Meeting of October 4, 1976

A regular meeting of the- Board of Southold Town Trustees was
held at 7 :30 P.M., Monday, October 4, 1976at the townboard-
meeting room, Superv. sor's Office, 16- South Street, Greenport,
New York, with the following present:

Application of Thomas S. Cottrell, Pine Tree Road; Cutchogue, N.Y.
for offshore mooring at Little Creek, Cutchogue was further tabled
V/for clarification of dimensions. Mr. Cottrell has not contacted
Mr. Philip Horton,' or sent any -additional ,in ormation since the
last meeting of- September 13, : 1976.
Application of Robert Isles, Private Road off Main Bayview Road,
Southold, N.Y. for offshore mooring at Corey Creek, Southold was
further tabled: The Board has -inspected the proposed site for this
✓mooring and finds. -that-- this- is- a very-congested- area and there is
no r(Dom for this mooring -as' proposed. '-Mr. - -Isles -will 'be advised
to contact the Board before the next meeting to' work out a suitable
location -for, this- mooring.

On motion by Mr. Bird, seconded by Mr. Hataier, it was
RESOLVED that MARIO J. FINORA, East Legion Avenue, Mattituck, N.Y.
be GRANTED permission to place ramp, dock, & float at James Creek,
/Mattituck, N.Y. , all in accordance with the detailed specifications
as presented in the originating application. This property was
inspected by Mr. Bird on August 17., l976� Fee $20.90

RESOLPED. that the application of Lorraine Dunhuber,, for deck and
dock at East Creek off Fleetwood Road.& ;-Betts Ave.-,-, Cutchogue
e transmitted to the Southold.. Town Building Department. It is
the opinion of the Trustees that this application does not come
under their. jurisdiction. since i,t does, not..;encrogch •.on -town waters. i
It does, however., ,encroach -on.. .town wetlands, therefore it will -
- be transmitted to the proper authority.

until the next meeting. This application was <received..,.too_ late -to
be put ,on the ,agenda.., Applicants will- be advised that.,they must
also' secure permits ' from the New York State Department.- of .Environmental
Conservation and from the Corps of Army Engineers.
Chairman Goldsmith reported that he received a call from Building .
Inspector Howard Terry -regarding activity in CoreY Creek at the
int next to the Hallock property. The Chairman read letter of
September 28, 197.6,_.sent .to Henry- .Smith by Howard Terry. Mr. Smith
has installed' a number of docks without a permit from the Trustees
and he has also violated the wetlands ordinance. Mr. Smith will be
submitting applications-for,-,permits to both the Trustees and the
Town Board.
Discussion was held regarding the town moorings at Narrow River,
Orient. It was decided that this property, which is rented from
H.M. Demarest & Sons, should be surveyed and markers placed on
each side of the boundaries to determine where ordinary highwater
mark meets the boundaries. After this is done , the Board can then
decide how many feet should be on each side before the mooring stakes
begin.
On motion by Mr. Goldsmith, seconded by Mr. Robertson, it was
RESOLVED that the Board of Southold Town Trustees petition the Southold
Town Board to approve their request for survey and placement of monuments
von property which the town leases from H-.M. Demarest ;& Sons at Narrow
River, Orient.

It was brought to the Board's attention by Paul Stoutenburgh that a ,
very poor job of dredging has been done at Fishermans Beach,. Cutchogue..
It seems that the County dredged the area and deposited tld!. fill in one
va' rea, the state did some work in the area, but the fill was again
moved"tafter these two agencies completed their work. The Trustees
-had no knowledge of the situation and did not authorize anyone to
move the fill after the county and state left the area.
Letter received from Town Attorney Robert Tasker advising the
Trustees that after examining the law creating the Board of Trustees
Chapter 615 of the Laws,,-.of 1893) he finds that since the Board is
composed of five members, three members present would constitute a
majority and would be sufficient to transact business of the Board.
On motion by Mr. Horton seconded by Mr. Bird, it was
RESOLVED-that the minutes of the Board ,of Southold Town Trustees
dated September 13, 1976 be approved as submitted.
