Gillispie, Jr., Chairman Robert Bergen Herbert Rosenberg Charles Gregonis, Jr. MINUTES Serge Doyen, Jr. Southold Town Board of Appeals August 28, 1958 A regular meeting 'of the Southold Town Board of Appeals was held at 7:30 P.M. on Thursday, August 28, 1958, in the Town Clerks Office, Sbutholdp New York. There were present-= Messrs. Robert We Ginispie, Jr*,. Chairman; Robert Bergen, Herbert Rosenberg and Charles Grigonis, Jr. Absent: Mre Serge Doyen, Jr* Also presents Mr* Howard Me Terry, Building Inspector. PUBLIC HEARING: Appeal Noe 85 Application of William Ae Lindsay, Bergen Avenue, Mattituck, New-,Yorke Fee Paid — 15.00, Appealing Article III, Section 300, subsection 7 of the Zoning Ordinance# to permit a 30 foot setback for a potato storage building on the above location. Chairman read the application, letter to applicant advising of date of public hearing and legal notice with affidavit attesting to its publication. There being no one present who wished to speak either for or against the appeal, the Board, after review, unanimously granted the variance to permit the 30 foot setback and stipulated that in no case should this setback be less than the setback established by the labor housing building adjoining proposed site of the potato storage building. PUBLIC HEARING: Appeal Noe 87 — Application of Philip We Abatelli, Route 25, East Cutchogue,,New Yorke Fee paid WOO. Request for a special exception to erect a 25 foot flag pole on the premises to fly an advertising flag, 5' x 81, with the words "Real Estate" on it. Chairman read the application, letter to applicant advising of date of public hearing and asking for information as to the size of flag and the lettering to be used, Mr. Abatelli's reply with the requested information and legal notice of public hearing with affidavit attesting to its publication in the local newspaper. Minutes of the August 21st meeting were read. On motion made by Mr. Grigonis, seconded by Mr. Bergen, and carried, Minutes .were approved as submitted. } .. 2 .. Board of Appeals August 28, 1958 MINUTES, Continued Chairman: Is there anyone present who wishes to speak for this application? Mr. Abatelli:' Ma.inly I want to fly .the American flag and maybe have an adver- tising flag. The oil company sign obstructs my sign,as that sign of mine is obliterated by their sign. I appealed to them and asked them to remove their sign and I was willing to pay for the cost of removing .it but they said they could not do it. Chairman: How big is your sign and how big is the Oil Company sign. Mr. Abatelli: My sign is about 6' x 8' or 5' x 81. It is about 91 offthe ground and their sign is about the same height. My sign is flood lighted from' the ground. Their's is lighted at the bottom of the circle on each side. Chairman : Would it help you any to raise the present sign. Mr. Abatelli: No it would not. The pressure of the wind would be bad if the sign were raised, Mr. Rosenberg: Do you happen to recall how many signs you have in the Township Mr. Abatelli? From Laurel, east? Mr. Abatelli: The big signs are from Queens to the border of Southold. I have one big sign, 1Oxl2 feet on Route 27A on a building. Mr. Rosenberg: Do you have any small signs that are not on property for sale? Mr. Abatelli: No. Chairman: In other words if you have 25 pieces of property for sale you will have 25 small signs. Is there anyone else who would like to speak for this appeal? Any questions? Is there anyone who would like to speak against it? I would like to say:that personally I am not in favor of flags in general unless they are American flags and this type of evasion of the true function of a sign. Most people are dead against any advertising signs in the Toren and I think that if we should grant this exception we would be creating.a precedent for the future. Mr. Abatelli: Suppose we just want to put up a flag pole and fly the American flags Chairman: We have no control over thate I am .sure that you would be permitted to erect a flag pole to fly the American flag just as anyone else in the Town would be and you would not have to come to us for permission to do this. By resolution of the Board it was determined that this special exception should not be granted. The Board is, unwilling to establish a precedent which would open the door"to various types of advertising other" than sign advertising. It is felt that the applicant is able to advertise far more effectively as a real estate operator, by reason of the many signs permitted him, than a proprietor of some other type of business and that this additional advertising is unnecessary, unwarranted, unsafe and prohibitive to the best interest of the Town of Southold. r ' x — 3 — Board of Appeals August 28, 1958 MINU'1MS, Continued PUBLIC HERRING: Appeal No. 86 — Application of Thomas P. Gibson, 17 Sunrise Court, East.Northport, New York. Fee Paid — No fee paid, this being an application for a variance to the Zoning Ordinance due to lack of access to property. Chairman opened the hearing by reading application, letterto lair. Gibson advising of date of public hearing and legal notice with affidavit attesting to publication in the local newspaper. Chairman asked if there were anyone present who wished to speak for this appeal and Mr. Gibson and Mrs. Fisher of Southold replied that they were both in favor of the granting of the variance. After review of the application and sketch of the property in question, Board linen usly agreed to grant' a 20 foot access or right of way from Horton's Lane, Southold, N. Ye, 82 feet east to lot described as 1001/89' x 237.35'. Right of way, as originally granted to PJr. Gibson in Breed to the property in question. PUBLIC HEARING: Appeal No. 88 - Application of Smitro Adamseveich of 427 Kaplan Avenue, Greenport, New York. Fee Paid — $15.00. Application for a variance under Article III, Section 307, of the Zoning Ordinance. Chairman read application, letter to applicant advising him of date of public hearing and legal notice with affidavit attesting to publication in the local newspaper. There was no one present who wished to speak either for or against the appeal and Board reviewed the application. Board unanimously agreed to grant the variance to reduce the side yard requirement of the Ordinance by one foot to permit the proposed house to be built one foot further to the north on the property described as Lot #62, Founders Path, Southold, News York. It was the determination of the Board that the hardship is undue and unique because of the slope of the property and the 50' lot is last one for sale in a filed subdivision and the variance as granted does observe the spirit df the Ordinance and would not change the character of the neighborhood as other houses in the area have very narrow side yards and all sites surrounding the proposed site are 40 feet from property line of lot in question.
