SOUTHOLD TOWN TRUSTEES
Meeting of April 3 , 1972
The Southold Town Trustees met at the Town Clerk ' s Office, Main
Road, Southold, New York, 'on Monday; April3 ;' 1,972 at 7f:30, P.M.
with the following present: -
Alvah B.- Goldsmith, . Chairman, Douglas M. Robertson,
GeGrge A. Simpson, Philip G. Hor,ton, Rudolph Johnson,
and Judith T. Boken, Secretary.
Mr. Howard- Terry advised the - Board that he stopped a 'dredging
operation under way at, the "end of Mason. Drive, Cutchogue by, it
is assumed, Broadwaters Cove Civic Association. The Secretary
was instructed to forward a' letter to the Broadwaters Cove Civic
Association advising them that an application must -be filed for
maintenance dredging regardleEs of the fact they had a previous
permit in 1967 for this same type of operation.
Mr. Patrick Carrig appeared before the Board/relative to the
outcome of investigation into the application of Stephen Hartman.
On motion of Mr. Hotton, seconded by Mr. Robertson, it was
RESOLVED, that Stephen Hartman, Little Pecon-ic Bay Road Nassau
Point, Cutchogue, New York, be granted permission to construct a
bulkhead along his aforesaid property, on Wunneweta Pond, 120 ft.
in length, in line with the existing bulkhead, all in accordance
with the application submitted. Fee $30. 00.
Vote of the Board: Ayes : Mr. Goldsmith, Mr. Robertson, Mr.
Simpson, Mr. Horton, Mr. Johnson.
Mr. Carrig presented to the Board the application of James Castagna,
Waterview Drive, Southold, New York.
On motion of Mr. Robertson, seconded by Mr. Simpson, it was
RESOLVED, that James Castagna , Waterview Drive, Southold, New York,
be granted permission to erect a dock and float on his property on
Goose Creek, 40 ft. in length overall, all in accordance with the
application submitted. Fee $20. 00.
Vote of the Board: Ayes : Mr. Goldsmith, Mr. Robertson, Mr.
Simpson, Mr. Horton, Mr. Johnson.

Mr. Carrig presented the application of Richard BozsnVak to the
Board of Town Trustees .
On motion of Mr. Robertson, seconded. by, Mr. .Horton, it was
RESOLVED, that Robert Bozsnyak, 46-30 Condord Avenue, Great Neck,
New York, be granted permission to build a dock and float on his
property at Bay Avenue, Cutchogue, New York, on Mud Creek, 39 ft.
in length overall, in accordance with the application submitted.
Fee_ 4�19. 50.
Vote of the Board: Ayes : Mr. .Goldsmith, Mr. Robertson, Mr.
Simpson, Mr. Horton, Mr. Johnson.
Mr. Carrig submitted the application of .William Albinson to the Board.
On motion of Mr. Simpson, seconded by Mr. Robertson, it .was
RESOLVED, that William Albinson, 30 Spottswood Road, Glen Rock,
New Jersey, be granted permission to build a dock and ramp on his
property at North Bayview Road, Southold, on Goose Creek, 33 feet
in length, .all in accordance with the application submitted.
Fee $16. 50.
Vote of the Board: Ayes : Mr. Goldsmith, Mr. Robertson, Mr.
Simpson, Mrc': Horton, Mr. ._Uohnson.
A letter was received from Gary F. Olsen relative. to Lot 127 (Davis
to de Reeder) , Map of Cedar Beach Park, at Bayview, Southold, New York.
Mr. Olsen wished to know whether or not a bulkhead could be restored
on this . lot and whether .or not it could be backfilled. Mr. Goldsmith
advised the Board that he had replied to Mr. Olsen, stating that the
fact this property was originally bulkheaded and filled, plus the
fact that. this area was, to.:,Mr: Goldsmith '.s:knowledge; =-a man .made
basin, , it would not be considered Town property, nor - in his .opinion
would it be. considered wetlands by the Board of Town Trustees.
The Board received Wetlands Permit No. , 3; application of =Henry F.
Praus, R.F.D. #1, Kirby Lane, Muttontown,- New York,--pertaining.--to
Lot 29 and part of Lot 30 at Nassau Point, known as Fisherman' s
Beach on subdivision map of "Peconic Bay Properties, Inc. " Letter
of referral from the Town Clerk was dated March 8, 1972 . --, The
Board will. investigate the site:
Mr. George K. Dornauer, 185 .,Willow Point Road, Southold, New York,
appeared before . the Board to discuss. the construction .of, a bulkhead
along his property fronting on the extension of Budd ' s Pond. Mr.
Dornauer also, submitted the .application-of-Cl,ifford. C. Cornell,
adjoining property owner: : Upon . examination of. the :area map;. -and
an opinion from Building Inspector Terry that . there is Ia possibility
this could be wetlands, the Board advised Mr. Dornauer that the
construction of a bulkhead is .out of the-jurisdiction -of the Town
Trustees as this is a dredged canal on private property, and stated
he- should file a wetlands application with the Town Board, and the
following resolution would .accompany .it:

