AUTHORIZATION I
Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on June
19,2013,and in consideration of application fee in the sum of$500.00 paid by En-Consultants and subject to
the Terms and Conditions as stated in the Resolution,the Southold Town Board of Trustees authorizes and
permits the following:
a.
_ Wetland Permit to remove existing damaged stairway and terrace retaining walls;
construct along eroding toe of bluff approximately 210 linear feet of stone revetment,including
angled westerly return,all consisting of approximately 3 to 5 ton stone placed over 50 to 100
pound core stone and filter cloth; restore bluff face using terrace retaining walls,with up to
1600 cubic yards of sand re-nourishment(including covering the proposed revetment),and
native plantings; construct ad-3'wide berm with±50 cubic yards of sand/loam within 15'wide
vegetated non-turf buffer to be established and subsequently maintained adjacent to bluff crest
_ to control storm-water runoff; and construct a new 4'x±50' elevated bluff stairway with
landings;with the condition a bond must be set up with the Town Highway Department if
access is required at/through a road end to get to site; and as depicted on the site plan prepared
by Jeffrey T. Butler,P.E.,P.C.,last dated February 17,2013,and stamped approved on June
19,2013.
IN WITNESS WHEREOF,the said Board of Trustees hereby causes its Corporate Seal to be axed,
and these presents to be subscribed by a majority of the said Board as of this date.

Dear Ms. Stephens,
I have reviewed the Declaration of Covenants draft you submitted to this office with
respect to the above referenced application concerning the fifteen foot wide non turf
buffer to be established and subsequently maintained adjacent to the bluff crest.
The covenants and restrictions document must be executed and filed with the County
pursuant to §275-10(K) of the Southold Town Code. Please note that a copy of this
document or, in the alternative, a sworn statement attesting to the filing is to be presented
to the Office of the Board of Trustees within 90 days of issuance of the permit.

DECLARATION OF COVENANTS

WITNESSETH:
WHEREAS, DECLARANT is the owner of certain real property located at 2050 Dignans
Road,Cutchogue, Town of Southold, County of Suffolk, State of New York, described in the Suffolk County
Tax Map as District 1000, Section 83, Block 2,Lot 7.3, which is more particularly bounded and described as set
forth in Schedule "A" annexed hereto, hereinafter referred to as the Property;
WHEREAS, the Property is situated on lands within the jurisdiction of the Board of Trustees of the
Town of Southold (hereinafter the "Trustees") pursuant to Chapter 275 of the Town Code of the Town of
Southold or its successor, and various activities conducted upon the property may thus be subject to the
regulation and approval of the Trustees prior to being conducted;
WHEREAS, the DECLARANT therefore made application to the Trustees for a permit pursuant to the
Wetlands Law of the Town of Southold to undertake certain regulated activities;and
WHEREAS, as a condition of the granting of a Wetlands Permit to undertake such regulated activities,
the Trustees required that a fifteen-foot wide vegetated "non-turf buffer" be established adjacent to the bluff
crest,
NOW,THEREFORE,the DECLARANT does hereby covenant and agree as follows:
1) Upon the substantial completion of the aforementioned permitted activities there shall be
established and subsequently maintained adjacent to the bluff crest on the subject premises a
fifteen-foot wide vegetated"non-turf buffer"as defined by Chapter 275 of the Town Code; and
2) These covenants shall run with the land and shall be binding on the DECLARANT, his heirs,
assigns, purchasers, or successors in interest and may be modified only upon resolution of the
Board of Trustees.

All that certain plot,piece or parcel of land,with the buildings and improvements thereon erected, situate, lying
and being in the Town of Southold,at Cutchogue, County of Suffolk and State of New York being bounded and
described as follows:
BEGINNING at a point at the center line of a 20 foot wide right of way, said point being distant 2149.70 feet
westerly from the intersection of the westerly side of Oregon Road and the center line of said 20 foot wide right
of way;
EHENCE from said point of beginning, along the center line of the 20 foot wide right of way north 46 degrees
39 minutes 50 seconds west, 188.55 feet to a pint and lands now or formerly of Kalamaras;
THENCE along said lands north 14 degrees 41 minutes 30 seconds east, 700.00 feet to a point;

SUBJECT TO the rights of others over that portion of premises covered by 10 foot wide portion of a 20 foot
right of way and over the southeasterly 50 foot wide strip of land leading from 20 foot wide right of way to
lands adjacent on the north.
TOGETHER WITH a right of way 10 feet in width over lands of Zuhoski from the northwesterly corner of the
