Dear Jill:
As per our conversation the other day, I have enclosed an amended survey of our property in
Cutchogue showing the previously approved dock_and walkway, permit number 4542. The dock
and walkway have not yet been built. The new position of the dock and walkway is located
parallel to the original position and northerly about 45 feet so that the water is deep enough for
my boat at low tide. The construction of the dock and walkway will be the same as previously
submitted.

ASSESSMENT FORM
Policy 7
The proposed activity has been designed to result in little or no impact
on significant coastal fish and wildlife habitats, eg, the elevated timber
walkway and floating dock.
Policy 11
The proposed activity has been sited to minimize damage to property
and the endangering of human lives caused by flooding and erosion, eg. the
proposed first floor elevation of 12.0 of the house is above the required flood
elevation.
Policy 12
The proposed activity has been designed to minimize damage to natural
resources and property from flooding and erosion by protecting natural
protective features. The existing tidal wetlands will be essentially undisturbed
by maintaining a 50' buffer (no fill),75' minimum setback to all structures, and
construction of the elevated timber walkway and floating dock.
Policy 17
Non-structural measures are proposed to minimize damage to natural
resources and property from flooding and erosion, eg, setbacks to structures
and setting the first floor of the house above the base flood elevation.
Policy 44
The proposed activity has been designed to preserve and protect the
tidal wetlands and to preserve the benefits derived from these areas. A tidal
wetlands permit has been obtained from the New York State Department of
Environmental Conservation. A tidal wetlands permit is pending from the Town
of Southold Board of Trustees.

received a request for Department of the Army authorization for-
the following activity:
APPLICANT: Robert F. & Barbara A. Coady

ACTIVITY: Install a 3 by 110 foot timber pier elevated a
minimum of 3 .5 feet above the grade of the marsh,
a 3 foot by 25 foot hinged ramp and a 8 foot by 25
foot float.
WATERWAY: East Creek, Great Peconic Bay
LOCATION: East Cutchogue, Town of Southold, Suffolk County,
New York.
As this is minor in nature, authorization may be by Letter
of Permission. This is in accordance with current Federal
Regulations governing work in navigable waters of the United
States. To accomplish the coordination required, prior to the
issuance of a Letter of Permission, your review of the enclosed
drawings is requested.
Pursuant to Section 307 (c) of the Coastal Zone Management
Act of 1972 as amended (16 U.S.C. 1465 (c) ) , the applicant has
certified that the activity complies with and will be conducted
in a manner that is consistent with the approved state coastal
zone management program.

Dear Mr.Wolpert:
The following action was taken by the Board of Town Trustees
during its regular meeting held on November 30, 1995 regarding
the above matter:
WHEREAS, Young & Young 'on behalf of ROBERT F. COADY applied to
the. Southold Town Trustees for a permit under the provisions of
the Wetland Ordinance of the Town of Southold, application dated
October 13,1995, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their. findings and
recommendations., and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on November 30, 1995, at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 37-18 of the Southold Town Code,
WHEREAS, the Board. .has determined that the project as proposed
will not affect the health, safety and general welfare of the.
people of the. town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees grants a Wetland Permit to
Young & Young on behalf of ROBERT F. COADY to construct a single .
family dwelling and related improvments including driveway,
sanitary. system, well, deck, shed, a 3 ' X "110' catwalk, 31. X 251
hinged ramp and a 6.' X 20' float: Haybales shall be placed at ' ' -
the 50' buffer line. As per survey dated December 4, 1995 and
DEC Permit.
and,
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct project will expire two years from the date
it is signed if not started. Fees must be paid, if applicable.,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

relevant facts;

continuous line of staked hay bales/silt curtain (or other NYSDEC
approved method) placed on the seaward side between the fill and
wetland or protected buffer area. Tarps are authorized to
supplement these approved methods.
5. All fill shall consist of "clean" sand, gravel, or soil (not
asphalt, flyash, broken concrete or demolition debris) .

6• To protect the values of the tidal wetlands, a permanent
vegetated buffer zone shall be established. There shall be no
disturbance to the natural vegetation or topography within an
area extending 50 linear feet landward of the tidal wetland
boundary.
7• A row of staked hay bales or approvable erosion control
devices shall be placed at the landward edge of the buffer area
or 50 linear feet from the tidal wetland boundary, or as per
NYSDEC approved plan, at commencement of regulated activities and
. remain in place until project is completed and all disturbed
areas stabilized with vegetation.
8• Roof runoff shall be directed to drywells a minimum of lo0
feet landward of the tidal wetland boundary for immediate on-site
recharge.

