TERMS and CONDITIONS
The Permittee Pat Colagiuri
residing at Bungalow Lane, Mattituck N. Y., as
pan of the consideration for the issuance of the Permit does understand and prescribe to the fol-
lowing:
1. That the said Board of Trustees and the Town of Southold are released from any and
all damages, or claims for damages, of suits arising directly or indirectly as a result of any oper-
ation performed pursuant to this permit, and the said Permit-tee will, at his or her own expense,
defend any and all such suits initiated by third parties, and the said Permittee assumes full liability
with respect thereto, .to the complete exclusion of the Board of Trustees of the Town of Southold
2. That this Permit is valid for .a period of 24 mos. which is considered to be the
estimated time required to complete the work involved, but should circumstances warrant, request
for an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes
to maintain the structure or project involved, to provide evidence to anyone concerned that auth-
orization was originally obtained.
4. That .the work involved will be subject to the inspection and approval of the Board or
its agents, and non-compliance with the provisions of the originating application, may be cause for
revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along
the beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations
in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the
work shall cause unreasonable obstruction to .free navigation, the said Permittee will be required,
upon due notice, to remove or alter this work or project herein stated without expenses to the Town
of Southold.
8. That the said Board will be notified by the Permittee of the completion of the work auth-
orized.
9. That the Permittee will obtain all other permits and consents that may be required sup-
plemental to this permit which may be subject to revoke upon failure to obtain same.

Dear Mr. Haje:
The following action was taken by the Board of Town Trustees during
its regular meeting held on October 3, _1991 regarding the above
matter:
WHEREAS, ROY HAJE ON BEHALF OF Pat Colagiuri applied to the
Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated July 24,
1991 and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on October 3, 1991 at which time all interested
persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and,
WHEREAS, the .Board has considered all the testimony and documentation
submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people 'of
the town,
NOW, THEREFORE BE IT
RESOLVED THAT ROY HAJE ON BEHALF OF PAT COLAGIRUI BE AND HEREBY IS
GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO: install from an
existing .bulkhead, a 3 ' X 12 ' hinged ramp leading to a 6' X 30 '
float. Float will be secured by ( 2) sets of 2 pile dolphins.
This permit will expire two 'years from the date it is signed. Fees
must be paid, if applicable, and permit issued within six months
of the date of this notification. Two inspections are required and
the Trustees are to be notified- upon completion of said project.
Please return to the Building Department for a determination on the
need for any other permits which may be required for this project.
Permit will be issued upon payment of the following fees for work to
be done below Mean High Water Mark:
Ramp 3 ' X 12 ' = 36 sq.ft. x $2 = 72. 00
Float 6' X 30 ' = 180 sq.ft. x 2 =360. 00

Re: Recommendation of Wetland Applications
The following recommendations were made by the CAC at its meeting
held Thursday, September 26, 1991 :
On a motion by John Holzapfel, seconded by Bruce Loucka, it was
RESOVLED to recommend to the Southold Town Trustees approval of
Wetland Application No. 35-7-4 of Pauline Israel to construct a 4' x 12'
catwalk, 3' x 10' ramp and 6' x 20' float. The CAC suggests everyone
move to their own proper space.

Motion carried.
On a motion by Stephen Angell, seconded by Robert Keith, it was
RESOVLED to recommend to the Southold Town Trustees conditional
approval of Wetland Application No.123-3-23 & 24 of Patrick, Colaguiri
to install, from an existing bulkhead, a 3' x 12' hinged ramp leading
to a 6' x 30' float. Float to be secured by two sets of two pile
dolphins. Approval is recommened provided the applicant provides
written permission from the property owner.

On a motion by Bruce Loucka, seconded by Robert Keith, it was
RESOVLED to recommend to the Southold Town Trustees approval
with exceptions of Wetland Application No. 71-2-8 and p/o 1 .3 of
George Koch to repair or replace, in kind, in place, existing bulkhead
return and extend landward to an overall length of 301. Repair 4' wide
walk landward of bulkhead. Appproximately 100 c.y. of clean sand
for bulkheading. The.Council recommends approval of the project
with exception of the fill. The Council objects to the backfill because
it will just wash into the channel.

On a motion by Robert Keith, seconded by Stephen Angell, it was
RESOVLED to recommend to the Southold Town Trustees approval
of Wetland Application No. 106-11-24 of Dorothy Northridge to replace
bulkhead, in kind, in place (621), Construct new bulkhead, 58' and
10' return attached to existing bulkhead. Install three support batter
piles to existing bulkhead.

