A regular meeting of the Southold Town Board of Appeals was held at 7:30
P.M. on Thursday, August 7, 1958s, in the Town Clerk's-Office, Southold, New York.
There were present: Messrs, Robert V. Gillispie, Jr.; Chairman,. Herbert
Rosenberg, Robert Bergen and Charles Grigonis, Jr.
Absent: Mr. Serge Doyen, Jr.
Also present: Mr. Howard M. Terry, Building Insppector.
PUBLIC HEARING: Appeal No.`78, Appeal from decision of Buildi.n Inspector
by William T, King.-of Bay View Avenue, Gieenport, N..Y• -,Fee. paid, IX5*00*
Chairman read the application for appeal For a variance to the Zoning
Ordinance for permit to use and build on four lots shown on sketch of Map of
subdivision of Summerhaven, Greenport, N. Y. and also an appeal for a variance
due to lack of access' from end of public road. Chairman also read letter to
Mr. King advising of date of hearing-'and. -legal-notice of hearing with affidavit
from the Long Island Traveler - Mattituck Watchman attesting to it's publication.
The Board advised Mr. King that they could not grant a'blanket variance
and had no authority to reduce the size of lots in a whole area. They explained
that this comes under the heading of subdivision of land and the request would
have to be approved by the Southold Torn Panning-Board Who would have to okay
the plot plans as well as the roads. It was also explained to Mr. Sing that he
might have to return to this Board for approval of access.
This hearing to be continued, at"the request of Mr. King,- to the latter part
of September in order that he can consult with the Planning Board before he
returns to this Board.

MINUTES, Continued
Appeal No. 76 — ,Application of W, Harry Lister Public Hearing held on
July 31, 1958. Applicant requested permissive use-as a Special Exception as
provided under-Article III A,- Section 350, paragraph 1. (reference Article III,
Section 300, paragraph 3A —.Marinas or boat basins for the docking, mooring or
accommodation of noncommercial boats when authorized as a special exception by
Board of Appeals as hereinafter provided).
Findines:
The land in question is zoned as. ."M" and when purchased in 1955 prior to
enactment of the Zoning Ordinance in 195.7;the. owner intended to build a motel with
docking facilities., In 1956 a complete water system was installed and approved by
New York State Division of Water Power and Control*
The Board as a group has visited this site and the members individually have
gone over the property at different timese The Board finds that the construction
of this marina would improve the character of the area and is peculiarly well
suited to this location..
The slips will be located more or less in the middle of the water front owned
by the applicant and would not have any connection with any property owned by.
others and will be part of the yachtel development.
The proposed docks will replace a series of broken and rotted spiles and will
abut a dock now zoned,for business which-in turn abuts do Town Dock. In the business
zone adjoining the Town Dock there are at present 17 slips now used by the local
residents for mooring their small craft.
The public convenience and wrelfate and, justice will be substantially served, and
the legally established or permitted use of neighborhood property and djacent use
districts would not be substantially or permanently injured and the spit of the
ordinance would be observed.
Deccisicn:
Special exception authorized to construct a noncommercial marina with facilities
for mooring 22 boats.
Mr. $1ipp, Town Supervisor and Mr. Tasker, Town Counsel, joined with 'the Board
in discussions regarding Signs and proposed amendments to the Zoning Ordinance.
The Secretary was instructed to write Mr. Wickham of the Planning Board and
advise him of the Board of Appeals unanimous recommendation of the' proposed amendments..
The next meeting of the Board is scheduled for August 1/+s 1958s at 7:30 P.M.
