THIS CERTIFIES that the raising of the existing one and two-story, single-family
dwelling by 2 feet and construct additions to dwelling consisting of a partial (30.4'x45.9'max.)
second story addition over existing first story with new roof overhang in-place of existing; a
3.9'x9.7' one-story roadside addition in-place of existing porch; new 5.9'x19.9' roadside porch
addition with 6.5'x9.7' steps; construct 9.2'x9.8' stoop/steps in-place of existing rear
stoop/steps; construct new 9.2'x20.3' waterside patio usingpervious pavers;relocate 8'x12' shed
to rear of house; erect fencing; remove existing asphalt driveway and install pervious gravel
driveway; abandon existing non-conforming sanitary system and install new, upgraded septic
system no less than 100' from wetlands boundary; raise grade around proposed sanitary_system
with approximately 107 cubic yards of clean sand and topsoil to be trucked in from an approved
upland source; replace and relocate existing public water service line; install drainage system of
leaders, gutters, and drywells; with the condition to establish and subsequently maintain a 15'
wide non-turf buffer landward of edge of wetlands in which the first 10' adjacent to wetlands
boundary is to be actively planted with native vegetation and the outermost 5' of buffer is to be
left for natural growth

DECLARATION OF COVENANTS

Bailey residing at 16 Ryan Drive,Ellington,CT 06029 hereinafter referred to as "DECLARANTS":
WITNES SETH:
WHEREAS, DECLARANTS are the owners of certain real property located at 129 Inlet Lane,
Greenport,Town of Southold, County of Suffolk, State of New York, described in the Suffolk County Tax Map
as District 1000, Section 43, Block 5, Lot 6, which is more particularly bounded and described as set forth in
Schedule "A" annexed hereto, hereinafter referred to as the Property;
WHEREAS, the Property is situated on lands within the jurisdiction of the Board of Trustees of the
Town of Southold (hereinafter the "Trustees") pursuant to Chapter 275 of the Town Code of the Town of
Southold or its successor, and various activities conducted upon the property may thus be subject to the
regulation and approval of the Trustees prior to being conducted;
WHEREAS, the DECLARANTS therefore made application to the Trustees for a permit pursuant to the
Wetlands Law of the Town of Southold to undertake certain regulated activities; and
WHEREAS, as a condition of the granting of a Wetlands Permit to undertake such regulated activities,
the Trustees required that a fifteen-foot wide vegetated "non-turf buffer" be established landward of the tidal
wetlands boundary, wherein the most inner 10' is to be planted with native vegetation and most outer 5' allowed
to revegetate passively,
NOW, THEREFORE,the DECLARANTS do hereby covenant and agree as follows:
1) Upon the substantial completion of the aforementioned permitted activities there shall be
established and subsequently maintained landward of the tidal wetlands boundary on the subject
premises a fifteen-foot wide vegetated "non-turf buffer" as defined by Chapter 275 of the Town

Code, wherein the most inner 10' is to be planted with native vegetation and most outer 5'
allowed to revegetate passively; and
2) These covenants shall run with the land and shall be binding on the DECLARANTS, their heirs,
assigns, purchasers, or successors in interest and may be modified only upon resolution of the
Board of Trustees.

BEGINNING at a point on the easterly side of Inlet Lane where the same is intersected by the southerly

southerly as measured along the easterly side of Inlet Lane from the corner formed by the intersection of the

I have reviewed the Declaration of Covenants draft you submitted to this office with
respect to the above referenced application concerning the fifteen foot wide non turf
buffer to be established and subsequently maintained landward of the tidal wetlands
boundary.
The covenants and restrictions document must be executed and filed with the County
pursuant to §275-10(K) of the Southold Town Code. Please note that a copy of this
document or, in the alternative,a sworn statement attesting to the filing is to be presented