SUS ,EME.NTAR`I SPECIAL CONDITTC
The following conditions apply to all Tidal Wetlands Freshwater
Wetlands; Coastal Erosion Management; and Wild, Scenic, and
Recreational Rivers Permits:
A. A copy of this permit, including all conditions and
approved plans, shall be available at the project site
whenever authorized work is in progress. The permit
sign enclosed with the permit shall be protected from
the weather and posted in a conspicuous location at the
work site until all authorized work has been completed.
B. The permittee shall require that any contractor,
project engineer, or other person responsible for the
overall supervision of this project reads, understands,
and complies with this permit and all its general,
special, and supplementary special conditions. Any
failure to comply precisely with all of the terms and
conditions of this permit, unless authorized in
writing, shall be treated as a violation of the
Environmental Conservation Law. If any of the permit
conditions are unclear, the permittee shall contact the
Division of Regulatory Affairs at the address on page
one or telephone (516) 444-0365.
C. If project design modifications become necessary after
permit issuance, the permittee shall submit the
appropriate plan changes for approval by the Regional
Permit Administrator prior to undertaking any such
modifications. The permittee is advised that
substantial modification may require submission of a
new application for permit.
D. At least 48 hours prior to commencement of the project,
the permittee and contractor shall sign and return the
top portion. of the enclosed notification form
certifying that they are fully aware of and understand
all terms and conditions of this permit. Within 30
days of completion of the permitted work, the bottom
portion of that form shall also be signed and returned,
along with photographs of the completed work and, if
required, a survey.
E. For projects involving activities to be undertaken in
phases over a period of more than one year, the
permittee shall notify the Regional Permit
Administrator in writing at least 48 hours prior to
recommencing work in subsequent years.
F. The granting of this permit does not relieve the permittee
of the responsibility of obtaining a grant, easement, or
other necessary approval from the Division of Land
Utilization, Office of General Services, Tower Building,
Empire State Plaza, Albany, NY 12242 (516) 474-2195, which
may be. required for any encroachment upon State-awned lands
underwater.

ATTACHMENT TO FEDERAL CONSISTENCY
ASSESSMENT FORM
Policy 7
The proposed activity has been designed to result in little or no impact
on significant coastal fish and wildlife habitats, eg. the elevated timber
walkway and floating dock.
Policy 11
The proposed activity has been sited to minimize damage to property
and the endangering of human lives caused by flooding and erosion, eg. the
proposed first floor elevation of 12.0 of the house is above the required flood
elevation.
Policy 12
The proposed activity has been designed to minimize damage to natural
resources and property from flooding and erosion by protecting natural
protective features. The existing tidal wetlands will be essentially undisturbed
by maintaining a 50' buffer (no fill), 75' minimum setback to all structures, and
construction of the elevated timber walkway and floating dock.
Policy 17
Non-structural measures are proposed to minimize damage to natural
resources and property from flooding and erosion, eg. setbacks to structures
and setting the first floor of the house above the base flood elevation.
Policy 44
The proposed activity has been designed to preserve and protect the
tidal wetlands and to preserve the benefits derived from these areas. A tidal
wetlands permit has been obtained from the New York State Department of
Environmental Conservation. A tidal wetlands permit is pending from the Town
of Southold Board of Trustees.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH STIPULATIONS of the Wetland Application of ROBERT F. COADY and
BARBARA A. COADY 103-9-1 to construct a single family dwelling and related
improvements including driveway, sanitary system, well, deck, shed, elevated
timber walkway, gangway, and floating dock.
The Council recommends approval with the stipulation that the applicant
move walkway 15' from the property line and turn the proposed floating dock so
it is straight and not in a "T" formation; also place hay bales at the 7'
contour line.

Our agency has no record of a current application for the proposed action as required by
Article VI of the Suffolk County Sanitary Code (SCSC). We recommend that the project sponsor
submit an application to our agency's Bureau of Water and Wastewater at the earliest possible date
so that a complete technical assessment of this proposal can be undertaken.

Sanitary Waste/Storrnwaiter)Runoff:
We are concerned with the proposed sanitary system with respect to the shallow depth to
groundwater which exists at the site,which may hinder the operation of a sanitary system.
Diminished treatment of wastewater can result in increased bacteriological,virological, and
nitrogen(and phosphorus)loading to groundwater and/or surface water.
Our concerns with the proposed sanitary system are magnified by the shallow depth to
groundwater and the proximity of the proposed project to surface waters. The surface waters of
this area are stressed by stormwater runoff and septic system effluent pollution contribution
created by past and present development pressure. In general, septic systems near surface waters
can result not only in increased bacteriological and virological contamination,but also in elevated
.BOD, solids, and nutrient(nitrogen and phosphorus)loading to surface waters. Such loading
could result in adverse effects on a surface water ecosystem and,ultimately,in the accelerated
pollution and/or eutrophication of the system.
In addition,a reduced leaching pool setback could result in an increased risk of channelling of
septic system effluent flow into a surface water as well as a stormwater runoff risk in the event of
septic system failure. Thus, any project which may have an adverse impact on these surface
waters deserves close scrutiny to examine measures to mitigate the potential adverse impacts to the
maximum practicable extent.
In the case of the proposed project,this scrutiny should extend to an evaluation of impacts of
stormwater runoff and septic system effluent on on-site and neighboring wetlands and natural
resources in addition to groundwater and surface water. The loss of vegetation,wildlife habitat,
and open space should also be carefully assessed(, as should any available hydrogeologic and
surface water quality data.
NATURAL RESOURCES:
The SCDHS fully supports all efforts to maximize protection of natural resources which may
be impacted upon by construction and development activities. It is the position of the department
that the SEQRA review process provides the greatest opportunity for comprehensive consideration
of these resources, and that all practicable planning measures should be employed to help ensure
their protection.
Of particular concern to department is the adequate protection of wetlands, surface waters,
natural communities,contiguous natural habitats, and rare,threatened and endangered species. In
addition,efforts to protect sensitive physical resources such as groundwater and shorelines are
fully supported and encouraged by the SCDHS.

