BOARD OF SOUTHOLD TOWN TRUSTEES
Meeting. of March 8, 1976
A regular meeting of the Board of Southold Town Trustees was.
held at 7: 30 P.M. , Monday, March 8, 1976, at the Town Board
meeting room, 16 South Street, Greenport, ' New York, with the
following present:
Alvah B. Goldsmith, Chairman
Douglas .M. Robertson '
Philip G. Horton
Joseph Hataier
Betty Neville, Secretary
Absent: George C. Bird
Also present: William .Terry & ,Paul Stoutenberg-North Fork Environmental
Council; Robert Rinklin-L.I. Traveler; Ronnie Wacker-Suffolk Times;
Lawrence Tuthill.
On motion by Mr. Robertson, seconded by Mr. Horton, it was
RESOLVED that John Lowery, 650 `.Oak Street, Southold, N.Y. be
/ GRANTED permission to construct dock 40'x4' , ramp 41x4' , and
J float 121x8' at Goose Creek, directly in front of his property
off Oak Street, Southold, N.Y. , all in accordance with the
detailed specifications as presented in the originating application.
Fee $27.20
Vote of the Board: Ayes: Mr. Goldsmith, Mr. Robertson, Mr. Horton,
Mr. Hataier.
On motion of Mr. Robertson, seconded by Mr. Hataier, it was
RESOLVED that the Board of Southold Town Trustees take no action
on the application of A.B. Rosenberg for proposed maintenance dredging
at Sterling Creek, Greenport until. such time as the Southold Town
/Board of Appeals determines exactly what legal rights he has under the
operation of this non-conforming marina.
The Board is of the opinion that they do not have enough facts to
make an equitable and justifiable decision at . this time. They strongly
suggest that Mr. Rosenberg take this matter up with the Board of Appeals
so that his legal rights can be cleared.
Vote of the Board: Mr. Robertson, Mr. Horton, Mr. Hataier.
Mr. Goldsmith abstained. from voting.
On motion 'of Mr. Goldsmith, seconded by Mr. Horton, it was
RESOLVED that the application of John J. Hughes, Jr. , 575 Dawn
Drive, P.O. Box .377, East Marion, N.Y. be TABLED for further
investigation and inspection of the proper-Ty-737a etermine . and
verify exact location and distances.
Vote of the Board: . Ayes: Mr. Goldsmith, Mr. Robertson, Mr. Horton,
Mr. Hataier. Mr. Hughes to confer with Mr. Koch and Mr. Guiderman
of the Cleaves Point Property Owners Association regarding the
location of the mooring.

On motion of Mr. Robertson, seconded by Mr. Hataier, it was
RESOLVED that the application of Noel J. Lutkowski, Inlet Lane,
Greenport, N.Y. be TABLED for further investigation and inspection
of the property to determine and verify exact location and distances.
Dote of the Board: Ayes: Mr. Goldsmith, Mr. Robertson, Mr. Horton,
�Mr. Hataier. Mr. Lutkowski to confer with Mr. Koch and Mr. Guiderman
of the Cleaves Point Property Owners Association regarding the
location of the mooring.
On motion by Mr. Robertson, seconded by Mr. Horton, it was
RESOLVED that Philip R. Marriner, Box 449 Sailor' s Needle Road,
Mattituck, N.Y. be GRANTED permission to place offshore mushroom
mooring (150 lb. w 20ft. 2" chain) in James Creek directly in
,/front of his property at Sailor' s Needle Road, Mattituck, N.Y. ,
all in accordance with the detailed specifications as presented
in the originating application. Fee $5.00
Vote of the Boara: Ayes: Mr. Goldsmith, Mr. Robertson, Mr. Horton,
Mr. Hataier.
On motion by Mr. Horton, seconded by Mr. Robertson, it was
RESOLVED that Joseph C. Cornell, Waterview Drive, Southold, N.Y.
be GRANTED permission to construct catwalk 30'x3' and float 181x5 '
,!' directly in front of his property at Goose Creek, off Waterview
Drive, Southold, N.Y. , all in accordance with the detailed specifications
as presented in the originating application;' Fee $18 .00
Vote of the Board: Ayes: Mr. Goldsmith, Mr. Robertson, Mr. Horton,
Mr. Hataier.
On motion by Mr. Horton, seconded by Mr. Hataier, it was
RESOLVED that the application of Leonard Walters, 2900 Stillwater
Avenue, Cutchogue, N.Y. be TABLED for receipt of further information
and better measurements.
✓Vote of the Board: Ayes: Mr. Goldsmith, Mr. Robertson, Mr. Horton,
Mr. Hataier.
The Trustees are concerned about the weight and scope of this mooring
in this particular area because of the silt over hard clay bottom.
The secretary was instructed to send a letter to Mr. Leonard requesting
more information and better measurements,.
On motion of Mr. Robertson, seconded by Mr. Hataier, -it was
RESOLVED that James Castagna, Waterview Drive, Southol:di, N.Y.
be GRANTED permission for installation of retaining wall at
Goose Creek, directly in fromt of his property off Waterview
v/�Drive, Southold, N.Y. , all in accordance with the -,detailed
specifications as presented in the originating application.
Fee $5.00
Vote of the Board: Ayes: Mr. Goldsmith, Mr. Robertson, Mr. Horton,
Mr. , Hataier.

