Gillispie, Jr., Chairman Robert Bergen Herbert Rosenberg MINUTE' S Charles Gregonis, Jr. Serge Doyen, Jr. Southold Town Board of Appeals September 41, 1955 A regular meeting of the Southold Town Board of Appeals was held at 7:30 P.M. on September 4, 1958 in the Town .Clerk'rs Office,. Southold, New York. There were present: Messrs. Robert W. Gillispies Jr., Chairman; Robert Bergen, Herbert Rosenberg and Charles Grigonies. Jre Absent: Mr. Serge Doyens Jr. Also present: Wr. Howard M. Terrys Building Inspector. PUBLIC HEARING: Appeal No. 89s application of Fred Baxter, Old Harbor Road, New Suffolk, New Yorks „for a variance due to lack of access to property. Fee Paid — None.. The Chairman opened the hearing by reading the applications letter to Kwasneski & Powells a/c Fred Barters advising of date of public hearing and asking them to present a plot.plan showing right of way and proposed driveway to dwellings and legal notice of public hearing with affidavit attesting to its publication in the local newspaper. Chairman: Is there anyone present who wishes to speak for this appeal? Mr. Baxter was present and explained that he had nothing to add to what had already been explained in the application. Chairman, read the application, letter to Bar. Corwin Grathwohl, a/c Mr. Wickham, advising of date of public hearing and legal notice of hearing with affidavit attesting to its publication in the local newspaper. In response to the Chairmants .questioning as to whether there was anyone present who wished to speak for the appeal Mr. Wickham advised that the right of way in question was mentioned in his deed as a middle right of gray and pointed out the right ,of.way on a survey by O.W. VanTuyl & Son, Greenport, N. Y. There was no one present who wished to speak against the--appeal and the Board unanimously agreed to grant the variance with approval of a 16.51 right of way at right angles from the northerly lin6"of property of F. H. Baxter, running easterly from Old Harbor Road, New Suffolk, as described in the above mentioned survey dated Oct. 21+, 1957. PUBLIC HEARING: Appeal ,No. 91., Application of Julius Zebroski, Bay View Road, Southold., N. Y,, .f or a'variance to the Zoning Ordinance under Article III, Section 303. Fee Paid. .: 015.00. Application. and-__all_.leg.al.,docents. were read. Mr. Zebroski was not present' and hearing was gon`�inubdmtil such time as the applicant can enlighten the Board about changes in the application. The Minutes of the August 28th meeting were read. On motion duly made by Mr. Rosenberg and seconded by Mr..Bergen, and carried, Minutes were approved as corrected. PUBLIC HEARING: Appeal No.- 92, application of James L. Gray, 109 Harrison Avenue, Garden,City, N. Y., request for permissive use under the Zoning Ordinance. Fee Paid — 015.00. Chairman read the application with accompanying deed description, letter to applicant advising of date of public hearing and legal notice of hearing with affidavit attesting to publication in the local newspaper. Chairman asked if there were anyone present who wished to speak for the appeal. Mr. Gray was present, along with his brother Mr, Peter Gray and $Air. Gerald B. Howell. Mr. §ray stated that the lot was approximately 601 x 1501 and stated that full description was contained in the attachment to the application. There was no one present wishing to speak against the appeal. By resolution of the Board it was determined that the lot purchased in January or February-of 1958 and resold immediately to Gerald B. Howell, .described in the deed description accompanying appeal, may be used for residential building purposes under the authority granted in Section 80I.B., concerning practical difficulties and unnecessary hardship in the way of carrying out the strict letter of these regulations, and as provided in Section 307 concerning the undersized lot. Location of property: Private. road W/S Camp Mineola Road, Mattituck, New York. -3- Southold Town Board of Appeals September 4, 1958 MINUTES, Continued PUBLIC HEARING: Appeal' No. 93, application of Truman H. Cook, 528 First Street, Greenport, N. Y., for.,a special exception under the Zoning Ordinance. Fee Paid — $15.00. Chairman read the application, letter to applicant advising date of public hearing and legal notice with affidavit attesting to its publication in the local newspaper. There was no one present who wished to speak either for or against the appeal. Board studied the application and preliminary map of Sterling Harbor Home Sites. By resolution of the Board it was unanimously agreed to grant the special exception on Lot No. 2 on preliminary map of Sterling Harbor Home Sites, a side and exception for a corner lot permitting location of the house not less than 19-17 feet from Robinson Road, as outlined on sketch submitted to the Building Inspector with application No. 425. It is believed that this will improve and enhance the character of the area enclosed by Robinson Road. The next meeting of the Board is scheduled for September 11, 1958, at 8 P.M.
