Ehlers dated 10/25/10, is beyond Tidal Wetlands Act (Article 25)jurisdiction. Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6NYCRR-Part 661) no permit is required. Town Law §267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Town Law 4267-b(3)(b)(2)- The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because both buildings are existing and the only alternative would involve extensive demolition and construction. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is not mathematically substantial, representing less than 10% relief from the code. The existing combined setback will actually be improved from 16.6 feet to 22.2 feet because the applicant is removing a portion of the existing deck located in the side yard. I I 4.
