You are advised that staff is maintaining objections to your proposal to bulkhead, dredge and fill in a mapped tidal wetlands area. If resolution of the issues cannot be achieved at the conference I will recommend a prompt decision on this matter to the Department's Central Office in Albany. The D.E'.C. suggested that this would be the best way for them to review the situation and allow them to make a change in their findings. Hgpefully, this will allow us to get started in an attempt to prevent further erosion and a lot more winter damage. The decision whether to issue a permit will be based on an evaluation of the probable impact of,-the proposed activity on the public interest. That decision will reflect the national concern for both protection and utilization of important resources. The benefit which reasonably may be expected to accrue from the proposed work must be balanced against its reasonably foreseeable detriments. All factors which may be relevant to the proposed work will be considered; among those are conservation, eco- nomics, aesthetics, general environmental concerns, historic values, fish and wildlife values, flood damage prevention, land use, navigation, recreation, water supply, water quality, energy needs,' safety, food pro- duction and, .in general , the needs and welfare of the people. Plans District Engineer 2 NANY FL-129-1 Aug 78 NANOP-E APPLICATION NO. 81-190 PUBLIC NOTICE NO. 10682-81-190-L2 DESCRIPTION OF WORK The applicant proposes to construct an 18' jetty extension to the west of the entrance channel to Gull Pond. The purpose of this project is to stabilize the beach to the west of the channel and minimize shoaling in the channel. The applicant also proposes to maintenance dredge the hatched, semi-elliptical area shown on the attached drawing. Dredging will be performed to a depth of 7 feet below the plane of mean low water to remove approximately 60 cubic yards of sand, The dredged material will be deposited on the cross- hatched area shown on the attached drawing where it will be suitably retained by the existing bulkhead to prevent reentry into the waterway. Future dredging operations are anticipated to be needed once over the ten year life of the permit. In addition the applicant proposes to repair the existing bulkhead on both sides of the canal. The repaired bulkhead wi'I1 be of the same material and will be in the same location and configuration as the existing bulkhead. This portion of the project is authorized by .a Corps of Engineers nationwide permit and .does not require further authorization before it is undertaken. . The moored boats become a nuisance to the residents with late nights and early morning activities.
