HARKER, party of the second part, Witnesseth, the party of the first part in consideration of the sure of $10.00, duly paid to the party of the first ,part before the delivery thereof, the receipt whereof is hereby duly acknowledged, has granted and doss hereby grant unto the said party of the second part, the heirs , successors and assigns of the party of the second part forever, permission to erect a dock in front of his property fronting on Mattituck Creek in Mattituck, in the Town of Southold, Suffolk County, New York, in aecordance with the plans submitted, Subject, however, to the public right of navigation and subject to the right of the public to pass and repass along that portion of the 'Leach between low and high grater nark. On condition, however, that the party of the second part will hold the said .T'rustees and the Town of Southold harmless and free from any and all damages and claims arising unddr or by virtue of said construction. The first is for the approval of a one family dwelling on the lot. No further approval is necessary and no expiration date is applicable here because the property is exempt from DEC control. The reason for this .being that the exist- ing bulkhead is in excess of 100 feet even though the property is only 75 feet. Where there is more than 100 feet of bulkheading the exemption applies. The second approval was obtained for -a dock, ramp and catwalk. . Said :,. approval expires on 6/30/79 and must either be assigned to you and/or renewed at a later date. The present approval was for specific dimensions outlined on a survey which we do not have. Therefore you would need to submit a new application with a work plan of the dock { to be constructed.
