Southold Town Building Zone Ordinance
Board of Appeals
June 6, 1957
A regular Meeting of the Board of Appeals was held at the Town Clerk' s
office in Southold, N. Y. , on Thursday, June 6, 1957, at 7:30 P.M.
Present were: Mr. Gillispie, Mr. Rosenberg, Mr. Gregonis & Mr. Bergen.
Also: Mr. Hovlard Terry, Building Inspector and lair. R. G. Terry, Jr,l,
Town Counsel.
Absent: Mr. Serge Doyen.
CHARLES L. DOUGHERTY, representing Mr. Henry J. Smith, owner of lots at
Mill Colony, stated that Dir. Smith had decided to cut lots 1 and 2 into
one lot and lots 3 and 4 into another lot, Lot 5 to be sold the way it
is as it is a fringe area case. Lots 6, 7 and 8 to be considered as two
lots. The board advised that an appeal would have to be filed for a
variance. . Public hearing to be held on `.Thursday, June 20th, at the Town
Clerk' s office at 7:30 P.M.
WALTER G. KAPP a.-ttorney for Ma;..rgery Burns. Property located at the
sound and known as "Sunset Knoll". Mr. Kapp advised that he had been to
the 'Town Board and asked them to . establish an open development area for
this particular property. He has received a report from the Planning
Board in which they suggested asking the Board of Appeals for an area
varianc e. Lot 6 has been sold. This lot was in single and separate
ownership before the ordinance went into effect. The board agreed that .
no variance would be needed before a building permit could be granted on
this lot. hir. :Kapp said he would need a right-of-way and assumes that
the planning board will grant an access to the property. trio decision was
made by the board at this time.
Discussion was then held on the forthcoming public hearing to be
held in Mattituck on June 7th. The board asked ivir. `ferry, `town Counsel,
what his opinion was regarding oath to be used a t public hearings.
mr. Terry advised that ordinarily no oath would be administered unless
counsel for the applicant wished to offer a sworn testimony. In such
a .case, the board may elect to have all of the hearing under oath. In
case of a sworn testimony the Chairman would administer the follovdng
oath:
Raise your right hand. Do you solemnly swear that the testimony
you are about to give is the truth, the whole truth and nothing,
but the truth, so help you God?

It was decided that in a case where a hearing would continue until
a n unreasona bly late hour.the board may elect to continue such hearing
at another specified time. No adjournment of the hearing would be
necessary unless an a ttorney for the applicant should ask for an adjourn-
ment and he would then, in all probability, ask for a meeting with the
board a t. a later specified date.
Mr. Terry then advised that affidavits from both newspapers would
have to be obtained and read at the hearing. . Petition by the applicant
would have to be read plus the letter to Mr. Riley, dated May 31st.
The board discussed the matter of removal of buildings and commercial
signs on property which is or has been confiscated. It was agreed that a
building permit would have to be obtained for the rebuilding of a struc-
ture which had been removed. In the case of signs a permit would not
be necessary as long as the owner complied with the necessary setbacks.
FRANK CLAUDIO - Mr. Gillispie mentioned that he had received a call from
Mr. Claudio pertaining to a sign approximately 30' x 121 which had been
removed from leased property in Mattituck due to the sale of this
property as the result of condemnation proceedings. Sign has not been
replaced and he would like to erect it on a suitable site. It was the
feeling of the board that owners of signs which had been removed subject
to condemnation proceedings should be permitted to reerect them.
Minutes of the May 31st meeting were then read by the secretary.
On motion made by Mr. Gregonis, seconded by Mr. Bergen and carried,
minutes were approved.
