I N U T E S BOARD OF SOUTHOLD TOWN TRUSTEES Meeting of February 11, 1974 A regular meeting of the Board of Southold Town Trustees was held at 7 :30 P.M. , Monday, February 11, 1974 at the Town Board meeting room, 16 South Street, Greenport, New York, with the following present: Douglas M. Robertson, Acting Chairman Philip G. Horton Frederick E.. Gordon George Bird Judith T. Boken, Secretary Absent: Alvah B. Goldsmith, Chairman Also present: Loretta Hess , representing the Long Island Traveler- Mattituck Watchman; Evelyn Gordon, representing the North Fork Tax- payers Association; Carol Bolger, representing the North Fork Environmental Council; Loraine Terry. On motion of. Mr. Gordon, seconded by Mr. Horton, .it was RESOLVED that the minutes of the Board of Southold Town Trustees .meeting held on January 7 , 1974 be approved as submitted. Vote of the Board: Ayes : Mr. Robertson, Mr. Horton, Mr. Gordon, Mr. Bird. 9 Mr. Robertson introduced Mr. George Bird, Mattituck, New York, new Southold Town Trustee, replacing Rudolph Johnson who resigned January 1, 1974. Mr. Rudolph Bruer, Esq. appeared before the Board representing Charles King and Anthony DeMaula on their proposal to lease 22 acres of underwater land in Mattituck Creek from the Town of Southold for the purpose of developing and farming oysters. Mr. Bruer stated he had nothing new to add but was available for any questions the Trustees might have. Mr. Robertson advised him that the Board has taken the proposed project under advisement and study, and will contact him for explanations or opinions if the need should arise. (Mr. Charles King appeared later in the meeting and submitted a survey of the proposed 22 acres, and a survey dated January 22 , 1923 showing oyster lease of of R. H. Bassford in Mattituck Creek. -- Mr. Paul Chanley also appeared to advise the Board that the D.E.C.' has certified the area in question for shellfish culture. ) 111 Mr. Jarvis Verity and Mr. Bob Hamilton of the Southold Town -Baymen 's Association appeared before the Board to protest the King-DeMaula project. They. stated_ it would cut out clamming, eeling, crabbing, etc. in Mattituck Creek, and the creeks aren ' t big enough for oyster farming. Mr. Robertson advised Mr. Verity that the .Trustees would like to meet with the Baymen's Association, and would be in touch with him. Mr. Norman M. Imray appeared before the Board to represent his applica- tion for a mooring permit at Mattituck Creek. Th.e_ Board discussed the location of the mooring with. Mr. .Imray and it.was agreed that the boat should be moored perpendicular to the shoreline. On motion of Mr. Bird, seconded by Mr. Gordon, it was RESOLVED that Norman Imray, Knollwood Lane, Mattituck, New York, be granted permission to place two mushroom anchors (perpendicular to the shoreline) in Mattituck Creek at the foot of Knollwood Lane, Mattituck, New York, all in accordance with the detailed specifications as presented in the corrected originating application. Fee $5 . 00. Vote of the Bo-ard: Ayes : Mr. Robertson, Mr. Horton, Mr. Gordon, Mr. Bird. An application by Albin Czelatka for a mooring at Arshamomaque Pond was received and examined by the Board. On motion of Mr. Gordon, seconded by Mr. Bird, it was RESOLVED that Albin Czelatka, Mill Colony, Southold, New York, be granted permission to place an onshore-offshore mooring in Arshamomaque Pond, Southold, New York, at the foot of Grove Road, "Alltln accordance with the detailed specifications as presented in the originating application. Fee: $5. 00. Vote of the Board: Ayes : Mr. Robertson, Mr. Horton, Mr. Gordon, Mr. Bird. An application for an onshore-offshore mooring was received from John S. Zimnoski, Breakwater Road, Mattituck, New York. The Board examined the application but withheld decision until an investigation can be made as to whether access to the mooring is over public or private property. An application was received from David Ackerman, 495 Rochelle Place, Mattituck, New York, requesting permission to construct a fixed dock over his bulkhead on James Creek. The Board examined the applica- tion and withheld decision until the site can be inspected. Notification was received from the Town Board instructing the Town Trustees to disregard recommendation on Wetland Application No. 13, Leonard Fischer. The Town Board has recommended that Mr. Fischer make application to the State of New York as this is fresh water and out of the jurisdiction of the Town of Southold under their Wetland Ordinance. 112 The .-I3oard. of_Town Trustees wa.ived ..the requirement for applicants to be present at the presentation of. an -application.. The Board will review the application and-, if there are any questions the Board will request the applicant ' s . appearance 'at the next meeting. The gas shortage has. .brought about this .temporary. measure. On motion of Mr. Gordon, seconded by Mr. Horton, it was RESOLVED that the next meeting of the Board of Southold Town Trustees will be held at 7 :30 P.M. , March 4, 1974 at the office of the Supervisor, 16 South Street, Greenport, New York.
