HomeMy WebLinkAboutTR-09/08/1975 p. 177 MIN- UTES BOARD OF SOUTHOLD TOWN TRUSTEES Meeting of September 8, 1975 A regular meeting of the Boardobf Southold Town Trustees was held at 7:30 P'.M. , Monday, September 8, X975, at the Town Board meeting room, 16 South Street, Greenpor New York, with the following present: Alvah B. Goldsmith,, Chairman Douglas Robertson Frederick E.. Gordon George Bird Betty Neville, Secretary Absent: Philip Horton Also present: Lorraine & William Terry, and Paul. Stoutenberg of the North Fork Environmental. Council. . Application of A.B. Rosenberg, 250 Great Mill Lane, Great Neck, N.Y. 11023, for permission to dredge in Sterling Creek, Greenport, N.Y. was tabled by the Board for further investigation and inspection of the property. The following propj`rty owners of the immediate area appeared before the Board and stated their objections .to this application: Harry Rocker; Clarence Powell;. David -Bruckenheimer; Nancy Cook. Several other -unidentified Property owners of the area were -also present. Lorraine Terry stated that the North Fork Environmental Council would like to go on record as objecting to this application. The Chairman instructed the secretary to send a special deliverry letter. to the U.S. Army Corps of Engineers registering our objections to thbsissuance of this- permit in view of the fact that it appears-.to- be in .violation of our. Ordinance. Also, ..there appears to be .a- discrepancy- in the number of yards to be excavated .in the application made to .the U.S. Army Engineers and the application made to .this Board. The Chairman- also instructed the secretary to .send a- letter to each member of the Board of- Appeals and- Town Board individually inquiring if application ha.s ever been .made, and/or granted-. for a change of zone on this property to allow the operation of a marina. On motion by Mr. Goldsmith, seconded by Mr. Bird, it was RESOLVED that Theodore-.Christianson, 1220_Deep Hole Drive, Mattituck, New York, be granted permission to construct a ramp 3' x 101 , , and a float 5' x 1.61 with 2 mooring piles directly in front of. hias, own property od� Deep Hole Dreek, . at Deep Holb Drive, Mattituck, New York, all in accordance with the detailed specifications as presented in the originating application. Fee $13.00 -Vote of the Board: Ayes: Mr. Goldsmith, Mr. Robertson, Mr. Gordon, Bird. p. 178 On motion by Mr. Robertson, seconded by Mr. Gordon, it was RESOLVED that Henry C. Weismann, 145 W. Main Street, Smithtown, N.Y. , be granted permission to dredge and extend existing bulkheading 165' to the east on north side of existing canal to prevent further erosion of land on his property located off Sages Basin, at Tarpon Drive, ,.Greenport, N.Y. , all in accordance with detailed specifications as presented in the originating application. Fee $5.00. This permission is granted subject to the Trustees having jurisdiction in this area. Vote of the Board:. Mr. Goldsmith, Mr'.. Robertson, Mr..- Gordon, Mr. Bird'. On motion by Mr. Gordon, seconded by Mr. Robertson, it was RESOLVED that the Board of Southold Yawn Trustees favorably recommends the approval of Wetlands .A lication #. 25 by Henry C. Weismann for permission.-to dredge in Sage' s Basin, directly in front of..-his own pr-operty.'.at Tarpon Drive, Greenport, N.Y. Vote of the Board: Ayes: Mr. Goldsmith, Mr. Robertson, Mr. Gordon, Mr. Bird.. . , The Trustees have .examined this .area '.and -do not have.. j any objections to this, providing that they have jurisdiction. This whole area is a man-made canal. On motion by Mr. ' Roberrtson, seconded by Mr. - Bird-9 it was_ RESOLVED Harold P. I I y I I I p• 179 On motion by Mr. Goldsmith, seconded by Mr. Robertson, it was RESOLVED that Geraldine Berge, Minnehah.a Blvd. & Owaissa Ave. , Southold, N.Y. be granted permission to place onshore-offshore mooring in Corey Creek at the foot of Owaissa Avenue, Southold, N.Y. , all in accordance with the detailed specifications as presented in the originating application. Fee $5.00 Vote of the- Board: Ayes: Mr. Goldsmith, Mr. Robertson, Mr. - Gordon, Mr. Bird. On motion by Mr. Gordon, seconded by Mr. Bird, it was RESOLVED that Austin & Virginia Lawther, Indian Neck Lane, Peconic, N.Y. be granted permission to do preventative maintenance on bulkheading at Richmond Creek, directly in front of their own property at right-of-way