October 23, 1958
A regular meeting of the Southold Town Board of Appeals was held at the Town
Clerkts Office, Southold, New York, on Thursday, October 23, 1955, at 7:30 P.M.
There were present: Messrs. Robert Wo Gillispie, Jr., Chairman; Robert Bergen,
Herbert Rosenberg and Charles Grigonis, Jr.
Absent: Mr. Serge Doyen, Jr.
Also present: Mr. Howard IA. Terry, Building Inspector.
PUBLIC HEARING; Appeal No. 108 — Application of Odell Smith of 404 West St.,
Greenport, New York, for a variance due.to lack of access, under provisions of
Section 280A of the Town Law. No fee paid.
Chairman opened the hearing by reading application for the variance, notice
of disapproval issued to applicant by the Building Inspector and legal notice of
hearing with affidavit attesting to its publication in the official newspaper.
There was no one present who wished to speak either for or against the appeal.
On motion made by flair. Rosenberg, seconded by Mr. Bergen, and carried, it was
unanimously
RESOLED, That a right of access be granted from 7th or Sand Streets to Lot
No. 77, as shown on map No. 369 of Greenport Driving Park, on Flint Street Extension,
Greenport' New York.
In granting this right of access the board feels that strict application of
the Ordinance would produce undue and unique hardship since Flint Street Extension
was laid out and dedicated to the Town many years ago, although the Town has not
maintained the street and is unable to take over the street under present rules and
regulations. Board feels that the variance does observe the spirit of the Ordinance
and would not change the character of the district as this means of access has been
used for many years by neighboring residents..

Vote of the Board: Ayes - Mr. Gillispiei Mr. Rosenberg, Mr. Grigonis and
Mr. Bergen.
PUBLIC HEARING: Appeal No. 107 - Application of Charles Abrahams and Wife of
Love Lane, Mattituck., New York. Application submitted by Mr. Robert Dart, attorney for
the applicants, for a variance to the Zoning Ordinance under ARTICLE III, Section 300,
Subsection 1, and Sections 303, 304, 306 and 308. Property located at Mattituck, N.Y.,
bounded on north by private right-of-way, oneast by laril of Cortelyou, on south by
land of Besch and Route 27A and on the west by Mattituck Park property. Fee Paid -
$15.00.
The chairman read the application for the variance, notice of disapproval by
the Building Inspector and legal notice of hearing with affidavit attesting to
publication in the official newspaper.
Chairman: ', Is there anyone present who wishes to speak for this application?
Mr. Dart stated that he was the attorney representing Mr. & Mrs. Abrahams who
were present at the hearing and stated that he would like to submit the plot plan
and some pictures of the proposed house which might be helpful. Mr. Dart also
presented a letter from Carl H. Besch, adjoining property owner, which the Chairman
read, as follows:
"I am the owner of premises in Mattituck. The premises of Charles Abrahams and
wife abut on my said premises, both to the north toward the boat basin and to the
west toward the new beach road to the basin. I understand that Mr. & Mrs. Abrahams
have made an application to your Board for a variance act to several sections of the
Torn Zoning Ordinance.
The purpose of this letter is to inform you that it is entirely agreeable to
me that the Abrahams build as close to, or on, my said northerly and westerly
boundary lines as they desire, and I consent that their application for variance be
in all respects granted by your. Respectfully submitted, (Sgd) Carl H. Besch."
Mr. Abrahams stated that he bought the property in 1954 and acquired an additional
strip of land at a later date and has since tried to acquire additional land but has
been unsuccessful as the Park Department had already acquired the existing land.
There was no one present who .wished to speak against the appeal. After much
discussion about the overall situation and the location of this lot it was decided
that the best plan would be in accordance with the plan, as revised by the petitioner,
amended October 23, �958.
On motion made by Mr. Bergen, seconded by Mr. Gillispie, and carried, it was
RESOLVED, That the application of Robert Dart for account of Mr. & Mrs. Charles
Abrahams, for a permit to use gnd build on property of the applicants on Private Road,
West Side of Love Lane, Mattituck, New York, requiring a variance under ARTICLE III,
Section 303, 3041 306 and 308, be granted and that that part of the application for a
variance to Section 200, Subsection 1 be denied.
Location of proposed residence must conform to revised plot plan of Donald J.
Colasono, Architect and Milton D. Petrides, Associate of 310 Norther Blvd., Great
Neck, N. Y., as amended by Mr. Abrahams personally on October 23, 1958.

