Town Board of Appeals September 18, 1958 A regular meeting of the Southold Town Board of Appeals was held at 7:30 P,M. on Thursday, September 18, 1958s in the Town Clerk's Office, Southold, New York. There were present: Messrs. Robert We Gillispie, Jr., Chairman; Robert Bergen, Herbert Rosenberg and Charles Grigonis., Jr. Absent: Mr. Serge Doyen, Jre Also present: Mr* Howard Me Terry, Building Inspector. PUBLIC HEARING: Appeal No. 98, Application of Anton We Ficurilli, 215 loth Avenue, Greenport, N. Ye, for a variance to the Zoning Ordinance, Article III, Section 303. Fee Paid — 015.00. Chairman opened the hearing by reading application for variance, letter to applicant advising of date of public hearing and legal notice with affidavit from the official newspaper attesting to its publication.. There was no one present wh& wished to speak against the application and I .* Fieurilli stated that he' would have a side line on each side of the new house of 17-1/2 feet and the house would be setback from Bay Road 53 feet. Board unanimously granted the application for permit to use and build on the lot in question., _Lot described in application as 1001in depth, running in a northerly ancL southerly directions baunded on the west by property of Me Barthwell and on the east by property of Julian Fiedler, Lot 65' wide on Bay Road and 75t wide on Beach Roads Greenport, N. Ye Board determined that the strict application of .the Ordinance would produce undue and unique hardship because there is no adjoining land available to increase the size of the lot in question and applicant has owned the lot since 1953 and all other lots in the area are approximately 50' in width by 100' in depth. y � 2 � Southold Town Board..of Appeals September 18, 1958 MINUTES, Continued PUBLIC HEARING: Appeal No. 99 - Application of George Nenning, Victoria Drive, Southold, .New York, for .a variance due-to lack of access. No fee paid. The Chairman opened the hearing by reading application, letter to applicant advising of date and time of public hearing and legal notice with affidavit from the official newspaper attesting to publication. There was no one present to speak either for or against the appeal. Board unanimously granted the appeal for right of access as it was the feeling of the Board that lot was of ample size to meet the zoning requirements. Access of 501 to Lot No. 20, on map of Reydon Heights by 0. W. VanTuyl, dated June,11+s 1949. 1001 lot, bounded on the east by Victoria Drive, north line 2001 and bounded by land of Gritz, bounded on the west by land formerly of Mary L. Dayton estate and on the south by other lands of the applicant, an irregularly shaped lot. It is the Boardts understanding that the Town is in the process of taking over Victoria Drive and-other roads in the Reydon Heights Development of Eduard Nidds. PUBLIC HEARINGr Appeal No. 100 '- Application of William Victoria, B View Road, Southold, New York, for a special exception to erect a- sign. Fee Paid - 15.00. Chairman read the application, letter to applicant advising of date of public hearing, legal notice with affidavit from the official newspaper attesting to its publication and letter from Mr. William Wickham, attorney for Mr. Victoria to which he attached a letter signed by Elizabeth Bedell granting permission to William Victoria to erect and maintain a sign on her property in Peconie, New York. There was no one present to speak either for or against the appeal. Board studied the application and unanimously granted the special exception to erect a directional sign, dimensions of which are to be approximately the same as that formerly advertising the Cedar Beach_Inn in the same location. Sign to advertise only the facilities provided by Victoria's Cottages and to be located on the property of Elizabeth Bedell, south side of Main Road, Peconic, New York. Sign to be located not closer than 5' from any property lines not to exceed 1516" from ground level to upper edge and lower edge of sign to be at least 31 from ground level. Permit is valid until revoked. Minutes of the September nth meeting were read. On motion made by Mr. Rosenberg, seconded by Mr. Bergen, and carried, Minutes were approved as submitted., . Chairman read letter received from Mr. S.F. Sarnowski, Secretary of the Nassau Point Property Owners Association, Inc., in which it was stated that he was attaching a petition signed by the members and residents of the association with respect to the parking of Angelo Petrucci on the south side of Bay Avenue. The Board unanimously agreed to have the Chairman write Mr. Sarnowski advising that it was the board's understanding that the parking of trucks and equipment of Angelo Petrucci occurs on Mr. Petrucgils property and that it was also the board's understanding that Mr. Petrucci conducts a non-conforming business established prior to the enactment of the Zoning Ordinances and to inform Mr. Sarnowski that the board has no control of the situation referred to and assumes that if Mr. Petrucci parked his equipment within the boundary lines of Bay Avenue it might be A matter for police investigation. . - 3 - Southold Town Board of Appeals September 18, 1958 MINUTES, Continued By resolution the Board agreed to set the time of hearing on the application of Clifford Tyler, application fora Special Exception, for 9 P.M. on October 2, 1958. Legal notice to be published in the official newspaper on September 25, 1958. Although hearing is scheduled for 9 P.Y. on October 2, 1958, by resolution Board agreed to meet at 8 P.M. on this date.
