Gentlemen:
Referring to my letter of June 4 and your
reply of July 14th referring me to the Town Police
or Highway Dept. may I again state that I am only
interested in ascertaining where the high water mark
is on Bayview Ave. and whether or not the owner of
the property facing Mattituck Creek at that point has
any legal right to erect a fence and sign prohibiting
access to land that for many years was under water
until the County dredged the creek and built up the
shore so that the high water is around 125 feet from
where it was previously.
For many years a number of the residents
of ShoreAcres moored their rwoboats in a lagoon that
was at the foot of Bayview Ave. and spread to the
properties on botbL sides of the Avenue and was about
125 feet from the present water line. This was land in
the public Domain and I assume that notwithstanding the
fact that the County filled it in the land is still
of that character and under the jurisdiction of some
governmental body and does not become the property
of the abutting property owner. So if you still feel
that this is not your concern will you please advise
me as to who had jurisdiction before dredging or what
authority I can contact as I am not concerned with the
avenue or policing in any way but the right to travel
on what has always been, to my mind, public lands.
