SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated December 30, 2013 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The property is a non-conforming 20,000 square foot developed lot located in an R-80 district. The property has 100 feet of frontage on cedar beach road. The North side of the property is 200 feet long. The East side of the property is 100 feet long, and the South side of the property is 200 feet long. There is a stockade fence along the South line of the property. There is an existing dwelling on the property which covers1248 square feet. The dwelling's septic system is located towards the Southeast corner of the property. The Southeast section of the property has irregular terrain and slopes from an elevation of 3 feet up to an elevation of 10 feet. All is shown on a survey by Kenneth M. Woychuk L.L.S. dated December 20, 2013 and submitted to the Zoning Board of Appeals on February 27,2014. BASIS OF APPLICATION: Request for Variance from Article III Section 280-15 and the Building Inspector's September 24, 2013 Notice of Disapproval based on an application for building permit for an accessory in-ground swimming pool and shed, at; 1)proposed location other than the code required rear yard. RELIEF REQUESTED: The applicant requests a variances to place a swimming pool and a shed in a side yard where the code requires that accessory swimming pools and sheds be placed in a rear yard location. AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the code. The applicant on February 27, 2014 submitted a revised application showing a smaller 12 ft. wide by 12 ft. long by 12 ft. high shed located in the front yard in place of the proposed 16 ft. wide by 16 ft. long-by 16 ft. high shed, and an in ground pool in the side yard. 1 Page 2 of 3—March 20,2014 ZBA#6710—Belkin SCTM#1000-89-24 ADDITIONAL INFORMATION: During the hearing testimony was taken that that shed and swimming pool could not be located in the rear yard as required by code because of the location of the existing septic system and because the terrain has a steep slope which is too steep for the construction of a shed and swimming pool. On February 27, 2014 the applicant's agent/architect submitted an updated survey showing the contour intervals and septic location, as requested by the Board of Appeals, confirming same. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held public hearings on this application on February 6`h and March 6,2014 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the amended application will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single family homes several of which have pools. The Zoning Board of Appeals has previously granted relief for swimming pools to be in other than the rear yard locations in this neighborhood. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The rear yard of the property has a steep slope making it difficult to construct a swimming pool and a shed in this location. The existing septic system is also located in the existing rear yard and its placement does not leave room for the applicant to construct a swimming pool and a shed. 3. Town Law 267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 100% relief from the code. However, the terrain and the septic system do not allow for the placement of the pool and the shed in a conforming location. Further, the applicant does not have a neighbor on the North side of the house, who would be most affected by the swimming pool in the side yard. The proposed shed will be located behind several trees leaking it difficult to see from the road and therefore will have a minimal effect on the character of the neighborhood. 4. Town Law U67-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of amended relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a swimming pool and a shed while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes, seconded by Member Goehringer, and duly carried,to GRANT AMENDED RELIEF, as follows; according to the survey by Kenneth M. Woychuk, L.L.S. dated December 20, 2013 and submitted to the Zoning Board of Appeals on February 27, 2014 and the shed plan and elevation by Meryl Kramer Architect submitted to the Zoning Board of Appeals on February 27, 2014. Subject to the following conditions: 1. Pool mechanicals shall be placed is a sound deadening enclosure. 2. Drywell for pool de-watering shall be installed. Page 3 of 3—March 20,2014 ZBA#6710—Belkin SCTM#1000-89-24 That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Vote of the Board.