HomeMy WebLinkAboutTR-09/11/1972 29 M I N U T E S BOARD OF SOUTHOLD TOWN TRUSTEES Meeting of September 11, 1972 A regular meeting of the Board of Southold Town Trustees was held at the Town .Clerk ' s Office, Main Road, Southold, New York, on Monday, September 11, 1972 at 7 :30 P.M. with the following present: Alvah B. Goldsmith, Chairman, Douglas M. Robertson, George A. Simpson, Philip G. Horton, Rudolph Johnson, and Judith T. Boken, Secretary. Mr. William W. Esseks, attorney, and Mr. Orlando Scaramucci, Divisional General Manager of New York Trap Rock Corp. appeared before the Board to, present detailed plans for reconstruction of bulkheads at Gotham Sand and Stone Division on Mattituck Inlet, Mattituck, New York, off of Naugles Drive. The bulkhead will be a total of 655 feet in length, of steel construction, and will be completed in a total of two years time. Oninmotion of Mr. Robertson, seconded by Mr. Simpson, it was RESOLVED that Gotham Sand and Stone Division, East Shore Road, Port Washington, New York, be granted permission to replace existing wooden bulkhead with steel bulkhead 655 feet in length at Mattituck Inlet, offoof Naugles Drive, Mattituck, New York, all in accordance with the application submitted. Fee $655. 00. Vote of the Board: Ayes : Mr. Goldsmith, Mr. Robertson; Mr. Simpson, Mr. Horton, Mr. Johnson. Mr, Richard- F. Lark, attorney for Mr. Joseph Rakowski appeared before the Board to present an application for a floating dock. Mr. Rakowski has a 16 ft. boat which is to be tied to the southerly portion of his proposed dock and his son has. a 34 ft. fishing boat to be tied to the northerly portion of the dock. The dock is not attached to .the shore as the Building Inspector will.not permit ,it; the mooring of a commercial boat to a dock - attached to residential land could be considered a business use. On motion of Mr. Horton, -,seconded by -Mr. Robertson,. it was RESOLVED that -Joseph Rakowski; . Westphalia Road, Mattituck, be granted permission to place a floating dock 8 ft. 6 in. by 18 ft. 30 and walkway 5 ft. by 32 ft. (315 sq. ft. ) , with 2 pilings, 25 ft. from the ordinary high water mark in front of his property located on private right-of-way off _Westphalia Road on Mattituck Creek, Mattituck, New York, all in accordance with the application submitted.. Fee $33. 50. Vote of the Board: Ayes : Mr. Goldsmith, Mr. Robertson, Mr. Simpson, Mr. Horton, Mr. Johnson.- Mr. Lark presented to the Board a map of land surveyed for Old Mill Marina , Inc. at Mattituck, by Otto W. Van Tuyl & Son, September 27 , 1969, land of Anna C. Hansen, located on the east side of Mattituck Creek, north of Mill Road, Mattituck, New York. Mr. Lark asked the Board to view the site at their convenience and submit suggestions and/or recommendations for the development of the property as a marina. Mr. Lark discussed with the Board a- land grant proposal on property of Wilbur A. Baldwin at "Fisherman'-s Beach" , all of lot 29 and the westerly 25 ft. of lot 30 on"subdivision map- of Peconic Bay Prop- erties, Inc. , " surveyed February 6, 1931 by Otto W. Van Tuyl, surveyor; and- filed in the- -office of the Suffolk County Clerk on April 5, 1931- as map No. '786'. This property is the subject of a . wetland application denied by the Southold Town Board and is- under appeal at the present time.. The question of ownership of the portion of the lot that is under water has become an issue in the appeal. The Board advised Mr. Lark they would look into the possibility of a blanket land grant for all the 'lots with portions under water, as they were under the impression James Rambo was given a grant to this underwater land sometime around 1930. The hoard received from William Wickham; 'at-torney, proposed land grants for properties of James S. Sellars and wife and John F. Seiler and wife at Mattituck- Creek, along with copies of -surveys and deeds. Dredging in Mattituck Creek and fill deposited on the applicant ' s property some years ago 'necessitates these applications. On motion of Mr. Simpson; seconded by Mr. Johnson, it was RESOLVED that .James- S. Sellars and Josephine Sellars, his wife, be granted the following described land: All that tract or parcel of land, situate at Mattituck, New York, bounded and described as follows : BEGINNING at a point on the boundary line between land of Seiler and land, of Sellars, 'being 205 feet south-easterly along said boundary line from Westview Drive, said point of beginning being the point where said boundary line inter- sects the ordinary high water mark of Mattituck Creek, as found in 1950; from said point of beginning running in a direct extension southeasterly of said boundary line South 330'- 40 ' East 105 feet; more or less, to the present high watermark of Ma.ttituck- -Creek; running thence in a southwesterly direction along ordinary high 31 water mark of Mattituck Creek 90 feet, more or less, to land of Burns; running thence along said land of Burns North 290 30 ' West 110 feet, more or less, to said high water mark of Mattituck Creek as found in 1950; thence northeasterly along said high water mark 80 feet, more or less, to the point of BEGINNING. Seiler and Florence K: Seiler, his wife, residing at Westview Drive, Mattituck, New York, be granted the following described land: BEGINNING at'-a point on the boundary line between land of Seiler and land of Halliday 200 feet south- easterly along said boundary line from Westview Drive, said point of beginning being the point where said boundary is intersected" by ordinary high water mark of Mattituck .Creek as .found in 195b; from said point of beginning running in a direct extension south- easterly of said boundary line South 390 20 ' 'East - 90 feet, more or less, to ordinary high water mark of Mattituck Creek; thence southwesterly along said high water mark 90 feet, more or less; thence on a direct extension southeasterly of the westerly boundary of said land of Seiler North 330 40 ' West - 105 feet, more or less, to said high water mark of Mattituck Creek, as found in 1950; thence northeasterly along said high water mark, 84 feet, more or less, to the point of BEGINNING.
