Gillispie, Jr., Chairman Robert Bergen Herbert Rosenberg Charles Gregonis,Jr. Serge Doyen, Jr. MINUTES Southold Town .Board of Appeals February 4, 1959 A regular meeting of the Southold Town Board of Appeals was held at the Town Clerk's Office, Southold, New York, on Wednesday, February 4, 1959 at 7:30 P.M. There were present: Messrs. Robert W. Gillipie, Jr., Chairman, Robert Bergen and Charles Gregonis, Jr. Absent: Mr. Herbert Rosenberg and Mr. Serge Doyen, Jr. Also present: Mr. Howard M. Terry, Building Inspector. PUBLIC HEARING: Appeal No. 1350 upon application of Eva M. Mains 100 Circle Drive, Plandome Manor, Long Island, New -: York*9 for a. variance in accordance with` the- Zoning Ordinance, Article IVY Section 4009 Subsection 19 for permit construct duplex dwellings on -lots 10, 11 and 12 located at east side Goldin Lane, Southold, New York. Chairman opened the hearing by reading application for the variance, notice of disapproval issued to applicant by the Building Inspector, and legal notice of hearing with affi- davit attesting to its publication in the official newspaper. Mr. Terry showed a sketch of the property and described same. CHAIRMAN: Is there anyone present who wishes to speak for this application? Southold Town Board of Appeals -2- February 4, 1959 Mr. Gordon Ahlersq Jamesport, New York spoke for the appli- cant. Mr. Ahlers produced a cardboard mode of the property and proposed location of the - structures, and stated they would like to construct four (4) units. He indicated the side yard and rear yard requirements have been complied with and then explained that the average setback on Soundview Avenue is 26 ft. and on Goldin bane 17 ft. Discussion was held relative to the previous appeals made by Mrs. Main on lots 11 and combined lots 13 and 14. CHAIRMAN: The buildings you would like to move, how are they to be located with relation to Goldin Zane? MR. AHLERS: Those cottages we will move back 45 or 50 ft. from the street line. MR. BERGEN: What have you allowed for parking area for cars? _ MR. AHLERS: There will be space provided next to the porch on each side, and in the -back of the duplexes, there will 'be room for that. -- As I mentioned before the hearing began, there will be a central water system to supply all units, and there will be two cesspools for each unit. The density allowed by the Code is for 20 families and we are only putting in 10 families. As far as enhancing the area, this cluster of cottages will improve the area greatly. CHAIRMAN: How many lots was this in before? MR. AHLERS: Seven lots. CHAIRMAN:- . Mr. Terry, is this a filed map? MR. TERRY: This is a filed subdivision. CHAIRMAN: It is proposed to place six structures in the final arrangement of the buildings on seven lots, is that correct? MR. AHLERS: Yes. MR. MAIN: There will be lawn around the entire areal and driveways for parking in the rear. There would be no necessity for parking on the road - Goldin Lane. There was considerable discussion relative to placing of the cottages which are to be moved to the rear of the property and it was decided they should be placed at the minimum distance allowable by the Ordinance. The Chairman drafted the following proposed resolution to enable everyone present to have a clear picture of the appeal: • '1 Southold Town Board of Appeals -3- February 49 1959 The proposed structures be numbered consecutively from north to south 1929 3, 4, 5, and 6. Numbers 1, .2, 49 and 6 are duplexes with outside dimensions of 74 ft. x 20 ft. 4 in. Structure No. 3 is 24 x 38 and Structure No. 5 is° 21 x 34.. Duplex No. -1 to be located parallel to Soundview Avenue at a distance of not less than 26 ft. conforming with the prevailing adjacent setbacks on Soundview Avenue. The easterly line of this Duplex to be no closer at any point to the easterly line of the property than 10 ft. 6 in. The westerly line on Goldin Lane to be no closer than 17 ft. ; Duplex No. 2 - the northerly line of Duplex No. 2 to be at no point closer than 20 ft. to Duplex No. 1. The westerly line of Duplex No. 2 facing on Goldin Lane to be parallel to Goldin Lane at a distande of 17 ft; Building No. 3 to be located parallel to Goldin