N.Y._. be GRANTED permission .to place offshore mooring__ (5,0 lb. mushroom). - mat Little Creek, o.ff R.O.W. off . Pine Tree , Road, Cutchogue, N.Y. , subject to applicant working_ out_ sui.table _dimensions and location with Philip Hor,ton_,: ouf Cutchogue representative. . Application of Henry Smith for-approval -of exi-stirig docks a�hd dredging at "Nunnakoma Waters", Southold was discussed at length. Rudolph Bruer, Attorney a/c Henry Smith explained that the ;Southold Town Planning Board granted final approval to his subdivision map - of Nunnakoma -Waters back' -in the- -1960 ' s., The boat basin was shown on that, subdivision map) and 'Mr. Smith assumed `that the approval I-of "the subdivision-,map also included '-approval for the boat basin. - Mr. /Smith stated that 'he di&n' ot realize that he needed any further approval or permits from anyone. Mr. Smith 'alao installed a `drain- age ring at the end I of the road to-replace= th-e d'rainage '-basin which washed out after the hurricane. - This matter is presently-before' the Town Board; Mr. Smith was required to apply for a wetlands permit. Chairman _Goldsmith questioned 'whether the- 'highwater mark as shown on the, survey is correct.- Mr.` Smith, pointed out that all ' the area below the- highwater- mark was - dredged out some time ago and that- It was privately owned by himself. Mr.° Robertson ques- tioned whether this will`be restricte& to lot owners in his subdi- vision. Mr. Smith answered yes `that it is- only for lot owners Iin his subdivision-. 'Chairman Goldsmith s' tated"'tha't he could ' see no objections as far as the Town Trustees are concerned. The wetlands application 6f Henry Smith transmitted to the Trustees for their p. 230 recommendation '`&,.o the Town Board will be discussed later. Mr. Hataier questioned who -put the oil on the road..- Franklin Bear, President 'of` the Nunnakoma Waters Association answered that there is no oil on the road. He said that there has been some black top or cold patch repairing done there, but there was no oil spread on the road. Mr. Bear stated that the property owners built their docks with the understanding"that they Ineeded no permits; which they were told by Mr'. Smith. Chairman, Goldsmith stated that the Trustees will have t,o concern themselves with what was there before " the excavation., -Mr. Bear presented a deed' which stated that the property owners fhad' a right to the commoners beach together with a right to ingress -and egress to waters as: shown oft the filed map.' Mr. Goldsmith asked for a list of the owners_ of the docks. Mr. Bear labeled the owners of the dock's on the survey map. Paul Stoutenburgh of the NFEC stated that problems in develop- ments occur because people do not concern themselves with the -environ= ment. He stated that developers should not- be allowed `to 'run' the drainage basins into the creeks. He cited the Town of I'sllip as an example - every. creek in the town is now contaminated due to drainage run-off. He stated that this type' of`appliaation should be examined ' very carefully before any determination is. made.. This application was postponed 'at thistime for further discussion by the 'Board. On motion of Mr. Goldsmith, seconded by Mr. Bird,, it was RESOLVED that 'Catherine Fabry, 3390 Deep_ Hole Drive, Mattituck,' -N.Y,. ( ' be GRANTED permission to ' place -catwalk, ramp, and floating dockat Deep Hole `Creek, directly in front of her property at Deep Hole Drive, Mattituck,`' N.Y. , all in accordance with -the detailed specifications . as presented `iri 'the brig inating application. Fee paid $15. 90 his permit shall include no permission for the filling of land. _ Vote of the 'Board: "Ayes Mr. Goldsmith, Mr. Robertson, Mr. Horton, Mr. Bird, Mr. Hataier. Letter to be sent with permit stating that the Board recommends a retaining wall tolprevent erosion of the property. ' 'They' suggest that you 'oonta"ct the Building Department' as to the 'advantages of installing a retaining wall to"prevent further erosion of the additional fill. On motion of Mt., Goldsmith, seconded "by Mr. ' Robertson,, it was RESOLVED that the Board of Southold- Town Trustees favorably recommends the approval of Wetland Application No. 26 by Henry C. Smith for permission to install drainage ring at Wampum- Way', ,✓Corey Creek, Southold, N.Y. with the. following recommendation:- We suggest- that 'you confer "with the Highway Superintendent and':' Building Inspector as to the adequacy of the existing drainage basin to determine whether it is adequate for the amount of drainage that bxists to prevent run-off' into the southwest branch of Corey Creek. If the present drainage basin is not adequate; then it should be suggested to the owner that an additional basin be installed. If this is necessary, the p. 231 additional basin should be installed at the proper- location and be of the proper size so as to. prevent run-off into Corey .Creek. Vote of 'the Board: - Ayes.: Mr. Goldsmith, Mr. Robertson, _ Mr. Horton, Mr. Bird, _Mr.,Hataier. Regarding tlie ,existing docks, the Trustees decided that the. permits should be• .applied. for by the individual- dock owners,. rather than by Henry_,Smith as a blanket application. The Board instructed that letters be sent. to,.the individual dock, .owners stating, .that_.the_ Trustees;,ha.ve no.objections to_. the existing, docks and existing boat_ basin, .providing that they be restricted .to, the owne,rs_,ofj.the property in, "Nunnakoma _Waters".sand that the, owners of_,_the.- docks secure permits for_ them_ individually. ;„_ Rob the • DemarestnpropertyaathNarr.ow. Both of the above dispositions. took place ,at ,the .September 13, .1976 meeting. On motion, of Mr.. Bird, ._seconded by. Mr. Robertson, = it was RESOLVED that the minutes of the Board_of .
