BOARD OF SOUTHOLD TOWN TRUSTEES
Meeting of October .3, 1972 `
A special..meeting of the Board of Southold Town. Trustees -was ,
held at 7 :30 A.M. , Tuesday; October 3 , 1972 at the Town Clerk' s
. Office, :Main .Rodgl, °Southold, New -York,,, --with -the following present:
Alvah `B. Goldsmith, Chairman, Douglas M. Robertson,
George •A. - Simpson, Philip,-G. Horton, .Rudolph Johnson,
-and Judith T. , Boken, ;Secretary.
On motion of Mr. Robertson, seconded by Mr.. Simpson;
WHEREAS; an application . dated-September 23 , '1971, was made by
Henry:F. Praus , contract vendee, to Howard Terry, Building.
Inspector., Town of Southold, .'to secure permission - to -place fill -
on Lot 29 and the westerly .25. feet .of: Lot 30. .on map entitled..- -
"Subdivision Map, Peconic Bay Properties, Inc. , _ surveyed February
6, 1931, by Otto W. Van Tuyl, Surveyor" known as "Fisherman's
Beach.; " and
WHEREAS, said application was deniedby the --Building Inspector
who referred the same to the. Town Board of-. Southold Town on the
grounds that said premises constituted wetlands it,Southold Town;
and
WHEREAS, the Southold Town Board asked .the Board- of - Town Trustees
to review the application and the effect, :if. any, on --the. wetlands
and tidal waters 'of the, Town; and
WHEREAS, the ..Board.iof Town -_Trustees; °by__letter dated 'May 3,, 19,72;
to the Town Board," replied as follows
Gentlemen:
The Southold Town Board of Town Trustees has
reviewed the application of. Henry F.,_ _Praus for a
wetlands permit, and ' investigated the site a-t ;Nassau
Point;,-.Lot *29-and part-:of 30:lon map-_'of ,".Peconic?Bay .,
Properties Inc::",, fronting:-on. Haywa ter s:.Cove,
:-.Cutchogue;: New-York.) r-
The Board of Town Trustees does not believe
the issuance,:of-°!a,.wetlands�,permit to Henry_-F. _Prads
will substantially-,adversely affect any portion of
Section 280 of the •,Wetland Ordinance.
It_,is the •recommendation of-the Board,,of Town
Trustees that the application of Henry F. Praus for
a wetland permit be approved.

WHEREAS, the Town Board of Southold Town has denied the afore-
said application; and
WHEREAS, by a subsequent survey dated August 8, 1972, by Young
& Young, it has been establ stied that"I.part of this parcel is
below ordinary highwater mark and under the jurisdiction of
this Board; and
WHEREAS, application has now been made by Wilbur Baldtip, owner
and contract vendor of"the property, .for a--grant from this
Board; and
WHEREAS, this property along with others on "Fisherman' s Beach"
has been assessed and taxes paid since the filing of this map
by the various owners, and the action of this Board over the
years has been to approve any reasonable request for filling,
bulkheading :and-. dredging; :as.:.long :as :such operations were,•con- .,
ducted. within "the. boundaries 'of this map; and ' Q
WHEREAS, . in :order to substantiateindividua l lot,:-ownership .and
to assure these_:owners of. the",:properties on :"Fisherman ' s;-Beach"
that reasonable- requests .,for improvements submitted .to =us -would
receive favorable consideration provided ,the. improvements- are
within the boundaries of the properties as shown on the filed
map of Peconic -Bay -Properties;r,Inc:
NOW, THEREFORE, BE IT RESOLVED that this Board of Trustees of the
Town .of Southold hereby.appr.oves the application for the issuance
of a grant. lt& Wilbur Bald*ihn. for such =land -as :now -is-.,- or. formerly
was, below highwater .mark ,and. under::-the waters of Haywaters Cove.-.
to extend 150 feet -northeasterly -from Haywaters Road. .

Haywaters Cove, .-s-ituate, .Iying.:and:.being 'At
Nassau Point, in:. the Town ,-of -Southold,. 'Suffolk

County, New York, known and designated as
"Fisherman 's Beach" comprising all of Lot 29
and the westerly 25 feet of Lot 30 shown on a
certain map entitled "Subdivision Map, Peconic
Bay Properties, Inc. , surveyed February 6 , 1931,
by Otto W. Van Tuyl, Surveyor", filed in the
office of the Suffolk. County Clerk -on April 5 ,
1931 as Map No. 786; said premises extending
150 feet northeasterly from Haywaters Road.
TO HAVE AND TO HOLD the above mentioned and described premises
with the appurtenances unto the said party of the second part.,r his
heirs and assigns forever.
IN WITNESS WHEREOF, the said Town of Southold, party of the
first part, has by a majority of the Board of Trustees of said
Town caused. its corporate seal to be hereto affixed, and these

DOUGLAS M. ROBERTSON, residing at Browns Hills, Orient, New York,
GEORGE SIMPSON, residing at 149 Sixth Street, Greenport, New York,
PHILIP G.. HORTON, Residing at Main Road, Peconic-, New-- York, and
RUDOLPH JOHNSON, residing at. Grand. Avenue, Mattituck, New York,
all personally known. to be who, being by me duly sworn, severally
said that they each reside in the Town of Southold, County of
Suffolk and State of New York, and were members of the Board of
Trustees of said Town of Southold and constituted a majority of
the same; that they know the corporate seal of the said Town of .
Southold; that the seal affixed to the foregoing instrument was
such corporate -seal; that it was thereunto affixed by order of the
Board of Trustees of said Town of Southold, and that each one signed
his name thereto as a Trustee and by like order.
