The project is to maintenance dredge and the installation of a small dock. The dredging is to allow this section of the bulkhead to be constructed and the dock. It is a small project, and I urge your approval. Trustee Smith: Does anyone have anything to say for this application. Mr. Hiltz: Doesn' t the covenants and restrictions on the Harbor._Lighys Estates restrict the docks. - Anchor Lane, Southold. Trustee Smith: I think it is in certain areas. I.t was my understanding in the basin area it does not p ,.rohibit it. On the North Bulkheaded side. Mr. Hiltz : The only thing I will say for Mr. Forosich is that it does .not protrude out. He did recess the bulkhead. Trustee Smith: Will it protrude out? Roy will you answer that. Roy Haje: About two or three feet. Trustee Smith: How far is it indented? Trustee Kujawski: Personally I donnt know if it is our responsibility to get involved with covenants and restrictions . Mr. Kramer: The covenants say that no owner is allowed to construct or maintain docks or other structures that extend out into the canal. IF you don't look at the 1966 map you don't know where the canal is. If you look at the basin there is a canal down the middle of the basin. Roy Haje: If this needs more interpertation, later on there is another application for Mr. Schiparo, If some of these people are not allowed to but in a dock, then there alternative is to dredge or put in a boat slip so that they can dock their boat. Oct. 30, 1985 Application of Howard Shapiro Anchor Lane, Southold, N.Y. 1TO17-5039 I am reminding the Board of Town Trustees that the above properties are located in IIarbor Lights Estates at Bayview and so being are covered by Harbor Lights convenants and restrictions(map of Harbor Lights Estates section one, filed June 8, 1965, map #4362, recorded Suffolk County Clerks office, liber 5771 , pages 283-288) . The ninth restriction states that: No owner shall have the right to construct or maintain docks or other structures extending out and into the ca._.. canals. The town cannot approve the above applications for floating docks, h-inged docks,pp3.L.tforms, ramps, finger docks or any other structures. The Board of Trustees have a copy of the covenants and restrictions which I let them copy in August 1985, which are in effect until June 1 , 1995. En-Consultants might try to fight the Board because of the following: The property of Howard Shapiro( lot 14 of Harbor Lights Estates) was previously owned by George Koch, who in 1983 applied to the Town Board for docks and finger docks similar to Mr. Shapiro ' s request and I believe it was approved by the Town. But the property was sold by Mr. Koch to Mr. Shapiro and the docks were never built by Mr. Koch, was a preeddeiat established? I think not. It was only an error madez.by the Board because they were unaware that the Harbor Lights cojrr 'n and restric- tions existed. This time around the same error should not be made. A suggestion would be to ask on ftiturppatp& cations if covenants and restrictions exist in the area' s of the applicants and if so a copy of same be presented with the application -to be examined by the Board.
