Dear Mr. Fitzgerald:
The Southold Town Board of Trustees reviewed the survey dated December 7, 2012,
and determined the proposed dwelling is 120' from the existing bulkhead and is out of
the Wetland jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111
of the Town Code.
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the
Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of
the coastal erosion hazard area as indicated above, or within 100' landward from the
top of the bluff, without further authorization from the Southold Town Board of Trustees
pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility
to ensure that all necessary precautions are taken to prevent any sedimentation or other
alteration or disturbance to the ground surface or vegetation within Tidal Wetlands
jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such
precautions may include maintaining adequate work area between the tidal wetland
jurisdictional boundary and the coastal erosion hazard area and your project or erecting
a temporary fence, barrier, or hay bale berm.
This determination is not a determination from any other agency.

Dear Mr. Diller:
Based on the information you have submitted, the Department of Environmental Conservation
(DEC) has determined that the property landward of the pre-existing (prior to 8/20/77)
bulkhead which is more than 100 feet in length, as..shown-on the-survey prepared by Alden W.
Young on June 17,1947 and confirmed on Tidal Wetlands Map #704-536 and infrared aerial
photograph #258 is beyond Article 25 (Tidal Wetlands Act)jurisdiction.
Therefore, in accordance with the current Tidal Wetlands Regulations (6NYCRR Part 661) no
permit is required.
Be advised,'however, that no construction, sedimentation, or disturbance of any kind.
may take place seaward of the tidal wetlands jurisdictional boundary, as indicated .
above, without a permit. It is your responsibility to ensure that all precautions are taken to
prevent any sedimentation or other alteration or disturbance to the ground surface or
vegetation within Tidal Wetlands jurisdiction which may result from.your project. Such

Dear Mr. Fitzgerald:
I am in receipt of your correspondence dated June 18,2013 with the attached architectural plans,
elevations and site plan.
Upon review of the sketches you provided, the proposed deck stairs are permitted by code and
therefore in keeping with the original decision, and as such, is de minimus. Our office will
forward a copy of the conforming site plan and construction plan sheet#A110 dated 6/17/2013 to
the Building Department.

I have reviewed your letter dated November 15, 2012,the additional information dated November
28, 2012, and the survey and site plan that you submitted with your request for a de minimus
determination.
I presented your request to the members of the Board of Appeals at our Regular Meeting on
December 6,2012. Since you do not propose any side yard setback changes to the variances
granted in decision#5884,and since the proposed location of the house has made it more
conforming to the-code and meets the setback condition cited in the original decision,the Board
has determined that your requested modification is de minimus in nature.
I will instruct the office to send a copy of this letter and a stamped approved copy of the-building

Dear Ms. Weisman:
The subject property has been sold to:
John D. Heslin.

Mr. Heslin proposes the construction of a single family dwelling as depicted in the attached site
plan,prepared by RES4 Architecture and dated 4/16/13. The building footprint has been extended
to the north and a first floor-level deck and associated access stairs have been added on the sea-
ward side. The five conditions of the ZBA's original findings,however, are still met by the pro-
posed structure if the stairs to grade from the seaward deck are exempt from inclusion in the set-
back calculations.
This request supersedes our previous request on behalf of John Diller,the former owner, dated
November 15, 2012, and approved by the ZBA on December 6, 2012.
The purpose of this request is to secure the Board's confirmation to the Building Department that
the house shown in the enclosed site plan meets the conditions set forth in the Board's original
granting of alternative relief in its November 9, 2006 findings.

Dear Ms. Weisman:
This is further to our previous correspondence on this matter, and responds to your letter of May
13,2013
The architect has further revised the plan to more clearly show that the area at the top of the stairs
to grade in the southeast corner of the dwelling is not an extension of the deck, but rather is a
landing and part of the steps for which we seek exemption from prohibition within the previously
approved setback area.
A revised site plan, a floor plan,and four perspective views, all dated 6/17/13,are enclosed.
Please review this change as it applies to our request for a de minimus finding with regard to the
plan for the dwelling as it is now proposed with this clarification.
