A regular meeting of the Board of Southold Town .Truste.e's was
held at 7:30 p.m. , Tuesday, July 3, 1979, at .the Town Hall, Main
Road, Southold, New York. . lPresent were:
President Philip G•. .Horton:

Trustee John Nickles
Trustee' Paul -Stoutenburgh
Motion was made byTrustee Hataier, seconded by Trustee
Nickles and carried .tb'. approve the minutes of the meeting of June
5, 1979.
Gary P-. Charnews - application tb place offshore stake from bulk-
head at public property at Gull Pond. A group of people appeared
with -Richard Mastrbsimbne as their spokesperson. He said'-his-:
family 'owns the property directly across •and the .town agreed there
would be no docking at the bulkhead. There was an agreement. with -'
the New York State DEC back in 1965 and the Town Clerk is requesting
a copy of same to see if this was '.included. The next meeting will
be the 7th of August and a determination will be made at that time. '
Trustee Nickle-s .made -a motion, ' seconded by Trustee Hataier
and carried to table action .on. this application pending receipt of
the agreement with the New York State Department of Conservation.
On motion made by Trustee Stoutenburgh, seconded by Trustee
Hataier, it was
13� RESOLVED to approve the application of Joseph G. Callahan to
place offshore stake with pulley line to onshore stake at Corey
Creek Estates at end of Corey Creek Lane.
Vote of the Board: Ayes: Horton, Harris, Hataier, Nickles,
Stoutenburgh
A letter is to be written to the Corey Creek Association informing
them that they must file permits for the two docks and the stakes.
On motion made by Trustee Stoutenburgh, seconded by Trustee
Harris, it was
RESOLVED to approve the application of William E. deBruin, Jr.
to place mooring in Little Creek with access from Meadow Lane.
Mr. deBruin is to contact Philip.Horton for placement of the
mooring.

On motion made by Trustee Hataier, seconded by Trustee Harris,
it was
RESOLVED to approve the application of Helen 'Brown to place
150 lb. mushroom anchor' off private property of the applicant at ^ 111-7
Goose Creek with the condition that the boat does not swing into 19,
the channel and it does not interfere with any other moorings.

RESOLVED to approve the application of Harold J. Hannafin to �
place 150 lb. mushroom anchor with access from public property with�, 3)3
a dinghy at Mattituck Creek.

On. motion made by Trustee Hataier, seconded by Trustee Nickles,
it was
RESOLVED to approve the application of Nancy-Jo Cantrell to 314-
dredge material and place behind retaining wall at private property
of the applicant at East Creek with the condition that the fill be
placed on the upland and not to be within ten feet of the two wings
and graded back from there and planted with suitable ground cover
to retain fill.
Vote of the Board: Ayes: Horton, Harris, Hataier, Nickles,
Stoutenburgh
On motion made -by 'Trustee Harris, seconded by Trustee
Stoutenburgh, it was
RESOLVED to recommend- to the Southold Town Board denial- of
Wetland Application #39 for Thomas and Jacqueline Occhiogrosso to
fill property and erect dwelling on property designated as Lot #28
of Corey Creek Estates because the lot is in wetlands by definition.
Vote of the Board: Ayes: Horton, Harris, Hataier, Stoutenburgh
Nay: Nickles
Trustee N,iekles voted, in the negative because he feels the
recommendation should not be 'for denial on- the strength off' the
fact that the Department of Environmental-Conservation has approved
it and he is able- to get Health Department permits for water and
cesspools.

A letter is to be written to Allie Hansen requesting him
/to remove his boat from Town Creek as there has been some
difficulty: in that it has.,drifted--into other boats. The. Town
.Highway. is to be' requested to- remove. the steel stakes- on the south
✓ side of the culvert at Town Creek at concrete wall built last year.
This is at the Youngs Avenue Extension.-. :
On motion made by Trustee Stoutenburgh, seconded by Trustee

50 lb. mushroom anchor and chain at Little Creek with the
condition that Philip Horton be called for exact location.

