The Salt Lake Village Association permit authorized maintenance dredging and placement of spoil on the Cicorelli parcel. As Mr. Cicorelli is in need of fill, in the vicinity of his pro- posed home, which is farther landward than the proposed spoil deposition site for. the Salt Lake Association, we would like to amend the permit to authorize placement of the spoil within the previously approved area for the Cicorelli project. The area will be bermed in order to contain the hvdraulic spoil and will not be upon any wetlands . As this modification entails movement of the spoil area farther away from the waterway, we trust there will be no objection. RESOLVED that the Southold Town Trustees RESCIND their Lead Agency Declaration declared on July .27, 1987 regarding the application submitted by En-Consultants, Inc. on behalf of Pat Cicorelli pursuant to the plan provided and with the provision that the house placement is 100' landward from the most landward piling on the beach of the two and with the understanding that the lower portion of the house will be 100' from the most landward piling and that there is a second story deck on the plan that will be closer than the 100' on the plan as per conversation with the Board on August 27, 1987 and RESOLVED that the Southold Town Trustees determine that the project as proposed by En-Consultants, Inc. on behalf of Pat Cicorelli is determined to be out the" the Trustees jurisdiction in accordance with the plan submitted which is dated August 27, 1987. Dear Sirs: I have received a copy of Bay Constable McCarthy's field inspection report dated June 1, 1987. In anticipation of this eventuality, my May 15, 1987 cover letter which accompanied a full application requested that you proceed with. processing of the application, which request I again restate here. However, I should also like you to conduct a full Board inspection of the subject premises to verify Mr. McCarthy's findings. I would like to point out that this parcel was previously used for spoil deposition for the dredg- ing of James Creek. In addition it has recently been approved by the Trustees as a spoil deposition site for the dredging of Salt Lake Association Basin. The vegetation found upon it consists of a mixture of up- land and wetland species indicative of disturbed spoil areas. Therefore, .I am hopeful that your Board will determine that the project will not be within the purview of the Town's wetlands jurisdiction. Again, however, if it is, please proceed with processing. As I understand your jurisdiction to extend 75' from the line of mean high water or wetlands, this pro- ject may be beyond your jurisdiction. He was more concerned witht he Bay Constable's report about the spartina, etc. and he felt that it was prejudicial in a "sence". I advised .that the Board would be making their own inspection on the property, during the application process, and If he wanted the Board to inspect again that he should write a letter advising same.
