Southold Town Building Ordinance— Zoning
Board of Appeals
July_ 25, 1957
A regular meeting .of the Zoning Board of Appeals was held at the Town Clerk1s
office in Southold, N. Y., .on.Thursday, July 25, 1957, at 7:30 P.M.
There were present: Mr. R. W. Gillispie, Jr., Chairman
Mr._ Robert Bergen -
Mr. Herbert Rosenberg
Also: Mr. Howard M. Terry, Building Inspector
Absent: Mr. Charles Gregonis and Mr. Serge Doyen
Mr. G. Nickles, Main Road, ,Southold, N. Y., asked the board if it were possible to
obtain an ,immediate variance on Lot No. 12, Block 2, on map of Beixedon Estates. Lot
on Map No. ;1472 filed in Suffolk County Clerk1s Office on March 16, 1946. Size of lot:
751 x 29019 on which a house was built in August of 1955. On July 8, 1957, Mr, Nickles
drew up_.contract of sale and the man buying the house lives in Peconie and he is clos—
ing his property out on -July 26th and Mr. Nickles had guaranteed him occupancy to house
on Lot 12 on August lst. Board advised Mr. Nickles that he would have to apply for
the variance through the usual channels and legal notices would have to be published
before a public hearing could be held.
Mr. P. V. Murphy, West View Drive, Mattituck, N. Y. Mr. Murphy advised that he had
read notices in the papers regarding appeal of Mr. Braun for a variance and questioned
the reason for the variance. Board explained to Mr. Murphy that the lot in question
was undersized and did not conform to the Zoning Ordinance and in order to build on an
undersized lot the owners of such a lot would have to receive a variance from the board
- of appeals before the building inspector_.could issue a building permit.
PUBLIC HEARING — Appeal No. 10 -- Upon application of William and Robertina .Breun
of 18th Street, Jericho, N. Y., for variance to Zonind Ordinance, Article III, Section
303. Lot No. 28, 751 x 1701 on William and Harry Masonts map of IlWestview", east side
of Mattituck Creek, Mattituck,_ N._Y.
After introduction of the members of the board, letter to Mr. & Mrs. Braun advising
them of date of hearing, legal notices and affidavits from two official town newspapets
and petition for variance were all read by the Chairman.
Chairman: "Is there anyone present who wishes to speak "for" this appeal?"
IlAnyone wishing to speak Ilagainst" appeal? II
Board reviewed appeal and studied map.
Chairman: I'There being no objections to this appeal and lots on either side of
Lot 28 bein completely built up, it is the unanimous decision ofthe board that appeal
be granted.

Discussion was held regarding the present Zoning Ordinance and it was decided to
have the Secretary write Commissioner Dickenson ofthe Department of Commerce in Albany
to try and procure copies of the booklet "Local Planning and ZoningII for each member
of the board.
Minutes of the July llth meeting were read. Upon motion made by Mr. Rosenberg
and seconded by Mr. Bergen, and carried, minutes were approved.
Next meeting to beheld on Thursday, August 1, 1957.
Meeting adjourned at 10:30 P.M.