• Ayes: Members Weisman (Chairperson), Schneider, Horning, Goehringer, Dantes. This Resolution was duly adopted(5-0). I PROPERTY FACTS/DESCRIPTION: The applicants' property consists of 52,682 square feet and is improved! with a single-family dwelling and accessory wood shed, shown on the 07/07/2004 survey prepared by Destin G. Graf,L.S. BASIS OF APPLICATION: Zoning Code Chapter 280 (formerly Chapter.100), Sections 280-30A.3 and 280-1 242 (ZBA Interpretation No. 5039 rendered 1/2/2002 in the Walz Application), based on the Building] Inspector's February 6, 2006 Notice of Disapproval concerning a proposed addition. FINDINGS OF FACT i The Zoning Board of Appeals held a public hearing on this application on May 25,2006 and June 22, 2006, at; which time written and oral evidence were, presented. Based upon all testimony, documentation, personal i inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and! relevant: AREA VARIANCE RELIEF REQUESTED: The applicants wish to construct a new 24' by 42' 1%story frame garage 13.3 feet from the right-of-way easement boundary, and 38.3+/-feet between the new extension and the applicant's northerly property line. The new addition will be an increase in the degree of nonconformity; when located less than 50 feet. f REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personall inspections, the Board makes the following findings: i 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The new proposed attached garage and second story addition are in j keeping with the scale, size and character of other nearby houses. The applicant's house is set much closer to the right-of-way than the neighbor's house to the east and will therefore have no visual impact on their I' property. The lot to the west is wooded. There are no objections in the appeal file, and none were voiced at the final public hearing. Nine letters of support for the-applicants' requested variance were submitted from owners of properties in the neighborhood. I Page 2—June 29,zoos REIV ZB File No.5886—Richard and K6nrerry FEB CTM Parcel 89-3-11.5 014 BOARD OF APPEALS 2. The benefit sought by the applicants cannot be achieved by some method, feasible for the applicant to pursue, other than the relief requested. The applicants' side yards are too narrow for any reasonably sized addition, and the rear yard contains a septic system and access to the basement through Bilko doors that make addition construction expensive and difficult. 3. The variance granted herein is not substantial. The new proposed attached garage addition will require a substantial variance for a front yard setback of 13.3' from the right-of-way instead of the required 50 feet' However, the actual road is another 25 feet from the property boundary so the total setback would be 38.3 feet. The applicants are the last homeowners along this small right-of-way, so there will be no impact on other, users. 4. The alleged difficulty has been self-created. The applicants are choosing to construct an attached garage addition in the front yard as the most architecturally sensible and cost effective location, although there are more expensive but legally allowable options for an accessory garage in the rear yard. 5. No evidence has been submitted to suggest that the proposed additions will have an adverse impact onlz physical or environmental conditions in the neighborhood. The rear yard of the applicants' property fronts ort wetlands off Cedar Beach. Less environmental impact will occur by locating the proposed garage addition it the front yard. i 6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicants to enjoy the benefit of an enlarged second story addition on the principal dwelling and a new 1'/ story attached; garage addition, while preserving and protecting the character of the neighborhood and the health, safety and; welfare of the community. ! RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under; New York Town Law 267-B,motion was offered by Member Oliva, seconded by Member Goehringer, and duly carried,to t GRANT the variance as applied for, as shown on the site map prepared by the applicant and elevation♦ diagram date stamped by the ZBA April 7,2006. Any deviation from the variance given such as extensions,or demolitions which are not shown on the applicant's diagrams' or survey site maps, are not authorized under this application when involving nonconformWes under the zoning code. This] action does not authorize or condone any current or future use, setback or other feature of the subject property that may; violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Vote of the Board: Ayes: Members Oliva (Chairwoman), Goehringer, Dinizio, Simon. (Absent was: Member) Weisman.) This Resolution was duly ad (4-0). . Board finds that applicant requests permission to construct -swimming pool in front yard area at Bayview Road and Cedar Beach Road, Southold. The findings of the Board are 'that applicant has an unusual situation because his house is located so close to Bayview Road, and because of the topography of the area. The Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be 'shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance.. Edson, Esq. a/c Gerald H.. & Jo Ann Osmond, Bayview Avenue & 'Cedar Beach Road, Southold, be 'GRANTED permission to construct swimming i pool in front yard area, as applied for, and that applicant be GRANTED permission to erect a 6 foot fence in the front yard area as the Board finds that -it seems to be required in this location. Permission as granted is subject to the following conditions: 1. That the fence surrounding the pool shall be least 10 .feet .from the property line 'of Bayview Road. i 2. The pool shall be located in the southwesterly. corner of the property. 3. That applicant be permitted to erect a 6 foot .fence in the front yard area. j vote of the Board: Ayes:- Messrs:• Gillispie, Bergen, .
