TRUSTEES Meeting of November 12 , 1973 A regular meeting of the Board of Southold Town Trustees was held at 7 :30 P.M. , Monday, October 1, 1973 at the Town Board meeting room, 16 South Street, Greenport, New York, with the, following pres.ent: Alvah B. Goldsmith,. Chairman Douglas M. Robertson . Philip G. Horton Frederick E. Gordon Rudolph Johnson Judith T. Boken, Secretary . Also present: Lorraine Terry, representing the North Fork Environmental Council, and Lorretta Hess, re_ presenting the Long Island Traveler-Mattituck Watchman. Mr. Lawrence Tuthill appeared .to represent the application of Mariano J. Cassata for a dock, ramp and floats at the south side Long Creek branch of Mattituck .Creek. The- float will be. within 4 ft. of the dredged channel, and will be constructed in lieu of the dock granted to Mr. Cassata under permit No.. 371 dated May 2 , 1966. On motion of Mr.. Johnson, .seconded by Mr. ; Robertson,� it was . RESOLVED that M. J. Cassata, 9420 Avenue M, Brooklyn, New York be granted permission to construct a dock 4 ft. by 34 ft. , ramp 20 ft. by 2 2 ft. , -2 floats 6 ft. by 20 ft. , with 4 ,mooring piles in front of his property on Long Creek, off Westview Drive, Mattituck,, New York, all in accordance with the detailed specifications as presented in the originating application. Fee $46. 60. Vote of the Board:. . Ayes: Mr. :, Goldsmith, Mr:_ Robertson,-: Mr..;.. Horton, Mr. Johnson, Mr. Gordon. Mr. Lawrence Tuthill also represented. Harold Casin for permission to construct a ramp and float at his property on Baldwin ' s Creek, where there is an existing dock. On motion of Mr. Robertson, seconded by Mr. Horton, it was RESOLVED that Harold Casin, 365 West 28th Street, New York, New York be granted permission to construct a 4 ft. by 14 ft. ramp 104 and 6 ft. by 20 ft. float with 2 mooring piles at the end of. his existing dock on Baldwins Creek, off Strohson Road, Cutchogue, New York, all in accordance with- detailed .specifications as presented in the originating application. Fee $19. 60. Vote of the Board: Ayes ; ,Mr_ Goldsmith_ Mr. .Robertson, Mr. Horton, Mr. Johnson, Mr. Gordon. Mr. Stuart R. MacMillan,' Mattituck, New York appeared before the Board to present his application for permission to experiment in Mattituck Creek wnfithe way to transplant clams; try various types of equ"ipment; study effect of such on surrounding area; ways to enhance the .natural. .set, of'-shellfish; effect of various :type bottoms. , Mr. MacMillan stated that .he. would. like '-to be permitted to use at least three one acre areas where he could experiment in sand,. gravel and mud bottoms, marking -.the 'ar;eas with ,bouys. . , He estimates such a project would take two to three years. The Board asked Mr. MacMillan to submit any .supporting material he might have or could secure, which would: enlighten the Board on such a project, and until the. Board .has time to. study this in detail his application would be held in abeyance. Loretta .Hess and Lorraine. Terry .posed. quest.ionsi.relative to .ahe Trustees ' position on the, proposed New York State Wetland Regulations . Mr. Goldsmith explained at length, the Board' s position, backed by the Town Board, .as not recognizing such regulations; the Trustees have sole jurisdiction over lands under water in .th_e Town .of. Southold; and. their- willingness -to defend- this position in a court of law. On motion of Mr. Robertson, seconded by Mr. Gordon, it was RESOLVED that the Board of Southold Town Trustees ' minutes of October 1, 1973 be approved as submitted.
