Moore, Esq. 51020 Main Road Southold, NY 11971 RE: TODD & EDITH WEBSTER-FREED 12400 NEW SUFFOLK AVENUE, CUTCHOGUE SCTM# 116-6-12.1 & 12.2 Dear Ms. Moore: The Southold Town Board of Trustees reviewed the survey prepared by Peconic Surveyors, P.C., last dated September 6, 2013, and performed a Field Inspection on November 6, 2013 to flag the landward edge of the jurisdictional boundary line and determined that any proposed tree/stump/underbrush activity located landward of this flagging is out of the Wetland jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code. Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward.of the coastal erosion hazard area as indicated above, or within 100' landward from the top of the bluff, without further authorization from the Southold Town Board of Trustees pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. A copy of the survey with the approximate location of the flagging performed by the Board of Trustees is enclosed for your records. This determination is not a determination from any other agency.
