BOARD OF SOUTHOLD TOWN TRUSTEES
Meeting of December 6, 1976
A regular meeting of the Board of Southold Town Trustees was held
at 7 :30 P.M. , Monday, December -.6, 1976 at the town board meeting
room,- Supervisor's Office, 16 South Street, Greenport, New York,
with the following present:
Alvah B. Goldsmith, Chairman
Douglas M. Robertson
Philip G. Horton
Joseph Hataier
Betty Neville, Secretary
Absent: George Bird
Also present: Orville Terry & Paul Stoutenburgh-North Fork
Environmental Council.
On motion of Mr. Horton, seconded by Mr. Robertson, it was
RESOLVED that w„nnPwPta Pond Association Nassau Point, Cutchogue,
�-.Y. be GRANTED permission for maintenance dredging to restore
" channel at Wunneweta Pond, Cutchogue, N.Y.,. all in accordance
with the detailed specifications as presented in the originating
application. Fee $5.00. Spoil to be placed on upland property
at northerly end of the channel.
Vote of the Board: Ayes: Mr. Goldsmith, Mr. Robertson, Mr. Horton,
Mr. Hataier.
On motion of Mr. Hataier, seconded by Mr. Horton, it was
r/"RESOLVED that Gerard Galliari. _ Pine Tree Road, Cutchogue, New York,
N.Y. be (,RANTED permission to construct ramp and floating dock at

at Little Creek, directly in front of his property at Pine Tree
Road, Cutchogue, New York, all in accordance with the detailed
specifications as presented in the originating application.
Fee $27.20 .

On motion of Mr. Goldsmith, seconded by Mr. Robertson, it was
RESOLVED that _Harriet Spillman, Nest Creek Avenue, Cutchogue,
N.Y. be GRANTED permission to construct walkway and floating
dock at Little Creek, directly in front of her property at
West Creek Avenue, Cutchogue, N.Y., all in accordance with
,the detailed specifications as presented in the originating
application, subject to obtaining wetlands permit from the
Southold Town Board, and permit from the New York State
Department of Environmental Conservation (if required. )
Fee $10.10
Vote of the Board: Ayes : Mr. Goldsmith, Mr. Robertson, Mr. Horton,
Mr. Hataier.
Mr. Warren Hardy and a number of other property owners who
live on or near Wunneweta Pond, Nassau Point, Cutchogue
appeared before the Board to protest the application of
George Quigley for offshore mooring at Wunneweta Pond,
Cutchogue. Mr. Hardy submitted a statement of protest for
the files. He stated that this mooring has been there since
",August. It swings back and forth into Mr. Kohns ' bulkhead
and into the channel which is only 10-12 feet in width. He
also stated that the R.O.W. over which Mr. Quigley is gaining
access to the mooring is to be used only for embarking and
discharging passengers, as specifically stated in their deeds.
Mr. Hardy stated that there are other moorings at Horseshoe
Cove which would be safer and more convenient. He does not
think that the owners realize that they are in a very hazardous
area.
On motion of Mr. Horton, seconded by by Hataier, it was
RESOLVED that- George Quigley, 4505 Vanston Road, Cutchogue,
N.Y. be DENIED permission to place _nffshnre mooring ate
Wunneweta Pon Cutchogue, N.Y. There is no room for any
ooring in this channel becuase of the very restrictive width
and depth of the channel. Any mooring would be considered an
obstruction to navigation. This mooring must be removed.
Fee paid $5.00

Chairman Goldsmith reported that the Trustees were served with
a summons in reference,. to their jurisdiction at .Sterling Creek.
Mr. Goldsmith ,p'r_otested .;their determination, _although the Trustees
- id not think that th' had a . chance of- reversin.a the decision.
The public -interest has..no,t'.been served,- in this matter, all of
the facts . come out.._. The ,ease;. came up.A. week, ago, but..
was postponed. It has since been heard and decision rendered.

Gentlemen-
The Board of Southold Town Trustees-'have examined the Wetland
Application �No.! 27 subtnitted�`by 2,eo''Kwasnesk-i for pe-rmi�ss-ion _
to construct turn-around at Sleepy Hollow Lane as approved by
the Southold Town Planning Board and filed in the Suffolk
P. 236
County Clerk's Office.
Although this matter does not come under our jurisdiction, we
feel that a wetland should not be filled for a turn-around on
a road. However, the damage is done and it cannot be corrected.
The fault is not with the owner of the property, but it is with
the boards who issued the approval for this.
We feel that there has been an error on -the putt of the Town;
having approved a plan which permits the highway and turn-
around to cover a wetland area. The same effect could have
been established by having the turn-around stop at the edge
of the meadow rather than proceed to the highwater mark.

It was ;-r�;eported that William Johnston,, Fishermans Beach, Cutchogue
is moving the main house but he has an O.K. to leave the guest house.
,Ie got approval from the Board of Appeals to do this. The Trustees
question this and feel that the guest house should be moved back
also. They feel that this is. all on filled land, which is town
property and if this is so, then it should be moved back.

RESOLVED that the minutes of the Board of Southold Town Trustees
dated November 1, 1976, be approved as submitted.

RESOLVED that the next regular meeting of the Board of Southold
Town' Trustees be held at 7 :30 P.M. , Tuesday, January 4, 1977,
at the town board meeting room, Supervisor's Office, 16 South
Street, Greenport, New York.