A condition of this action of the Board is that the new residence be used as a
one family residence.
Vote of the Board: Ayes; Mr. Bergen, Mr, Grigonis and Mr. Gillispie. Nays;
Mr. Rosenberg.
Minutes of the previous meeting held on October 9th were read. On motion made by
Mr. Rosenberg, seconded by Mr. Grigonis, and carried, it was
RESOLVED, That the minutes of October 9, 1958s be approved as submitted.
Vote of the Board: Ayes; Mr. Gillispie, Abe-. Rosenberg, Iu1r. Bergen and Mr.
Grigonis.
On motion made by Mr, Rosenberg, seconded by Mr. Bergen, and carried, it was
RESOLVED, That time and place be fixed for the following public hearings to be
held by the Zoning Board of Appeals of the Town of Southold:
Public hearing to be held at the Fire House, Fishers Island, New York, on
November 51 1958, at 1:30 P.M. (E.S.T.) upon application of .Theodore Arasimowicz for
a variance due to lack of access, in accordance with the State of New York Town Law Sec.
280A, Subsection 3, and a variance for permit to'use and build in accordance with
ARTICLE III, Section 303 of the Zoning 6rdinance. This property located on Peninsula
Street, Fishers Island, New York, on map No. 223, Lots 54, 55 and 56.
Public hearings to be held at the Town Clerk's Office, Main Road, Southold, N. Y.,
on November 61 1958 on the following:
7:30 P.M. (E.S.T.) upon application of Henry,O.,-Kruger for a variance in' accordance
with the Zoning Ordinance, ARTICLE III, Section 304, for permit to build an addition to
the premises on Lots 30 and 31 on map of Eugene Hights, east side .of Oak Street.,
Cutchogue, New York.
7:45 P.M. (E.S.T.) upon application of J. Richard Holmes for a special exception
.in accordance with the Zoning Ordinance, ARTICLE III, Section '300, Subsection 11, t&
erect and maintain an advertising directional sign on land of Sepko at Route 27A. and
Cox Neck Road, Mattituck, New York.
8:00 P.M. (E.S.T.) upon application of Victor Trunee for a variance in accordance
with the Zoning (�?dinance, ARTICLE III, Section 300, Subsection 12 for permit to use
for two family dwelling the premises located at Southold, N. Y.., bounded an north by
land of Ullerich, on the east by land of Zazecki, on the south by land of Smith and on
the west by Bay View Road.
8:15 P.M. (E.S.T.) upon application of William H. Sorenson for a variance in
accordance with the Zoning Ordinance, ARTICLE III, Section 300, Subsection 1 and
Section 304, for permit to use an existing non--conforming two family dwelling for
three apartments. This property located on the east side of Village Lane and the
south side of Navy Street, Orient, New York and bounded by land of Harris on the

with the Zoning Ordinance, ARTICLE IV, Section /f00, Subsection 1 and Section 306 for
permit to use and build on property located on Sound View Avenue and Goldin Lane,
known as Lot 8 on map of Nathan Goldin, Southold, N. Y.
9:00 P.M. (E.S.T.) upon application of Eva Al. Main for a variance in accordance
with the Zoning Ordinance, ARTICLE IV, Section 400, Subsection l for permit to use and
build on property located on south side Sound View Avenue, known as Lot 9 on map of
Nathan Goldin, Southold, N. Y-.
9:10 P.M. (E.S.T..) upon application of Eva M. Main for a variance in accordance
with the Zoning Ordinance, ARTICLE IV, Section 4,002 Subsection 12 for permit to use
and build on property located on east side of Goldin Lane, knovm as Lot 11 on map of
Nathan Goldin, Southold, N. Y.
9:20 P.M. (E.S.T.) upon application of Eva M. Main for a variance in accordance
with the Zoning Ordinance, ARTICLE IV, Section L,001 Subsection 1 and Section 306 for
permit to use and build on property located on North Road and Goldin Lane, known as
the southerly part of Lots 13 and 14 on map of Nathan Goldin, Southold, N. Y.
Legal notice of the above mentioned hearings to be published in the official
newspapers on October 30, 1958.
Vote of the Board: Ayes; Mr. Gillispie, Mr. Bergen, Mr. Rosenberg and Mr. Grigonis.
Secretary was instructed to reply to Mr. Stanley S. Corwin, attorney for Mrs.
Nella Williams, informing Mr. Corwin that the several applications of Nella Williams and
others, which had been calendared to October 23rd, are now continued to calendar of
November 6, 1955, at 9:30 P.M., at which time it is the understanding of the Board that
Mr. Corwin will present an application for a variance on behalf of Mr. Krieb.
The secretary was also instructed to write Mr. William B. May of Fishers Island
Estates asking that he be present at the hearing to be held on November 5, 19582 at
the Fire House on Fishers Island, on application of Mr. Theodore Arasimowicz, as there
is some question about the condition of the right of way in question and the Board
would appreciate Mr. May being--:present tQ •discusbathe�ihat^ter.
The next meeting of the Board will be held on November 52 _1958 at 1:30 P.M in the
Fire House on Fishers Island. Following that meeting a regular meeting of the Board
will be held on Thursday, November 6, 1958 at 7:30 P.M. in the Town Clerk's Office,
Southold, N. Y.