In general,the department encourages the following land use measures be considered(where
appropriate)to actions being reviewed pursuant to SEQRA.
1. Maximum practicable setbacks from all wetlands and surface waters.
2. Non-disturbance buffers between wetland limits and required structural setbacks.
3. Stringent clearing limitations which can reduce potential impacts to wildlife habitats,
vegetative communities, and unconsolidated soils.
4. Maximum use of native species for landscaping purposes.
SCDHS Compliance Requirements and Jurisdiction:
The applicant must comply with the requirements of the Suffolk County Sanitary Code and
relevant.construction standards for water supply and sewage disposal. Design and flow
specifications, subsurface soil conditions, and complete site plan details are essential to the review
of this project. These considerations are reviewed completely at the time of SCDHS application.
SCDHS maintains jurisdiction over the final location of sewage disposal and water supply
systems. The applicant,therefore, should not undertake the construction.of either system without
Health Department approval.

1 . The impacts during construction will be temporary and minor in nature. In addition, I
they will be reduced to non-significant levels through the use of erosion control I
devices.
2. Project is consistent with surrounding land uses. There will be no significant
impact to agricultural, archeological, historic or cultural resources as the I
construction impacts are temporary and site disturbance is minor.
3. The setbacks/buffer zones will reduce any impacts on wetlands and wildlife habitats -
to a non-significant level. No threatened or endangered species were identified at
-this site.
4. This project is not expected to induce any subsequent- activities, area is currently
developed with similar structures.
5. No long term or cumulative impacts will result if constructed in accordance to the
approved plans and conditions.

FULL ENVIRONMENTAL ASSESSMENT FORM
Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent-
ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine
significance may have little or no formal knowledge of the environment or may not be technically expert in environmental
analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting.
the question of significance.
The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination
process has been orderly, comprehensive in nature,yet flexible enough to allow introduction of information to fit a project
or action.

This letter is in response to your letter .of 316/95.
1. While I cannot guarantee the approval of a dock without
fully reviewing a complete application, the sketch which you
have submitted.. is "generally approvable".
2. The purpose or intent of the catwalk is to provide the
boater access to his floating dock without harming the marine
environment.
3 . . The standard width of the catwalk is 3 ' and New, Y,�rk State
Department of Environmental Conservation specifies that it must
be 3 ' above grade.
4. As far as actual building requirements, the Building
Department would be a more appropriate source of information for
that.
Also our jurisdiction for any activity is 75 ' upland of the
wetland. This includes clearing, grading and building.

Dear Diane:
As per our conversation, I am requesting an inspection of a piece of waterfront property that my
wife and I are.considering purchasing on Beebe Drive and Wilson Avenue in Cutchogue. I hope
that the inspection will provide us with the following information:
1. If applied for will a dock be approved?
2. If a dock is approved, is a catwalk to the dock mandatory?
3. If it is required what height and width must the catwalk be?
4. Is the property in a"Flood Zone", and if it is, can fill be used to raise the level of the
house so that it would be safe from flood effects?
The property number is 1000-103-9-1. Enclosed is a copy of the property.survey on which I have
drawn the tentative location of a future dock and catwalk over the wetlands to it. The other
information on the survey is from a while back and I believe that the permits have expired. We
would appreciate receiving any other information that you may be aware of that could impact our
decision to purchase this property and also any recommendations you can make as to how to
proceed cautiously. Our intentions are to build and live in a year round home on that site.
I have enclosed a check for$40.00 for the inspection.

Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a projec
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequen-
ly, there are aspects of a project that are subjective o.r unmeasureable. It is also understood that those who determin
significance may have little or no formal knowledge of the environment or may not be technically expert in environments
analysis. In addition,many who have knowledge in one particular area may not be aware of the broader concerns affectin:
