The validity of this permit is or may be subject to the approval of other governmental or municipal
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, the holder of this permit shall not commence operations here-
under until such approval has been obtained in writing. The failure to obtain such other approval when
required shall subject this permit to immediate revocation by the Trustees upon receipt by the
Trustees. of written notice from such other governmental or municipal authorities of its refusal or
disapproval.

The applicant does by.the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this'permit, and shall take all precautions for the prevention of injuries to persons
and property resulting,from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and all claims arising
from operations under,this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
this permit are being conducted, do, by the.acceptance of this permit, give consent to the Town, and
its officers and employees to enter upon the premises where such operations are being conc.�i:c:ed to
make such inspections as the Town may deem necessary to insure that-such operations are being con-
ducted in conformity with this permit:
This operation will not substantially:
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety and general welfare of the people of the town.

Dear Mr.. Haje:
The following. action was taken by the Board of Trustees at their
regular meeting held on April 24, 1986 regarding the application for
Dr. Vincent Claps.
Moved by Trustee Larsen seconded by Trustee Bredemeyer
WHEREAS , En-Consultants, Inc. on behalf of Dr. Vincent Claps applied
to the Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated
November 15, . 1985, and
WHEREAS , said application was referred to the Southold Town Conservation
Advisory Council for their findings and recommendations and,
WHEREAS , a Public Hearing was held by the Town Trustees with respect
to said application on April 24 , 1986 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and. are familiar with
the premises in question and the surrounding area; and
WHEREAS, the Board considered all testimony and documentation submitted
concerning this application; and it is noted for the record that there
has been no public opposition; and -
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety, and general welfare of the people of ,
the Town,
NOW, THEREFORE, BE IT
RESOLVED, that En-Consultants, Inc. on behalf of Dr. Vincent Claps be
and hereby is granted permission to construct a dock consisting of a
3 ' x 16 ' hinged ramp and 6 ' x 20 ' float secured by (2) 8" pilings. This
permit is granted under the provisions of the Wetland Ordinance of the
Town of' Southold. This permit will expire on April 24 , 1987 if work
Has not commenced by same. There are two inspections required and the
Trustees are to be notified upon completion of the work.

There is a $5. 00 inspection fee now due and payable, upon
remittance your permit will be forwarded by mail.

This notice is issued pursuant to the provisions of Article 8
of the Environmental Conservation Law State Environmental Quality
Review and 6NYCRR Part 617, Section 617. 10 and Chapter 44 of the
Code of the Town of Southold, Notice is hereby given that the
Southold Town Trustees, as lead agency for the action described
below has determined that the project will not have a significant
effect to the environment.
TYPE OF ACTION: Unlisted
DESCRIPTION OF ACTION: To construct a 3 ' x 16 ' hinged ramp and 6 ' x 20 '
float secured by (2) 8" spiles. .
LOCATION OF PROJECT: Town of Southold, County of Suffolk, more
particularly known as: 817 Main Street, Greenport, NY 11944;

REASONS SUPPORTING THIS DETERMINATION:
1 . An environmental assessment form in the short form has been
submitted which indicated that there would be no adverse effect
to the environment should the project be implemented as planned.
2. Because there has been no response in the allotted time from the
Southold Town Building Dept. and the N.Y.S . D.E.C. it is assumed
that there are no objections nor comments from those ai en i s.
.3. The project as proposed will not adversely . affect the ea
safety and general welfare of the people of the town.

d. That the discharge will not destroy a threatened or endangered species as identified under the Endangered Species Act,
or endanger the critical habitat of such species.
e. That the permittee agrees to make every reasonable effort to prosecute the construction or operation of the work
authorized herein in a manner so as to minimize any adverse impact on fish,wildlife,and natural environmental values.
f. That the permittee agrees that he will prosecute the construction or work authorized herein in a manner so as to minimize
any degradation of water quality.
g. That the permittee shall allow the District Engineer or his authorized representative(s)or designee(s)to make periodic in-
spections at any time deemed necessary in order to assure that the activity being performed under authority of this permit is in
accordance with the terms and conditions prescribed herein.
h. That the permittee shall maintain the structure or work authorized herein in good condition and in reasonable ac-
cordance with the plane and drawings attached hereto.
i. That this permit does not convey any property rights,either in real estate or material,or any exclusive privileges;and
that it does not authorize any injury to property or invasion of rights or any infringement of Federal,State,or local laws or
regulations.
j. That this permit does not obviate the requirement to obtain state or local assent required by law for the activity authoriz-
ed herein.
k. That this permit may be either modified, suspended or revoked in whole or in part pursuant to the policies and pro-
cedures of 33 CFR 325.7. `
L That in issuing this permit,the Government has relied on the information and data which the permittee has provided in
connection with his permit application.If,subsequent to the issuance of this permit,such information and data prove to be
materially false,materially incomplete or inaccurate,this permit may be modified,suspended or revoked,in whole or in part,
and/or the Government may,in addition,institute appropriate legal proceedings.
m. That any modification,suspension,or revocation of this permit shall not be the basis for any claim for damages against
the United States.
n. That the permittee shall notify the District Engineer at what time the activity authorized herein will be commenced,as
far in advance of the time of commencement as the District Engineer may specify,and of any suspension of work,if for a period
of more than one week,resumption of work and its completion.
o. That if the activity authorized herein is not completed on or before day of .19 .(three years
from the date of issuance of this permit unless otherwise specified)this permit,if not previously revoked or specifically extended.

p. That this permit does not authorize or approve the construction of particular structures,the authorization or approval of
which may require authorjzation by the Congress or other agencies of the Federal Government.
q. That if and when the permittee desires to abandon the activity authorized herein,unless such abandonment is part of a
transfer procedure by which the permittee is transferring his interests herein to a third party pursuant to General Condition t
hereof,he must restore the area to a condition satisfactory to the District Engineer.
r. That if the recording of this permit is possible under applicable State or local law,the permittee shall take such action as
may be necessary to record this permit with the Register of Deeds or other appropriate official charged with the responsibility
s. That there shall be no unreasonable interference with navigation by the existence or use of the activity authorized
herein.
t. That this permit may not be transferred to a third party without prior written notice to the District Engineer,either by
the transferee's written agreement to comply with all terms and conditions of this permit or by the transferree subscribing to
this permit in the space provided below and thereby agreeing to comply with all terms and conditions of this permit.In addi-
tion,if the permittee transfer the interests authorized herein by conveyance of realty,the deed shall reference this permit and
the terms and conditions specified herein and this permit shall be recorded along with the deed with the Register of Deeds or

u. That if the permitter during prosecution of the work authorized herein, encounters a previously unidentified ar-
cheological or other cultural resource within the area subject to Department of the Army jurisdiction that might be eligible for

II. Special Condltions:(Hen list conditions relating specifically to the proposed structure or work authorized by this permit):
The following Special Conditions will be applicable when appropriate:
STRUCTURES IN OR AFFECTING NAVIGABLE WATERS OF THE UNITED STATESt
a. That this permit does not authorize the interference with any existing or proposed Federal project and that the permittee
shall not be entitled to compensation for damage or injury to the structures or work authorized herein which may be caused by
or result from existing or future operations undertaken by the United States in the public interest.
b. That no attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or
adjacent to the activity authorized by this permit.
C. That if the display of lights and signals on any structure or work authorized herein is not otherwise provided for by law,
such lights and signals as may be prescribed by the United States Coast Guard shall be installed and maintained by and at the
expense of the permittee.
d. That the permittee,upon receipt of a notice of revocation of this permit or upon its expiration before completion of the
authorized structure or work,shall,:without expense to the United States and in such time and manner as the Secretary of the
Army or his authorized representative may direct,restore the waterway to its former conditions.If the permittee fails to com-
ply with the direction of the Secretary of the Army or his authorized representative,the Secretary or his designee may restore
the waterway to its former condition,by contract or otherwise,and recover the cost thereof from the permittee.
e. Structures for Small Boats:That permittee hereby recognizes the possibility that the structure permitted herein may be
subject to damage by wave wash from passing vessels.The issuance of this permit does not relieve the permittee from taking all
proper steps to insure the integrity of the structure permitted herein and the safety of boats moored thereto from damage by
wave wash and the permittes shall not hold the United States liable for any such damage.