be GRANTED permission---for maintenance dred�iri to -keep existing
channel open at Goose Creek, directly in front of his aproperty
off Waterview Drive, Southold, N.Y. ; all in accordancei-with the
detailed specifications as presented in the originating application.

Mr. William F. Johnston appeared before the Trustees in regard
to his. applications for:- 1m' bulkheading 2. . dredging and filling
at Haywater Cove, Fishermans Beach, Cutchogue, N.Y. Lawrence
Tuthill represented Mr. Johnston as the engineer for this project.
✓Mrs. Nicol representing the. Fleets Neck Prop. Owners Assoc. and
Paul Stoutenberg representing the North Fork Environmental Council
questioned the purposes of these applications. A lengthly
discussion was held regarding the titles and boundaries of this
property.
On motion of Mr. Robertson, seconded by Mr. Horton, it was
RESOLVED that the application for bulkheading submitted by
William F. ' Johnston be approved in "principle only" subject
Ito the submission of- a meets and bounds description of the
property and a proposal for a quit claim deed.
Vote of the Board: - Ayes: Mr: Goldsmith; Mr. Robertson, Mr. Horton,
Mr. Hataier.
Mr. Goldsmith reported that he received a phone call from Mr.
George S. Case, President of the Nassau Point Property Owners
Association regarding the blockage of the channel at Haywater
✓/Cove. The channel was blocked due to a "let go" of a bulkhead
which was built on the Cornwell property by Dr. Thos. Samuels:
It was suggested that Bill Januick be contacted and asked to
stake out the channel. Mr. Januick to contact Mr. Case to get
the names of the property owners in the area to work with him
marking the channel and to investigate what; the best approach
would be.
Mr. Robertson reported that a new type of dredge is being tried
out for eeling purposes. It consists of lohgitu"dinal-horizontal
me"tal rods with spears on the end, the weight of the dredge
carries it down into the mud. This dredge greatly disturbs the
bottom' of the creek. It is a cause for great concern and should
be looked into.
The Board was presented with, a plan for proposed marina of Capt.
Howard Peterson, W/S Mattituck Inlet, -off Naugles Drive, Mattituck,
✓ N.Y. transmitted to them by the Planning Board and questioning if
there were ever any permits for pilings -dssued on this property.
The Secretary was instructed to check -the records on this matter.
The Board was presentdd with letter from the Suffolk County Dept®'
of Public .Works-Carl Eisenschm:eid=inquiring if it is necessary
Afor the County to secure permits for dredging town waters. The
Board stated "that they must secure -permits for each location and
send the same two . maps to us that they send to the'-Army Engineers.
The Board requested the secretary to secure a list .of the approved
dredging projects.
On motion of Mr. Horton, seconded by Mr. Goldsmith, it was

RESOLVED that the next regular meeting of the Board of Southold
Trustees be held at 7: 30 P.M. , Monday, April 5, 1976, at
the Town Board meeting room, 16 . South Street, .Greenport, N.Y.
Vote of the Board: Ayes: Mr. Goldsmith, Mr. Robertson, Mr. Hataier,
Mr. Horton.
Meeting adjourned at 9:45 P.M.
