A regular meeting of the Southold Town Board of Appeals was held at 7:30
P.M. on Thursday, August 8, 1957, at the Town Clerk' s Office in Southold, N. Y.
There were present;_Mr. Gillispiq; Chairman, Mr. Bergen, Mr. Rosenberg and
Mr. Gregonis.
Also: Mr. H. M. Terry, Building Inspector.
Absent: Mr. Serge Doyen, Jr.
Minutes of the August 1st meeting were read. On motion made by Mr. Rosenberg
and seconded by Mr. Gregonis, and carried, minutes were approved.
PUBLIC HEARI1jG: Appeal No. 12. Application of Horace E. Kyser of 504
Hempstead Avenue, West Hempstead,_ N. Y. , for a special exception to build and
operate an automobile service station on lot 1501 x 1251 , south east corner
Locust Lane and Main Road, Southold, N. Y. Article IV, Section 400, Item 9
of the Zoning Ordinance.
Letter to Mr. Kyser advising of date of public hearing and legal notices
with affidavits from two official town newspapers were read by the Chairman.
Chairman: "Is there anyone present who wishes to speak "for►l this appeal?"
Mr. Kyser: "Yes. I have here building plans and plot plans and would like
to show them to you. I have with me Mr. Warner of the Texas Company. Also
Mr. DeCamp and Mr. DePiazzy. °
Mr. Warner: °I would- like to say that the building is set up pretty well in
the center of the plot. The plans show two pump islands, one of two pumps and
the other of three pumps, which is subject to change when we get a final survey.
Tanks are 301 back from the property line.'
Chairman: I'What. is going to be along the side of the building and tanks?"
Mr. Warner: tilt is going to be asphalt all around. "
Chairman: "What about entrances and egress from the station to the street. "
Mr. Warner: "We have to have curb cuts at various points. There will be
three entrances', each of 251 . A curbing of 171 will be at the corner of Locust
Lane with two curbings of �51 each between the three cuts, leaving 81 on other
corner. 11

Mr. Warner: "We intend to place a Texas Company sign on curbing at the
corner ofthe property. "
Chairman: "I .am wondering if it would be favorable to have a grass plot on
the corner. "
Mr. Warner: "We prefer a blackout instead of grass as it would be easier to
keep neat and clean. " "We intend a solid block of concrete which will be nearly
41 back from the line. "
Chairman: "Just where would the sign be placed?"
Mr. Warner: "It would be placed in the concrete,, which goes up about 18
inches. Tf this map is approved a final layout will- 'be prepared and it is possible
that we may end with a little different setup as to- gas tanks, etc."
The board then discussed in detail the matter of the curbing on Locust Lane
and all agreed that a 251 should be placed at that corner in the interest of
safety.
Chairman: "Is there anyone here who wishes to speak "against" this exception?"
!lAre there any other questions?" "I think we can make our decision right away. "
Mr. Kyser: "We will present final map to the Building Inspector at the time
the permit is applied for and shall adhere to the recommendations of the board."
Board unanimously agreed to grant this appeal withthe understanding that
applicant agreed to the stipulation of the board_ that a 251 curb be placed on
Locust Lane in the interest of safety.

PUBLIC HEARING: Appeal No. 11 — Application of Mrs. Grace R. Nickles,
Southold, N. Y. , for a variance of the Building Zone Ordinance, Article III,
Section 303, on Lot. No. 12, Block 2, Map of Beixedon Estates, 751 x 2901.
Letter advising date of public hearing and legal notices with affidavits from
two official town newspapers were read by the Chairman.
Chairman: "Is there anyone present who wishes to speak "for" this appeal?
Anyone "against"? There being no response the board. I believe is agreed that
this appeal should be granted. "
Since this. lot is on filed map No. 1472, which we understand is going to
be approved, and dwelling was erected on lot in august of 1955, board_ feels that
strict application of the Ordinance would_ produce unique and undue hardship..
Since variance does observe the spirit of the Ordinance the board unanimously
agrees to grant this appeal.

Mr. Ernst G. Radford of East Marion, N. Y., presented unfiled map', dated
Septeraher 15, 1950, plan of lots of James Douglass at Orient, N. Y. There are
two lots in question, 681 on the road and 801 on the water, with a depth of
2001 . Board advised that a variance would have to be applied for in order to
build on either lot. Mr. Radford then mentioned a lot in East Marion, 601 x
851 and was wondering whether the buyer or the present owner should apply for
the variance. It was the opinion of the board that the variance be applied for
by the buyer when he is ready to build. _
PUBLIC HEARING: Appeal No. 13 — Application of James DIAgusta, Kenneyls
Road, Southold, N. Y. Application for variance to Zoning Ordinance, Article III,
Section 303, on lot No. 8, 751 x 1531 , Kenney's Road, Southold.
Letter to Mr. Don.iel .Smith, Main Road, Southold, N. Y. , advising of date
of public hearing, legal notices and affidavits from two official town news—
papers were read by the Chairman..
Chairman: 11Ts there anyone present who wishes to speak "fort' this appeal?
Anyone wishing to speak "against" appeal?- There being no response I believe
the board can make an immediate decision. 11
Since lot was sold under contract previous to adoption of Zoning, this being
a time payment deal which was paid up and deed given about June 15, 1957, board
unanimously agreed to grant this appeal for variance.
Hearing Ended.
The Chairman advised that all members of the' board were invited to attend
the Town Board meeting at Fishers Island on August 20th.
Next meeting to be held on Thursday, August 15, at the usual time and place.
Meeting adjourned at 10:00 P.M.