On motion of Mr. Johnson, seconded by Mr. Simpson, it was
RESOLVED, that the Board. of Town Trustees waive objection' to
the applications of George K. Dornauer and Clifford C. Cornell
faor�.:aawetlands permit on the grounds the property was filled to
several feet above. the highest high tide a number of years prior
to the passage of the- Wetlands Ordi,nanc_e.- All of- this property
was excavated from private land, and none of it is now, nor ever
was under the jurisdiction of the Town Trustees.
The Board of Town Trustees feel the proposals of George K. Dornauer
and Clifford C. Cornell do not conflict with, nor' have any detrimental!
affect on any Wetland Ordinance provision.
Vote of the Board: Ayes : Mr.Goldsmith, Mr. Robertson, Mr.
Simpson, Mr. Horton, - Mr.. Johnson.
An application- was- received from Fisherman' s Beach. Association for
permission to dredge at Broadwaters Creek.
On motion of Mr,. Horton, .seconded by Mr. Robertson, . it was
RESOLVED, that Fisherman ' s Beach Association, Cutchogue, New York,
be granted permission to dredge a channel 100 ft. long and 6-ft.
wide for maintenance to ,provide access to the channel behind
Fisherman ' s Beach on Broadwaters Creek, Haywaters . Road, --Cutchogue,
New York. Approximately 200 cu. yds. of dredged material is to be
placed on 'the property of William Johnston, Fisherman ' s Beach,
Cutchogue; New York, all in accordance with the application. sub-. .
mitted. No Fee for maintenance dredging.
Vote of. the Board: Ayes : Mr. Goldsmith, Mr. Robertson, Mr.
Simpson, Mr. Horton, Mr. Johnson.
The Board received notification from the Suffolk County Department
of Public Works advising- the Board-. of the proposed dredging project
in Deep Hole Creek, Mattituck. The Secretary.was instructed to
forward a letter to the Department of Public Works requesting the
Preliminary Plan for this project and the locations for deposit
of the dredged material.
_Mr. . Goldsmith .advised the`.Board that Mr. Noor at 'Boatman's Harbor,
had asked him if he would need a permit to remove a sand bar
obstructing the channel in Cutchogue Harbor at Wickham Creek.
Mr. Goldsmith advised him that a permit would not be needed for
his-'mairitenance dredging in that area, as the County will be
doing maintenance dredging there in the near future.
The Board. of. Town Trustees received maps from the Suffolk "County
Department of Public Works indicating the spoil areas in connection
with dredging at Corey Creek, -'Wickham Creek and Richmond Creek.
An ..application was received from. James E. Gibbons requesting
permission to build a dock.
On motion of Mr. Robertson, seconded by Mr. Horton, it was

RESOLVED, that James E. Gibbons., '137 Cambridge Avenue, Garden City,
New York, be granted permission to build a dock, ramp and float,
overall 58 feet in length, with two pilings, ,- on his property on
Jockey Creek at a private road off Pine Neck Road, Southold, all
in accordance with the application submitted. Fee $31. 00.
Vote of the Board: Ayes : Mr. Goldsmith, Mr. Robertson, Mr.
Simpson, Mr. Horton, Mr. Johnson.
An application was received from,-Jerome B. . &. Betty, Lewin, 76737
167 Street, Flushing, New York, for permission to place a boat.
mooring in Goose Bay, Southold. The Secretary was instructed ,to
forward a letter to Mr. Lewin advising him that the Town .Trustees
has an agreement with the Goose Bay Civic Association, Inc
whereby we would not assign mooring spaces without obtaining
approval from the upland owner, and upon receipt of such approval
a permit will be issued.
On motion of Mr. Robertson, seconded by Mr. Johnson, it was.
RESOLVED, -that the minutes of the Board of Trustees of March 6,
1972 be approved as submitted.
Vote of the Board: Ayes : Mr. Goldsmith, Mr. Robertson, Mr.
Simpson, Mr. - Horton, Mr. Johnson.
On motion of Mr. Horton, seconded by Mr . Robertson, it was
RESOLVED, that the next meeting of . the Board of. -Town Trustees will
be held_ 7 :30 P.M. , Monday, May 1, 1972 at the Town_ Clerk. Office',.
Main Road, Southold, New York.
