A regular meeting of the Southold Town Board of Appeals was held at 7:30
P.M. on, Thursday.. December 19, 1957, in the.Town Clerkls Office, Southold, N. Y.
There were present: Mr. R.- 1lispie, Jr. — Chairman

Mr. Charles Gregonis, Jr.
Absent: Mr. Serge Doyen, Jr.
Also Present: Mr. Howard M. Terry, Building Inspector.
PUBLIC HEARING: Appeal No. 39 —, .Application of Julian and Bertha. Fiedler
of 427 7th Street, Greenport, IT. , for a variance to the Zoning Ordinance, v�

Beach and Bay Roads, Greenport, N. Y. Variance requested in order to permit
appTican.ts_ to move two small bungalows to the property in question. Mr. & Mrs.
Fiedler bought the land in 1951 with the intention of erecting several small
summer cottages. _
Application for appeal, letter to applicants advising them of date of public
hearing and legal notices with affidavits from two local newspapers were read by
the Chairman:
Chairman: .I'Is there anyone present who would like to speak 11forf' this appeal?
Mr. Fiedler: "We would like to place one bungalow on ea.ch corner I.of the lot
or would place them wherever you gentlemen decided would be best. I would like to
.\say that most of the neighboring_ lot.s..are 50 foot lots."
Chairman: I'Is there anyone else who wishes to speak "for" this appeal.

we have no objection to the variance being granted. "

It was the decision of the Board that this appeal be granted with tree stipula—

tio.n that the jointly owned lots in question be transferred separately to Mr. 8c Mrs.
Fiedler and recorded, at which time the variance will be issued and the applicants
can proceed with plans to move the houses on to the property as located on map of
December 4, 1957, which_accompanied the application.

Mattituck, N. Y., for a variance to the Zoning Ordinance, ARTICLE III, Section
303• Location of property: Irregular- shaped lot 80/831. x 220f245i on east side of
Old Jule Lane, Mattituck, N.'' Y. Variance requested.on Lot No. 4 on map of 0. W.
VanTuyl dated January. 29., 1951_ (revised September 131 1951).

Mr. Zanowski: nI bought the lots in 1950 and had them surveyed in 1951. I
would like to have the variance on that lot in order to sell it. 11
Chairman: "Is there anyone present who wishes to speak °against" this appeal?"
Appeal was unaninously granted._ It was the feeling of the Board_ that strict
application of the ordinance would.produce undue and unique hardship as lotX was
purchased before the enactment of the Zoning Ordinance for the purpose of resale
and has been held in single and separate ownership since that time. The variance
does observe the spirit of the Ordinance and would_. not change the character of the
district as all other lots in this immediate area are of similar or smaller size.
Minutes of the December 12th Meeting were read. On motion made by
Mr. Gregonis, seconded by Mr. Bergen, and carried,, Minutes were approved.
The next meeting will be held at the same time and place on January 9, 1958.
Meeting adjourned at 9:15 P. M.
