concerned that auth-
orization was originally obtained.
5. That .the work involved will be subject to the inspection and approval of the Board or
its agents, and non-compliance with the provisions of the originating application, may be cause for
revocation of this Permit by resolution of the said Board. z
6. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
T. That there shall be no interference with the right of the public to pass and repass along
the beach between high and loci water raarks.
8. That if future operations of the Town of Southold require the removal and/or alterations
in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the
_ work shall cause unreasonable obstruction to free navigation, the said Permittee will be required,
upon due notice, to remove or alter this work or project herein stated without expenses to the Town
of Southold.

Liability Policies in the Amount of .........................................................................................................
The validity of this permit is or may be subject to the approval of other governmental or municipal
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, the holder of this permit shall not commence operations here-
under until such approval has been obtained in writing. The failure to obtain such other approval when
required shall subject this permit to. immediate revocation by the Trustees upon receipt by the
Trustees. of written notice from such other governmental or,municipal authorities of its refusal or .
disapproval.
The applicant does by the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
its officers and employees to enter upon the premises where such operations are being conducted to
make such inspections as the:Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit. . . .
This operation will not substantially:
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish'or other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety and general welfare of the people of the town.

Dear Mr. Fox:
The following action was taken by the. Board of Trustees during
their regular meeting held on March 26, 1987 regarding your wetland
application.
WHEREAS, Dana P. Fox applied to the Southold Town Trustees for a permit
under the provisions of the Wetland Ordinance of the. Town of
Southold, application dated January 20, 1987, and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a public hearing was held by the Town• Trustees with
respect to said application on March 26, 1987 at which time all interested
persons were given an opportunity to be heard, and no objections were raised, and
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area; and
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application,. and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE, BE IT
RESOLVED that Dana P. Fox BE AND HEREBY IS GRANTED PERMISSION UNDER THE
PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD TO: To construct
a 4' x 30' dock and a 8'x 24' floating platform secured by two pilings.

This permit will expire on, March 26, 1988 if work has
not commenced by said date. There are two inspections required and
the Trustees are to be notified upon the completion of the work.
Prior to the issuance of said permit by the Clerk, the applicant
shall file with the Clerk a certificate that he has public liability
insurance policies insuring against any liability which may arise
in the performance of the operations pursuant to such permit in such
amount as shall be fixed by the Trustees, which said policies shall
name the Town as a name insured. Please take further notice that
this declaration should not be considered a determination made for
any other department or agency which may also have an application
pending for the same or similar project.

The following recommendations were made at the regular meeting of the
Southold Town Conservation Advisory held March 20, 1987:
No. 489 - Geddes Parsons - .Approval with stipulations as per letter from
John Thatcher of Fishers Island.
No. 490. - Sal Prato - Recommend .approval.
No. 491 - Nick Tsouris - Recommend approval but suggest that applicant
work with the Southold Town Kenney's Beach Erosion
Committee.
No. 49.2 - Ralph Levy - Approve application but suggest permit be withheld
until possible •violations have been rectified.
(Upon inspection of property it was discovered that
a 4" diameter hose was being used to drain water from
driveway into the creek, also there is a deck being
constructed but no permit is displayed. In addition
there are questions as. to whether the dock on premises
has been issued a permit. )