off E/S Indian Neck Lane, Peconic, N.Y►, all in accordance with the detailed specifications as presented in the originating .application. Fee $5.00 Vote of the Board: Ayes: Mr. Goldsmith, Mr. .Robertson, Mr. Gordon, Mr- Bird. On motion by Mr. Robertson;= seconded by Mr. Bird, it -was RESOLVED that William E. DeBruin, 163 R.ockaway-Road, _ Garden City, N.Y. 11530 be granted permission to place offshore- (mushroom) mooring in Little Creek, off Pine Tree Road, Cutchogue, N.Y. , all in accordance with the detailed. specifications as presented in the originating application. Fee $5.00 Vote. of the' Bpard: Ayes: Mr. Goldsmith; Mr. Robertson, Mr. Gordon, Mr. Bird. The Board of Southold Town Trustees was presented with request from- the Southold Town Clerk (dated September 1 , 1975) for bud et estimate for the next fiscal year. Subject estimate must e presented to the Town Clerk by September 22, 1975. The Board acknowledged receipt and will prepare- estimate .and submit , to secretary before that date. Letter was received from John Wickham (dated August 29, 1975) informing the Trustees that he plans to repair existing bulkheading. on his property at Cutchogue. The Chairman instructed the secretary to send a letter to Mr. Wichkam advising him that he does not,-need a permit from the Trustees for this work, but if he should have an extra copy of the plans, the Trustees would-like to -have them' for their records. The Board discussed the mooring problem at Narrow River, Orient. It was decided ghat they will make an inspection of the area at 2: 00 P.M. , Saturday, September 13, 1975. The Board will also inspect the A.B. Rosenberg property at Sterling Basin, .Greenport, and the Guenther Stotzky property at Gull Pond, Greenport. The Chairman instructed the secretary to. make 5- copies of-..each of these files - to be picked up by him on Friday. p. 180 The Board was presented with two quick claim deeds regarding the re-location - of a portion ,of Nassau Point' Road at Cu.tchogue. Subject- deeds were 'drawn- 'between the -`Board of Trustees of the Town of Southold and- the Nassau Point Causeway Association; and the Board of Trustees of the .''Town of Southold and the Cutchogue-New Suffolk -'-'ark District: All of the members present signed the deeds. They also must- be signed-by -Philip Horton, who was absent, and then returned to Town 'Attorneyy Tastier.. Correspondence dated August1-,`.?1975 was received from the Cooperative Extension,,,_ Cornell. University, State University of New York U.S. Dept.. of.. Agriculture::.. The Board discussed the-'Southampton Town - Dolphin case. Southampton.. .Town is seeking aid from other municipalities and- the state attorney general in. ari attempt to reverse a precedent setting State Court of Appeals decision that removes .hundreds of shoreline acres from the control of the town trustees. This is a very important matter. The Trustees are to investigate the matter as to cost. Announcement was received from the law firm of Bleakley, Platt, Schmidt &_Fritz stating that Gerard A. Dupuis has. become a member .of their firm. Announcement received. from Marian- Steinberg, Conference Coo dinator, New York Sea' Grant Institute Re: Two Sympbsia to be held in November. 1975. Subject notice to be placed on file for reference. Lorraine Terry, North Fork Environmental Council questioned the County -dredging .at Pete' s Neok, Orient. The Trustees are to investigate and -find out who originally requested this' dredging project. -- Copy of letter sent. to _George Burrell,. dated August 139 1975, by Building Inspector Edward Hindermann was presented to the Trustees. In this letter Mr. Hindermann informed Mr. Burrell that .a wetlands permit will be required before he can fill=_. the lagoon between lots 98 &_ 100.. as contemplated on Map..,, of Nassau Point. Prop. , .Cutchogue, N.Y. Copy of letter sent to Richard J. Northridge, -dated August 5, 1975, by Building Inspector Edward Hindermann was presented to the Trustees. Mr. Northridge is in violation of the Wetlands Ordinance because he has deposited fill over the bank of his property at Sunny Shores,- Lot A, Mattituck, N.Y. On motion by Mr. Gordon, seconded by. Mr. Goldsmith, it was RESOLVED that the minutes of ,the Board of Southold Town Trustees, dated August'.. 4, 1.975, .be approved as submitted. Vote of the Board: Ayes: Mr. Goldsmith, Mr:?
