BOARD OF SOUTHOLD, TOWN TRUSTEES
Meeting of September 10, 1974
A regular meeting of the Board of Southold Town Trustees was held
at 7 :30 P.M. , Tuesday, September 10, 1974 at the Town Board meeting
room, 16 South Street, Greenport, New-York, with the following
present:
Alvah B. Goldsmith, Chairman
Philip G. Horton
Frederick E. Gordon
Douglas M. Robertson
George Bird
Judith T. Boken, Secretary
Also present: Steve Katz, representing the Long Island Traveler=
Mattituck Watchman.
The Board again considered the application of Richard Guy Miller,
presented on August 5th, and held for—investigation.
On motion of Mr. Bird, seconded by Mr. Gordon, it was
RESOLVED that Richard Guy Miller, c/o Floyd F. King, Orient, New
York, be denied permission to place an anchor and bouy mooring in
Mattituck Creek. Mr. Miller is not a resident of Southold Town,
and the boat, a 31 f t. Seafarer sailboat, is too large to be moored
in the area requested.
Vote of the Board: Ayes : Mr. Goldsmith, Mr. Robertson, Mr. Horton,
Mr. Gordon, Mr. Bird.
The Board again considered the application of Hallock N. Young,
presented on August 5th, and held for investigation.
On motion of Mr. Gordon, seconded by Mr. Horton, it was
RESOLVED that Hallock N. Young, A;70 Reeves Park, Riverhead, New
York, be denied permission to place a mushroom mooring in Jockey
Creek, Southold. Mr. Young is not a resident of Southold Town,
and he has had his sailboat moored in Jockey Creek without permission,
and the Board has received several complaints as to its hazardous
location, and neglect.
Vote of the Board: Ayes : Mr. Goldsmith, Mr. Robertson, Mr. Horton,
Mr. Gordon, Mr. Bird.

On motion of Mr. Robertson, seconded by Mr. -Gordon, it was
RESOLVED that Dr.. Maxwell Y. Simkin, 4 Hen Hawk Road, Great Neck,
New York, be granted permission to construct a bulkhead 155 ft. in
length on his own property at Gull Pond, off Snug Harbor Road, and
attach a platform 6 ft. by 8 ft. , ramp 4 ft. by 6 ft. , floating dock
6 ft. by 45 ft. , and three mooring piles thereto, .all in accordance
with the detailed specifications as presented in the originating
application. Fee : $37 .20.
Vote of the Board: Ayes : Mr. Goldsmith, Mr. Robertson, Mr. Horton,
Mr. Gordon, Mr. Bird.
On motion. of Mr. Robertson, seconded by Mr. Horton, it was
RESOLVED that the application of Frank. Bisk, 2940 Mott Avenue,- Far
Rockaway, New York, for permission to build a -f'amp and float at his
property, a:t Gull Pond Road on the Fordham Canal, Greenport, New
York is outside the jurisdiction of the Town Trustees, as it is
located on a man-made canal, and not considered Town waters, and
therefore the Board waives objection to the construction of this
ramp and float.
Vote of the Board: Ayes : Mr. Goldsmith, Mr. Robertson, Mr. Horton,
Mr. Gordon, Mr. Bird.
On motion of Mr. Bird, seconded by. Mr. Robertson, it was
RESOLVED that Thomas J. Fitzmaurice, 345 _Snug Harbor Road, Greenport,
New York be granted permission to place a mushroom mooring in Gull
Pond, off the end of Gull Pond Road, Greenport, all in accordance
with the detailed specifications as presented in the originating
application. Fee: $5. 00.
Vote of the Board: Ayes : Mr. Goldsmith, Mr. Robertson, Mr. Horton,
Mr. Gordon, Mr. Bird.
The Board received two applications.. from Robert W. - Foster, 315 South
Street, Greenport, for onshore-offshore moorings at- the foot of
Pine Neck Road, Southold, in Town Creek, and in Richmond' Creek, off
Indian Neck Lane, Peconic. The Board will investigate the locations.
Moved by Mr. Bird, seconded by Mr.. Horton, -it was
RESOLVED that the August 5, 1974 minutes of the Board of Southold
Town Trustees be approved as .submitted.
Vote of the Board: Ayes : Mr. Goldsmith, Mr. Robertson, Mr. Horton,
Mr. Gordon, Mr. Bird.
On .motion of Mr. Robertson, seconded by Mr. Horton,
BE IT. RESOLVED that this Board approves ,.. as. of . August. 12, 1974,
the retention, as special counsel to this Board.,. of Gerard A. Dupuis,
Esq. and his firm of Miller & Summit, - Esgs. , 90 Broad Street,- New
York, New York 10005 , for -the purpose of filing a Brief, as amicus
curia on behalf of this Board, with the New York Court of Appeals
in a matter entitled "The State of New York vs. James H. Rambo, Inc. "
and that said Brief shall set forth an argument opposing the position
taken in the matter by the State of New York; and

authorized, as of August 12 , 1974, -to -proceed by appropriate
motion to the Court of Appeals seeking leave for this Board-to

The Secretary a sed the Board that a telephone c 1,1_"had been
received fro the Southwood Civic Association opposing any further
moorings/ £ the .foot of Wood End Way. It is crowded and boats are
inter -ef�ring with the public beach. A further complaint was received
from Mr.

RESOLVED that the following annual estimate for the Southold
Town Trustees be submitted to the Town Board for the fiscal year
beginning January 1., 1975 :
