Gillispie, Jr., Chairman Southold_ Town Board of Appeals Robert Bergen September 19, 1957 Herbert Rosenberg Charles Gregonis, Jr. Serge Doyen, Jr. A regular meeting of the Southold Town Board of appeals was held at 7:30 P.M. on Thursday, September 19, 1957, at the Town Clerkis office in Southold, N. Y. There were present: Mr. R. W. Gillispie, Jr. (Chairman) Mr. Herbert Rosenberg Mr. Robert Bergen Absent: Mr. Serge Doyen, Jr. and.Mr. Charles Gregonis, Jr. i Also _ present: Mr, Howard M. Terry, Building Inspector r Appeal No. 24 - Application of Ursula Sledzieski and Dr. 1awrence T. Waitz for a variance to the Zoning. Ordinance under Article VIII, Section 801-A, paragraph b. Appeal was denied unanimously because the Board believes the OR clause in Article III, Section 300, sub-division 8 must be interpreted in the light of the definition for an Accessory Building, as provided in Article I, Section 100, sub- division 1. Counsel for the appellants interprets this clause to mean that a building for the practice of veterinary medicine can be erected apart and physically separate from the dwelling building in which the practioner resides. However, the Board's interpretation of this type of permissive use in Section 300 is that a profession such as described in sub-division 8 must be conducted in the dwelling building of the owner but can overflow into an accessory building. D r. Waitz and counsel have been seeking a method of establishing Dr. Waitz as a veterinarian in the Torn of Southold to conform with the Zoning Ordinance. In the past efforts were made to the Southold Town Board to either amend the Ordinance to permit the practice of veterinary_ medicine in the "A" Residential and Agricul- tural District or to change the zone of this property to 11Bn Business District, On August 7, 1957, the Southold Town Planning Board stated that they were not willing to recommend either one of these procedures and suggested to the Town Board that the location of kennels and exercise pens be referred to the Board of Appeals as a special exception. The Board of Appeals directed the Building Inspector to issue the necessary building and use and occupancy permits to permit the construction of an office and clinic to be attached to the west side of the dwelling to be purchased by Dr. Waitz from Ursula Sledzieski. Southold Town Board of Appeals September 19, 1957 MINUTES, Continued PUBLIC HEARING: Appeal No.- 27 on application of.Earold J, Schaller of 61 Robbin Drive, .East Williston, N. Y. for a variance to the Zoning Ordinance, Article III, Section 303, on lot No. 77 and half of lot No. 78, 751 frontage x 1301 in depth. Lot on filed map of Gardiners Bay Estates, Letter to Mr. Schaller advising of date of public hearing, application for appeal and legal notices with affidavits from two official town newspapers were read by the Chairman. Owner is unable to purchase any adjacent land to in size of lot and since the variance does observe the spirit of the Ordinance and strict application of the Ordinance would produce undue and unique hardship it was the unanimous decision of the Board to grant the appeal. Hearing ended. PUBLIC HEARINGS Appeal No. 28 on application 'of Thomas J. and Ethel M. Hickey of 226 Monsell Place, Greenport, X. Y. for a variance to the Zoning Ordinance, Article III, Section- 303, on .lots Nos. 23, 24 •and 25, 691 x Z00t each. Lots located on Anglers Road ox unfiled map of Sunrise Estates, Greenport, N. Y. Letter advising date of public hearing, application for appeal and legal notices with affidavits from two Official town newspapers were read by the Chairman. Owner is dividing the three lots into two lots of got frontage x 1001 in depth. Board unanimously agreed to grant this variance, It was the decision of the Board that strict application of the Ordinance would produce undue and unique hardship as there is no adjacent land available and the variance does observe the spirit of the Ordinance as the lots in question will be increased in size and will not change the character of the district as other lots in that area are smaller. Hearing ended. Minutes of the September 12th meeting were read and on motion made by Mr. Rosenberg, seconded by Mr. Bergen, and carried, minutes were approved. Meeting adjourned at 9:15 P,M.
