A regular meeting of the Board of Appeals was held at 7:30 P. M. on Thursday,
October 3, 1957, in the Town Clerkts Office in Southold, N. Y.
There were present: Mr. R. W. Gillispie, Jr., Chairman
Mr, Herbert Rosenberg
Mr. Charles Gregonis, Jr.
Mr. Robert Bergen
Absent: Mr, Serge Doyen, Jr..
Also present: Mr. Howard M. Terry, Building Inspector
PUBLIC HEARING: Appeal No. 30 - Application. of Clement W. Booth of Mt. Beulah
Avenue, Southold, N. Y., for a variance of the Zoning Ordinance, Article III,
Section 303. Location of property: Lot. No. 10, 801 frontage x 1601 in depth, on
south side of Sound View Avenue, Southold, N. Y.
Letter to Mr. Clement advising him of date of public hearing, application for
variance and legal notidb s with affidavits from two official town newspapers were
read by the Chairman.
There being no one present to speak either ufor� or "against" this appeal the
Board, after study and discussion, unanimously agreed to grant this appeal. It was
the decision ofthe Board that strict application of the Zoning Ordinance would
produce undue and unique hardship as the land in question had been surveyed and
laid out to Zoning requirements and an existing road made it impossible to increase
the frontage of the lot. Also, the variance does observe the spirit of. the Ordi-
nance as total area of lot is sufficient to cokply with the Ordinance.
Hearing Ended.
Discussion was held on the subject of Access to Property, under Section 280-A,
Paragraph b, of the New York State Law. It was agreed that tentative rules of
procedure in approving access to property in general should meet the following
conditions. One lot in width. Two or Three lots in depth. Width in feet should
not exceed 150 ft. overall, including the right-of-way. It is our understanding
that no fee is to be charged, in accordance with the Town Boardts decision in the
matter, for appeals for access to property..

Accurate description of the right—of-=vray must appear on the appeal form and
will be included in the variance.
Permit for access can be made subject to conditions thatewill protect any
future street or .highway layout.
Mr. Rosenberg then presented rough drafts of several appeal applications
for the Board's review and approval. It was the Board's decision to present
the new forms to the Town Counsel for approval and printing.
Minutes of the September 26th meeting were read. On motion made by
Mr. Gregonis, seconded by Mr. Rosenberg, and carried.Minutes were approved.
T he next meeting of the Board of Appeals will be held on Thursday, October
17th at the usual time and place.