Lane at a distance no closer than 15 ft. to the easterly property line. Building NO-3 to be equally distant from the southerly line of Duplex No. 2 and the northerly line of Duplex No. 4; Duplex No. )+ to be located parallel to Goldin Lane at a distance- of 17 ft. and 45 ft. from the southerly line of Duplex No., 2; Building No. 5, which is 21 x 34, to be located parallel to Goldin Lane equally distant between the southerly line of Duplex No. 4 and the northerly line of Duplex No.69 and at a distance no closer than 15 ft. from the easterly line of'the property; Duplex No. 6 to beAoegted 45 ft. south of Duplex No. 49 parallel to Goldin ?pane at a distance no closer than 17 ft. No part of the southerly line of Duplex No. 6 to be closer than 17 ft. from Route 27. CHAIRMAN: Ss that what you people are requesting? MR. AHLERS: Yes. CHAIRMAN: Is there anyone present who wishes to speak against this application? MR. DANIEL CHARNEWS9 - Youngs Avenue, Southold, N.Y.,: You have already granted thempermission on those two buildings on the ends. You have given them a little leeway already. I' think that is enough. CHAIRMAN: When you impose zoning restrictions on a whole area some things won't fit. This situation, as I understand 'it now after tonight - this was .a filed map of the Town, whid:L is a recognized map in the Zoning Ordinance. They become a part of it. Some lots are under-size, however the man owned them 20 or 30 years and they are in the "B" Business District and he has certain rights which exist and occasionally you have to give a variance. MR. CHARNEWS: The point is, if he came in 'in the beginning would you have given him the whole four duplexes then - a variance of ordinance for the whole four in the beginning? CHAIRMAN: Yes, I think we would have. Southold Town Board of Appeals -1+- February 4, 1959 lots.MR. CHARNEWS: This is just like having ten houses on seven CHAIRMAN: It is not the samet- there are proposed to be four duplexes, which are similar to ranch-type houses. The Chairman answered several of Mr. Charnews' questions relative to sewage, and. parking .facilities. Mr. Charnews explained that he owned beach-front property 100 ft, east of a piece of beach-front property owned by Mr. Main and he was concerned that the additional structures, bringing more people: into the area, would cause an overflow on to his beach. Mr. Charnews went on to say that he did not feel the proposed structures would be an asset to the neighborhood. MR. MAIN: Mr. Charnews, we believe these buildings will enhance the value of all property in the vicinity. Yours and mine. MR. CHARNEWS: I suppose you are going. to have an office in one of the end duplexes. MR. MAIN: I have already made plans for the renting of the duplexes. They will be renting them for the season or half season only. As a matter of fact Mrs. Main and I intend to live in one of the small cottages in the rear during the summer. Mr. Charnews stated that these hearings seemed to- be at quite a convenient time when no one who owned .property in. the area (mostly summer residents) could attend., The Chairman fully explained to Mr. Charnews the procedure that is followed when setting up a public hearing. MR.CHARNEWS: It does not seem right to me, that as I understand it zoning is undet state jurisdiction. I don't think the State should be able to take the power away from the Town officials. ' CHAIRMAN: Of all the hearings I have conducted, before and after zoning went into effect, this is the first time I have heard mention of State controlled zoning. (The Chairman went on to -clarify this point in Mr. Charnews' mind. ) CHAIRMAN: As to the legality of this request, it seems quite reasonable to me. I would defend anything you. would like to do as well as this because I believe this is legal. Hearing- Closed. The aforementioned resolution was offered by Mr. Bergen, seconded by Mr. Gregonis and unanimously carried. Vote of. the. Board: Ayes- Mr. Gillispie, Mr. Bergen, Mr. Gregonis. Southold Town Board of Appeals -5- February 4, 1959 Minutes of January 29, 1959 were read. On motion of Mr. Gregonis, seconded by Mr. Bergen and carried, the minutes were approved as submitted.
