Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review and 6NYCRR Part 617, Section :
617.10 and Chapter 44 of the Code of the Town of _Southold, notice
is hereby given that the Southold Town. Board, as lead agency for
the action described below, has determined that the project , which
is unlisted will not have a significant effect on the environment .
DESCRIPTION OF ACTION
Application of Joseph Fischetti for a Wetland Permit to install upland bulkhead,
return, fixed dock, ramp and three float docks at the north end of Arshamomaque
Pond, on the south side of Middle Road, Southold, New York.
The project has been determined not to have a significant effect
on the environment for the following reasons:
An environmental assessment has been submitted which indicated
that no significant adverse effect to the environment are likely to
occur should the project be implemented as planned.
Because there has been a response. from the Board of Southold
Town Trustees and Southold Town Conservation Advisory Council indicating
that this project would not have a significant effect to the environment .
._. Because there has been no response in the allotted time from the
New York State Department of Environmental Conservation and the Southold
Town Building Department, it is assumed that there are no objections nor
comments from those agencies.

INSTRUCTIONS FOR PERMIT
A. This application is to be completely filled in by typewriter or ink and submitted to the Town
Clerk in quodruplicate, accompanied by writter permission from the owner of the property if -not-7-
the some as the applicant.
B. Pilot Plan must be drown to scale on the reverse side of this application showing the location
of property, the names and locations of owners of adjoining prcperties, and a detciled description
of prcoosed project. (Note: Copies of the Pilot Plan may be mcde by a copy machine and attached
to the Permit Application.)
C. No operation shall be initiated by the applicant until oil permits that are required are issued.
D. A detailed statement of the rehabilitation and prc,posed condition of the premises. after the
work i.- completed must be given, including a survey if required.
E. If permit is being sought for a more sizeable, excavation than the construction of a private
single dock or jetty, then this application .must be accompanied by a survey and topographical map
certified by a registered land survey or Professional Engineer. The horizontal control of survey
shall be based upon an approval local coordinate system. The vertical control for elevation and sound-
ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological
Survey datum.
F. A statement must accompany the application describing any known prior operations conducted
on the premises in question and whether any prior licenses or permits have been issued to erect
structures or to dredge or deposit fill on said premises and whether any such permits or licenses
were ever revoked or suspended by a governmental agency.
G. A filing fee of $50.00shall accompany the application. This filing fee includes one inspection.
there is a $5.00 fee for each additional inspection.
H. The Town Board upon request9� 7�- applicant for a permit, may waive in.whole or in part,
the provisions of Article 11, Section , subdivisions (b and 'GGr where it finds that nature of the
proposed operations are such that the requirements of such provisions ore not necessary for a
proper ccnsideration of a permit application.

Dear Mr. Hall:
. Thank you for your letter concerning the applications of
Joseph Fischetti for bulkheads and docks. As proposed, the
project is consistent with the area and is considered to be minor
under Tidal Wetlands Land Use Regulations .
The applicant has stated that access will be provided over
the fixed dock in the form of steps . Therefore the structure will
not restrict movement along the beach. This condition will be in-
corporated in the Permit.
We -are all-concerned over the introduction of petroleum
products to the'-.water column. True, the addition of five or six
boats----can only -compound any problems that may exist. in this area.
However, our -department does not regulate the use of inboard/out
board engines. The-Environmental Protection Agency and the U. S .
Coast Guard are the -agencies which have jurisdiction in this matter.
Do any of the interested parties use a motorized boat on the Pond?
Finally, the applicant is not proposing any dredging, and to
the best of my knowledge will not be requesting permission for
dredging in the future. Any applications or dredging in this area
will be scrutinized most carefully.
I hope this satisfies your concerns over the project.

Gentlemen:
We have received a request for Department of the Army authorization
for the following activity:
ACTIVITY: Construction of a 20 foot by 4 foot open pile supported timber
pier, elevated 3 feet above the grade of the marsh, connecting with a walk
ramp and a "U" shaped floating pier consisting of 3 floats secured by 8 piles.
In -addition,. 70 linear feet of timber bulkhead would be constructed landward
of the high tide line and tidal wetlands;

As this work is minor in nature, authorization may be by Letter of
Permission. This is in accordance with current Federal .Regulations governing
work in navigable waters of the United States. To accomplish the coordination
required, prior to the issuance of a Letter of Permission, your review of
the enclosed drawing is requested.
Pursuant. to Section 307(c) of the Coastal Zone Management Act of 1972
as amended (16 U.S.C. 1456(c)) , the applicant has certified that the activity
complies with and will be conducted in a manner that is consistent with the
approved state coastal zone management program. The ,applicant's certification
and accompanying information is available from, and any comments on, should
be addressed to the New York State Department of State, Division of Local