OLD BUSINESS :
Jeanne Marriner suggested, at -some time, someone should
contact an attorney (possibly retired or someone from out of
town) to aid in drawing up changes to the Town Ordinances .
These changes then could be presented to the Town Board for
approval. Some of the issues she feels should be addressed
.are lawn sprinkling and its effects with saltwater intrusion,
and changes along those lines .
Martin Garrell stated Councilman Paul Stoutenburgh would
like the CAC to send a letter to the Town Board regarding
the sensitivity of the Sebastian Cove area. Jeanne Marriner
will draft the letter.
NEW BUSINESS :
Jeanne Marriner attended a meeting with the Shelter Island
CAC, Shelter Island Supervisor, .Dave Newton and Ruth Oliva
concernig ground water and waste disposal . This group is
planning a media blitz to educate the public and if the program
is successful they may need Southold CAC' s help in the future.
WETLAND APPLICATIONS
RECOMMENDATIONS
Wetland Application No. 319 of Ted Dowd is still tabled.
A letter was sent to Mr. Dowd requesting his presence at a
future meeting to ,answer questions- con cer-n ng--h-i-s- application .
Wetland Application No . 333 of Dr. Vincent Claps remains
;tabled until a letter by John Holzapfel is sent and action is
taken by the applicant .
On a motion made by Martin Garrell, seconded by Ralph Condit it was
RESOLVED to table Wetland Application No. 335 of John J. Newman
to drive pilings to shore up existing garage and second story to
be added. The Council feels it must table this matter pending
approval of the two story garage. It appears two story buildings
go against the deed and covenants. If the garage receives
approval then questions will be asked

If the second story of the garage is not approved, then it is
not clear if pilings are necessary . It is not clear that the garage

RESOLVED to recommend to the Southold Town Trustees disapproval
of Wetland Application No . 334 submitted by En-Consultants, Inc.
on behalf of John Xikis to construct 200 ± l . f. timber retaining
wall from corner to corner of adjacent retaining wall and approx-
imately 101 . in front , of failing gabion wall . Backfill with 275+
cubic yards of clean sand to be tracked in from commercial upland
source. Proposed wall will be above spring H. W. Construct a. 50 '
stone groin approximately50 ' west of east property line and pre-
fill up-drift side with 40+ cubic yards of sand and gravel to be
trucked in.
The Council feels the present wall is serving its purpose
there is no need for bulkheading. Also of concern is the severe
impact on the downdrift neighbors of the proposed groin. In
addition, creation of additional land to an existing beach is
contrary to the existing Wetlands Ordinance. In conclusion, the
applicant should leave AS IS, the stones and screens appear quite
secure. The cove is sheltered from the northwest by a natural
point .
Vote of Council : Ayes: All

RESOLVED to table Wetland Application No. 336 submitted by
Glenn Heidtmann. The Council wishes to await notice from the

RESOLVED to recommend to the Southold Town Trustees- disapproval
of Wetland Application No. 337 submitted by John Schoenstein
to approximately 40 yds of fill for proposed building. The Council
disapproves because:
1. The creek is about to be designated as a significant habitat .
It is critical to vast freshwater wetlands and uplands
;�. as far north as Moores Woods .
2. The setback is not observed with care on the present lot .
Rubble fronting on the creek and banks are already a hazard.
3. The building can be sited perpendicular to current plan.
4. Town ordinances are already in question due to expansion
of facilities and previous variances .
Vote of Council : Ayes: All

Dear Mr. Haje:
In regard to the above captioned wetland application,
the Southold Town Conservation Advisory Council is concerned
about the configuration and length of the intended dock. We
believe -the land next to the existing docks extends further
out into the creek and if the proposed dock were built, it
would extend too far into the creek. As a result it would
interfere with navigation and the right of the owners on the
opposite-Side of the creek to build a dock of their own in the
future.
Based on the existing proposal the Council would recommend
disapproval to the Southold Town Trustees . We suggest that
you reconfigure the proposed dock, keeping the above mentioned
problems in mind, and either amend or resubmit the wetland
application.

Wetland Application No. 324 Arthur J. Bujnowski - Table - The
Council reinspected the application at the request of the
Town Trustees. After another inspection and being alerted
that there were objections by neighbors ,. the Council decided
to table the application pending a meeting of all ' those
neighbors concerned in the surronding properties . They ineed to
find a solution to best handle the problem of erosion and
property loss . The Council feels .the property owners
need an expert in littoral drift to advise on proper place-
ment of groins.
Wetland Application No. 336 Glenn F. Heidtmann - Table - The