RESOLVED to appr.ove : the .application of .Richard M. Osmer.
to place offshore stake with pulley line to onshore stake off
right-of-way at Goose Creek.

On motion made by Trustee Stoutenburgh, seconded by Trustee
Harris, it was
RESOLVED to approve the amended application of Harold I.
/ Thomas which will include buffer posts to keep boat off shore.
There will be no dredging, no structure in the waterway and no
encroachment on upland areas. This will be to the south on the
property.

The. following letter was received from the Nassau Point
Property, Owners .Association directed to the Board of Trustees.
Gentlemen:
Over the -years we .have observed the ,Petrucci boat marina on -Skunk -
Lane in Cutchogue expand to a sizeable operation. 'We have been'
told that this business was started before residential zoning was
adopted for this area. While this property is not on Nassau Point,
our members have an interest in .-its- use as it is on the only access
road to' our area. ' Apparently, this .business has -now been sold and
we are interested in making sure that this non-conforming use .is
not expanded in the future.
We would' appreciate receiving from -the .Zoning Board of Appeals and
the Board of Trustees copies of the most recent permits which define
how this land may be used commercially and what defined ,areas may
be dredged .and .bulkheaded. and .u.sed for the mooring of boats. We
are also interested in what business can be carried on (i.e. sale of
gasoline,. .rest rooms, food and beverage .sales,. storing of boats off-
season etc. ) . Our Board of Directors may then observe the continued
compliance with the permits and report any exceptions to the proper
Town of Southold officers. ,
We feel that the Town of Southold has. provided a valuable tool , in
its use of -property and waterfront uses. We, hope that we can help
in this area of protection for the Town and the Residents .of Nassau
Point.

The Board of Tbwn Trustees directed that a letter be written to
the Nassau Point Property Owners Association informing them that
this Board does not have jurisdiction over this roar'-made. waterway.
A copy of the Southold Town Board of Appeals letter of June 1, 1978
to Mr. Angelo G. Petrucci will be forwarded to the Association for
its information.
The following letter was received from the-_ Southold.-Town.
Baymen,' s Association._
The Baymen' s Association has been active for years reviewing
applications made/to the Army Corps of Engineers relating to water-
front projects, b, lkheads, etc. A large number of these applications
were for additions to existing.: prSojects. The original projects were
installed eitTowould
rbefore permits, were required or at a . - date and
applications the Army Corps /and the Town were ignored by the
landowners. appear, we .feel, that .a law should be enacted
where landowners. who proceed with work of this nature should be
penalized in some form. . .
Perhaps another approach that might help to stem these unlawful
procedures .could be as follows:

Notify all. dock builders that it,. will be necessary .for. .them to be
presented with a permit issued by the Army :Corps and the Town of
Southold before they are allowed to proceed with any work they have
contracted for with a landowner. Further, it was suggested that
dock building permits issued by the Town Trustees be posted during
the construction period in •a conspicuous .location, .much the same
as the procedure of the ,Building Department.
As a footnote, Our ,.observAtions halve been that -the Army Corps :'
stands on a .premises "We do not intend :to prosecute at this time'! .
It is not .the 'Association'.s' function nor.' do we wish to create
problems for past "bad boys"' but :we do feel the Town should- not be
required to indulge in the "error of their ways" for .the future. .
We shall be glad to submit our..opinion .in person at a Trustees
meetindif you feel it might' be helpful.

The secretary informed the Board that it was becoming difficult
if not impossible to process these mooring renewals because of
the time factor involved. She requested that the Board consider

this at the time the budget is prepared.
On motion made by Trustee Nickles, seconded by Trustee Harris',
it was
RESOLVED to approve the amended plan.'-of Henrry. P. Smith with
the dock being changed to 92 feet in length and-the placement of
four temporary pilings which will be. reriiov.ed .at the.* time the float
is completed.
