A regular meeting of the Southold Town Board of Appeals was held at the Town
Clerk's Office, Southold, New York, on Thursday evening, October 9, 1958 at 8 P.M.
There were presents Messrs. Robert W. Gillispie, Jr., Chairman; Robert Bergen,
Herbert Rosenberg and Charles Grigonis, Jr.
Absent: Mr. Serge Doyen, Jr.
Also present:' Mr. Howard M. Terry, Building Inspector.
PUBLIC HEARING: Appeal No, 106 — Application of Spiro Zuchlich, Hommel Avenue,
Southold, New York, for a variance to the Zoning Ordinance under Article III, Section
3002 subsection 1, for permit. to use for two family dwelling the property..located at
Southold, New York, bounded on north by land of J. M. Grattan, on east by land of
Carl Butkovich, on south by Hommel Avenue and on west by land of J. M. Grattan. Fee
Paid — $15.006
Chairman opened the hearing by reading application,_ notice of disapproval issued
by the building inspector, and legal notice of hearing with affidavit attesting to
its publication in the official newspaper.
There was no one present who desired to speak either "for" or "against" the
appeal.
On motion duly made by Mr. Grigonis, seconded by Mr. Bergen, and carried, it
was unanimously
RESOLM, that the application of Spiro Zuchlich, appeal No. 106 dated September
25, 1958, for permission to use his present residence for two families, be granted.
The Board agrees with the applicant that undue hardship would be caused by failure
to grant ,this application because many of the houses in this block are now two family
houses. It also agrees that the hardship is unique because this--is the last house in
the block suitable for this changeover. It finds that granting of this application
would not change the character of the district because there are now five houses used

for two family occupancy on this street and the applicant's house is now between
a pair of two family houses.

The Board finds its authority for this action in Article VIII, Section 801 3,
concerning unnecessary hardships in the way of carrying out the strict letter of
these regulations;
Vote: Mr. Rosenberg, aye; Mr. Gillispie, aye; Mr. Bergen, aye; Mx. G'rigonis, aye.
PUBLIC HEARING: Appeal No, 105 Application of Robert G. and Bertha S.
Rockefeller, 104-27 107th Street, Ozone Park 17, N. Y., for a variance in accord—
ance with the Zoning Ordinance$' Article III, Section 303, for permit to use the
property located-at Arshamomoque, Net York, bounded on the north by Long Island
Sound, on the east by land of D. Driscoll, on the south by North Road and on the
west by land of Charles Butt, for uses permitted under Article III in the "A"
Residential and Agricultural districts. Fee paid — $15.000
The Chairman read the application, notice of disapproval by the building
inspector and legal notice of hearing with affidavit attesting to its publication
in the official newspaper.
There was no one present who wished to speak either "for" or "against" the
appeal.
On motion made by Mr. Bergen, seconded by Mr. Grigoni.s,and carried, the
following resolution was adopted:
RESOLVID, that the application of Robert G. Rockefeller and Bertha'-S.
fis Rockefeller, Appeal No. 105 ted September 20, 1958, for a permit to use the
easterly half,.of the property,described in deed accompanying application, for
uses permitted in Article III, covering."A" Residential and Agricultural ,Districts,
be granted
The Board finds the reasoning of the applicant to valid& Specifically, the
Board agrees with the applicant that strict application of the Ordinance would
produce undue hardship because of the 150t size of the present lot.. It also
finds the hardship unique because there are no other lots in the immediate vicinity
with frontages as large as 100 feet.. The character of the neighborhood will not
be affected and the lots resulting from this division will be in excess of the
required 12,500 square feet&
-Vote: Mr. Gillispie, aye; Mr. Rosenberg, aye; Mr. .Grigonis, aye and Mr.
Bergen, aye.
PUBLIC`HEARING: Appeal No, 104, Application of Guido Ciacia, R.F.D.., Southold,
N.Y.> for a special exception under the..Zoning Ordimmce, in accordance with Article
g', Section 1007, paragraph (e) for an addition to a non—conforming business�on the
property in Southold, N. Y., bounded on north by land of J. Mann, on east by a
proposed road (Lawrence Lane), on south by Kerwin Blvd and on west by Main Road.
Fee paid — 15.00.

Chairman read the application, notice of disapproval by the building inspector
and legal notice of public hearing with affidavit attesting to its publication in
the official newspaper.
In response to the Chairman's asking whether there was anyone present who
wished to speak "for " the application Mr. Ciacia presented a sketch of the plot
and the proposed.-addition to the building.,
There was no one else present who wished to speak either "for" or "against"the
appeal.
On motion made by Mr. Grigonis, seconded. by Mr. Rosenberg,- and carried, the
following resolution was offered:
RESOLVID,_ that the special exception on application No. 101+ dated September 19,
1958, of Guido Ciacia, requesting permission to enlarge his boat building and repair
shop from its present size of 21+' x 36' to an enlarged size of 4/+1 x 52', be granted,
subject to' the following conditions::
1. Size of the enlarged building may not exceed dimensions noted; namely,
"I x 521.
2. The side line on Kerwin Blvd may not be closer to Kerwin Blvd than the
side line already established for the existing building.
3. The new side line on the north side of the building may not be closer
than 9' to the lot of John Ciacia. -
1a. Completion of this work is to be accomplished within one year from this
date.
.In considering this application the Board finds that it would be an undue
hardship to prevent the expansion of.this business. It is believed that this
exception will not change essentially the character of the neighborhood and the Board
also notes the fact that applicant owns a lot to the east and that property on the
south side of Kerwin Blvd is already zoned for business.
Vote: Mr. Rosenberg, aye; Mr. Gillispie, aye; Mr. Bergen, aye and Mr.
Grigonis, aye.
On motion made, seconded and unanim&usly carried it was
RESOLVED,_ That a time and place'be fixed for the following public hearings to
be held by the Zoning Board of Appeals of the Town of Southold:
Public hearing to be held at 7:30 P.M. (E.D.S.T.) at the Town Clerk's Office,
Main Street, Southold, New York, on October 23, 1958, upon application of Odell
Smith for a variance due to lack of access, in accordance with State of -New York
Town Law, Section 280A, Subsection 3.
Public Hearing to be held at 7:45 P.M. (E.D.&T.) at- the Town Clerk's Office,
Main Street, Southold, New York, on October 23, 1958, -upon application of Charles
Abrahams and wife fora variance, in accordance with the Zoning Ordinance, Article
III, Section 3002 subsection 1, and Sections 303, 30I+, 306 and 308 for permit to Use
and build.
IT TEAS FURTHER RESOLVED, That legal notice is to be. published in the official
newspaper on date of October 16, 1958.

The minutes of the meeting of October 2, 1958 were read. On motion made by
Mr. Grigonis, seconded by Mr. Rosenberg, and carried, minutes were approved as
submitted.
The next meeting of the Board is scheduled for Thursday, October 23, 1958 at
7:30 P.M. in the Town Clerk's Office, Southold, N. Ye
There being no further business, meeting adjourned at 11:05 P.M.
