M. on Thursday, January 23, 1959, . in-the Town Clerk's Office, Southold, N. Y. There were.present: Mr. R. W. Gillispie, Jr., Chairman Mr. Robert Bergen. Mr. Herbert Rosenberg Mr. .Charles Gregonisl Jr. Absent: Mr. Serge Doyen, Jr. „ AMLIC HEARING: Appeal No. 44 - Application of Madeline Michaelis, Bay View Road, Southold, N. Y., for a variance to the Zoning Ordinance under Article III, Section 303 and Approval of Access under Section 290-a of the Town Law of the State of New York. Location of property: N/S Bay View Road, Southold, N. Y., loot x 1141. Application for appeal, letter -to appellant,advis.ing of date of hearing and legal notices with affidavits, from two local newspapers were all read by the Chairman. Chairman then asked if anyone present wished to speak either 'for" or "against" the appeal. Mr. Rosenberg advised that there had been no objections received at the office regarding this appeal. It was the determination of the Board that strict application of the Ordinance would in this case produce undue and unique hardship as all available land_had been purchased to increase the. size of the lot and the variance would observe the spirit of the Ordinance as other lots in the area are of the same or smaller size. The variance was therefore unanimously granted. Approval of access was granted as follows: a 101 right of way on the West Side of the property, 1141 in depth from Bay View Road. PUBLIC HEARRING: Appeal. No. 43 - Application of Gilbert Michaelis, Bay View Road, Southold, N. Y., for a variance to the Zoning Ordinance under Article III, Section 303. Location of property: N/S Bay View Road, Southold, N. Y., 1001 x 1141. Application for appeal, letter to appellant advising of date of public hearing and legal notices with affidavits from two local newspapers were read by the Chairman. 2 Southold Town Board of Appeals January 23, 1959 MANTES, Continued Chairman then asked if there were anyone present who wished to speak either "for" or "against" this appeal. Mr. Rosenberg advised that no objections had been received at the office. Board unanimously granted the appeal as it was the determination of the Board that the lot had been increased in size to conform as far as possible to the Ordinance and the variance would not change the character of the district as other lots in the vicinity are of the same or smaller size. PUBLIC HEARING: Application No. 45 of'Sophie'Krukoski and. Charles Krukoski, 5th Avenue (New Suffolk Lane), New Suffolk, N. Y., for permissive use of land, 3201 on private road x 1601 deep, described. and shown on map attached to application. Chairman opened the hearing by reading application, letter to appellants advising date of public hearing and legal notices with affidavits from two local newspapers. Chairman: "Is there anyone present who wishes to speak "for" this appeal? I,;r. Krukoski: "I would like to divide the 3201 into 4 g0, lots. 80f x 1601 is larger than the Zoning calls. for." Chairman: "Mr. Krukoski you show a 1001 turn around on the map." Mr. Krukoski: "The Town wanted me to give the 1001 for a turn around." Chairman.: "Is there anyone who wishes to speak "against° this appeal?" Mr. Rosenberg: "On behalf -of the Building Inspector, Mr. Terry, I wish to say that the Town will not take over the road if the lots are not 1001 in width: That is why Mr. Grathwohl changed his lots to conform to the Ordinance." C hairman: "Under the State Law the Building Inspector cannot issue a building permit unless the access is approved by the Town Board. We have no choice but to deny this permissive use, for your own protection as well as the fact that the Ordinance calls for 1001 lots." Appeal denied. Minutes of the January 9th meeting were read.
