P.M. , Monday, July 12, 19-76, at the _Town Board- meeting room, 16 South Street„:;Greenport, New York, with the following present: Alvah B. Goldsmith, Chairman Douglas M.. Robertson Philip G. . Applicant is .presently negotiating with his attorney to have the righ:t'-of-way re-routed so that they can move the house back. Application of Leonard Walters. for offshore mooring at East Creek, �Cutchogue ,was taken off the agenda due to failure of the applicant to submit further information. He will have tore-apply, but there will notebe an additional fee. On motion by Mr. Horton, seconded by Mr. Bird, it was RESOLVED that JOHN PRIZEMAN, Park Avenue, Mattituck, N.Y. be- GRANTED permission to place offshore mooring (150 lb. mushroom) Zat Deep Hole Creek, at the foot of Park Avenue, Mattituck, N.Y. all in accordance -with the detailed specifications as presented in the originating application., Fee paid $5.00 Vote of the Board: Ayes: Mr. Goldsmith, Mr. Robertson, Mr. Horton, Mr. Bird, Mr. .Hataier. Request by John Prizeman to moor. boat at dock, on -weekonds, was not acted upon. This is not a town dock, therefore, the Trustees have no jurisdiction. I p. 216 Thomas & Arthur O'Neill appeared before the Board of Trustees regarding their properties at Goose Creek off Smith Drive South, - Southold. They sent a letter to the Town Board on April 15, 1976 complaining u.f tresspassers clamming on their properties. They, presented the Trustees with Surveys, maps, and deeds of their properties and requested the Trustees to give them a letter stating that they have no jurisdiction. After inspection of same; the Trustees were of_ the opinion that this is private property and , that they have no jurisdiction over it. The following letter was sent to the O'Neills: Gentlemen: The Board of Trustees of the Town of Southold have examined the survey, maps, and deeds of your properties in the Goose Creek area. In our opinion, the areas covered by these deeds indicate your ownership as of the dates shown. This ownership includes the marshland and the bottoms of the man-made canals included therein. Therefore, in the opinion of the Trustees, the Town of Southold does not have ownership of these lands and lands under water and consequently does not ha$re jurisdiction over .them:. We suggest that you. stake out the boundaries of your marsh lands and canals that- are -covered by these deeds -in order that your rights thereto"may be known ..by anyone concerned. . Yours truly, Alvah B. Goldsmith, Chairman Mrs. Carol Ruroede appeared before the Trustees to request advice on a problem which they are having at Pipes Cove, Greenport. It seems her neighbor has built' a very. long jetty out into the water 'which is causing a hardship to both neighbors on either side of him. The Trustees advised her that they have no juriidiction in this area and suggested they she contact the Army Corps of Engineers. A lengthly discussion was held by the Trustees on the Simonsen property at Mud Creek, Cutchogue. The Chairman will discuss the Matter with the Simonsens in an effort to get their cooperation in rectifying the situation. Discussion was held regarding the town moorings at Sterling Creek. It has been brought to our attention by Bay Constable Januick that only a few of the moorings have boats on them. Some of the persons holding the permits renew them each year, but have never moored a boat there or even owned a boat. Also, some of the permit holders are renting the space to other persons. The Trustees are of the opnion that the town moorings should be made available to persons who .own boats and want to moor them there. There is a lengthly waiting list for available space. The secretary will have Mr. Januick make a list of the boats presently being moored at Sterling Creek. Letters will be sent out to the permit holders who do not have boats moored or who are renting their mooring to other persons advising them that their permits will be cancelled. p. 217 The Board members were advised that an "Information Meeting" will be held by the DEC on the proposed "Tidal Wetlands Act" at the , County Center, Riverhead on Thursday, July 15, 1976 at 2:00 P.M. and 7:00 P.M. Mr. Goldsmith-, Mr. Robertson, and Mr. Bird plan to attend this meeting. Copy of petition sent to the .Southold Town. Board by the Southold Town Baymens Association was received and .reviewed by the Board. They are requesting that the ordinance be amended to include f mariculture uses in the "Al' Residential-Agricultural District. Mr. Horton suggested that they contact the L.I. Farm Bureau. West Sayville applied for and received agricultural status with the state to cover a similar situation. On motion by Mr. Hataier, seconcded by Mr... Bird,. it was RESOLVED that the minutes of the Board of Southold Town Trustees dated June 7, 1976 be approved as 'submitted.
