A regular meeting of the Southold Town Board of Appeals' was held on Thursday
evening, September'25, 19589 at 7:30 .P.M, in the Town_Clerkts Office, Southold,
New York.
There were--present: Messrs. Re We Gillispie, Jr*,, Chairman, Robert Bergen,
Herbert Rosenberg and Charles Grigonis, Jr.
Absent: Mr. Serge Doyen, Jr.
Also present: ,Mr. Howard Me Terry, Building Inspector*
PUBLIC HEARING: ',Appeal No. 101 — Application of Kenneth Rhodes of Peconic
Bay Blvd., Laurels New.York, for a variance under the Zoning Ordinance, Article
III, Section 300 and Section 309, to erect a garage on a 50 foot lot less than the.
required,three feet from the property line• Fee paid — $15.00e
Chairman opened the hearing by reading application for appeal, legal notice
with affidavit from the official newspaper attesting to its publication. There
was no one present who wished to speak either for or against the appeal. Board
studied application with accompanying sketch of the proposed garage. Board then
unanimously agreed to grant the variance as it was the findings of the Board that
the hardship was undue and unique because a garage •was a necessary accessory to
the dwelling and dwelling has been erected long be fore the enactment of the
Zoning Ordinance. The variance does observe the spirit of the Ordinance since
most lots in the area are of the same or smaller width and other garages have
been built in this area directly on the property linese

Peconic Bay, on west b land of He Brush, on east by lands of Mormile & Smith and
on the north by private road.
By resolution the Board agreed to set the time and place for hearing on the
application of Sprio Zuehlich for a variance, in accordance with the Zoning
Ordinance Article III, Section 3039' and time and place was fixed for S P.M*
(E.D.S.T.I on October 9 195$ at the Town Clerkts Office, Southold, N.Y., and
legal notice to be published in the official newspaper on October 2, 1958e,

Time and place was then fixed for a public hearing on application of
Robert G. and Bertha S. Rockefeller for a variance, id the Zoning Ordinance, Article
III, Section 303, for permit to use for residence certain property located at
Arshamomoque, N.Y.
By resolution Board determined that public hearing is to be held at 8:15 P.M.
on October 9, 1958, at the Town Clerk's Office, Southold, New York, and legal
notice is to be published in the official newspaper on October 2, 1958.
Time and place was then fixed for a public hearing- on application of Guido
Ciacia for a special exception in accordance with the Zoning Ordinance,. Articlb X'
Section 1007, paragraph (e), for in addition to a non-conforming business.
By resolution Board determined that a public hearing is to be held at 8:30 P.M.
on October 9, 1958, at the Town- Clerk's Office, Southold, New York,. and legal_ notice
is to be published in the official newspaper on October 2, 1958.
Minutes of the September 18th meeting were then read. On motion made by Mr.
Bergen, seconded by .Mr, Rosenberg, and carried, Minutes were approved as submitted.
Chairman then dictated a letter -to the secretary to be sent to the Town Board
requesting that they arrange to issue _a check in the amount of 15.00 to Otto
Lindermayer of Horton's Point, Southold, Neva York,. representing a refund of fee
paid on Appeal No. 103, as Mr. Lindermayer had withdrawn his application and no
publication was made of the application.
PUBLIC HEARING: Appeal No. 94 - Application of Nella. Williams and others for
a. variance to the Zoning Ordinance. ' Hearing was held on September ll, 1958 and
continued to this date at the request of the applicants' attorney, Mr. .Stanley S.
Corwin,
Mr. Corwin appeared before the Board -and asked for further postponement because
his clients were not available at this time. Board agreed to this postponement and
will fix a time and date for the continuance of this hearing when further word is
received from Mr. Corwin.
The next regular meeting of the Board 'is scheduled for 8 P.M. on .Thursday,
October 2, 1958..
