Southold Town Board of `appeals
November 20, 1958
A regular meeting of the Southold Town Board of Appeals was held at the Town
Clerk°s Office, Southold, New York, on Thursday, November 20, 1958, at 7:30 P.M.
There were Iresent: Messrs. Robert W. Gillispie, Jr., Chairman, Robert Bergen,
Herbert Rosenberg and Charles Gregonis, Jr.
Also present: Mr. Howard M. Terry, Building Inspector.
PUBLIC HFALRING: Appeal No. 119, Application of G. W. Smith & Sons, for
Arthur Cornell, for a special exception in accordance with the Zoning Ordinance,
.Article III, Section 306, for permit to use and build an attached garage on
property located on the west side of Oakwood Drive, Oakwood Park, Southold, N.Y..
Fee paid - $15.00.
Chairman opened the hearing by reading application for the variance, notice
of disapproval issued to applicant by the Building Inspector and legal notice of
hearing with affidavit attesting to its publication in the official newspaper.
No one wished to speak for or against the application.
Resolution offered by Mr. Gregonis, and seconded by Mr. Bergen,
Whereas the application of G. W. Smith & Sons, for Arthur Cornell, requesting a
special exception for permit to use and build an attached garage on property
located on the west side of Oakwood Drive, Oakwood Park, Southold, NJ.., having
been considered at Public Hearing No. 119, on November 20, 1958, and the Board
finding that strict application of the Ordinance would produce undue hardship
because the adjoining property has been sold and it is impossible to enlarge
lot. The situation is unique because it is a new area and all the other lots meet
the Zoning requirements.
The public convenience and welfare and justice will be substantially served,
and the legally established or permitted use of districts would not be substantially
or permanently injured and the spirit of the ordinance would be observed.
Be it resolved that the application be granted subject to the following conditions