GENERAL CONDITIONS
By acceptance of this permit,the permittee agrees that the permit is caatingerd upon strip compli-
ance with the ECL,all applicable regulations and the conditions specified herein or attached hereto.
1. The permittee shall file in the office of the appropriate regional permit administrator,or other office designated in the specialconditions,a notice of intention to commence
work at least 48 hours in advance of the time of commencement and shall also notify himther promptly in writing of the completion of the work.
2. The permitted work shall be subject to inspection by an authorized representative of the Department of Environmental Conservation which may order the work suspended if
the public interest so requires pursuant to ECL§71-0301 and SAPA§401(3).
3. The permittee has accepted expressly,by the execution of the application,the full legal responsibility for all damages,direct or indirect,of whatever nature,and by whomever
suffered,arising out of the project described herein and has agreed to indemnify and save harmless the State from suits,actions,damages and costs of every name and descrip-
tion resulting from the said project.
4 The Department reserves the right to modify, suspend or revoke this permit at any time after due notice, and, if requested, hold a hearing when:
a) the scope of the project is exceeded or a violation of any condition of the permit or provisions of the ECL and pertinent regulations are found;or
b) the permit was obtained by misrepresentation or failure to disclose relevent facts;or
c) newly discovered information or significant physical changes are discovered since the permit was issued.
5 The permittee is responsible for keeping the permit active by submitting a renewal application,including any forms,fees or supplemental information which may be required
by the Department, no later than 30 days(180 days for SPDES or Solid or Hazarduous Waste Management permits)prior to the expiration date.
6. This permit shall not be construed as conveying to the applicant any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the
permitted work or as authorizing the impairment of any rights,title or interest in real or personal property held or vested in a person not a party to the permit.
7 The permittee is responsible for obtaining any other permits, approvals, lands, easements and rights-of-way which may be required for this project.

6. Docks and floats shall not extend laterally beyond property lines, be
placed so that docked boats extend over adjacent property lines,
interfere with navigation, or interfere with other landowners' riparian
rights.
7. Dock reconstruction or replacement or seasonal installation shall not
involve expansion or substantial modification of existing structures or
facilities.
8. Installation of additional docks at marinas, boat basins, or other
commercial facilities is not authorized by this. permit.
9. No dredging, excavating or other alteration of shoreline or underwater
areas is authorized by this permit, nor shall issuance of this permit be
construed to suggest that the Department will issue a permit for such
activities in the future.

SUPPLEMENTARY SPECIAL CONDITIONS
The following conditions apply to all permits:
A. If any of the permit conditions are unclear, the permittee shall con-
tact the Division of Regulatory Affairs at the address and telephone
noted below.
B. A copy of this permit with supplementary conditions and approved
plans shall be available at the project site whenever authorized
i
work is in progress.
C. The permit sign enclosed with the permit or a copy of letter of
approval shall be protected from the weather and posted in a con-
spicuous location at the work site until completion of authorized work .
D. At least 48 hours prior to commencement of the project, the permittee
shall complete and return the top portion of the enclosed receipt form
certifying that he is fully aware of and understands all provisions and
conditions of this permit. Within one week of completion of the
`. : permitted work, the bottom portion of that form shall also be com-
pleted and returned.
E. For projects involving activities to be accomplished over a period of
more than one year, the permittee shall notify the Regional Permit
Administrator in writing at least 48 hours prior to the commencement
of resumption of work each year .
F. If project design modifications take place after permit issuance, the
permittee shall submit the appropriate plan changes for approval by
the Regional Permit Administrator prior to undertaking any such modi-
fications . The permittee is advised that substantial modification
may require submission of a new application for permit .
G. All necessary precautions shall be taken to preclude contamination of
any wetlands or waterway by suspended solids, sediment, fuels,
solvents, lubricants, epoxy coatings, paints, concrete, leachate or
any other environmentally deleterious materials associated with the
project work .
H. Any failure to comply precisely with all of the terms and conditions
of this permit , unless authorized in writing, shall be treated as a
violation of the Environmental Conservation Law.
I . The permittee is advised to obtain any permits or approvals that may
be required from the U.S. Department of Army Corps of Engineers, NY
District , 26 Federal Plaza, New York, NY 10278, (Attention: Regulatory
Functions Branch) , prior to commencement of work authorized herein.
J. The granting of this permit does not relieve the permittee of the
responsibility of obtaining a grant , easement, or other necessary
approval from the ,Division of Land Utilization, Office of General
Services, Tower Building, Empire State Plaza, Albany, NY 12242, which
may be required for any encroachment upon State-owned lands underwater .
