A meeting of the Town Trustees was called to order at 4 P.M. on
Tuesday, April 24, 1956, by President Emmons Dean.

Mr. Carl E. Vail appeared before the Board to report on a condition
existing at the location on Jockey Creek where Messrs. Francisco
and Hendrickson are dredging. He reported that the run-off from
the disposal area on Barron Hill 's property was carrying the fill
out toward the old existing channel to a point where it would
interfere with navigation. The Board agreed to inspect the job
at once.
Mr. Vail suggested that if possible it would be very desirable
if an ordinance could be enacted to prevent anyone from digging
clams in the Immediate proximity of any private docks or bulk-
heads in the creeks of the Town. Also to restrict shellfishing
in creeks to residents and to bar commercial shellfishing within
the creeks of the Town to conserve the shellfish for the future
enjoyment of the towns residents.
The Board visited the location of the dredging project of Francisco
and Hendrickson and found that the disposal area had not been
properly diked. The overflow had caused a large shoal to be formed
southerly of the disposal area which extended almost half the
distance across the creek and up to the edge of the exidting
channel. The Beard was unanimots".in their decision that this
condition was detrimental to the other property owners on the
creek and to all others using the creek. It was voted unanimous-
ly that the Contractor be advised by phone immediately of the
condition and that he be directed to correct this condition
immediately by removeing this material from the creek and to
redeposit it on the disposal area in such a manner as to prevent
any recurrence of this flowback and shoaling by means of adequate
dikes along the general shore line of the disposal area.
.After consultation with the Town Attorney it was voted that the
Clerk also notify Messrs . Fox, Francisco , Hendrickson and Hill
by registered mail of this situation and further advise them that
the condition must be corrected immediately. The clerk was auth-
orized to see the men on the dredge Wednesday morning, Apr. 25,
and to advise them of the Board's Action and see to its enforce-
ment.
The minutes were read and approved.
The meeting adjourned at 5:45 P.M.
