HomeMy WebLinkAboutTR-04/03/1979 337 A regular meeting of the Board of Southold Town Trustees was held at 7: 30 p.m. , Tuesday, April 3, 1979 at the Town Hall, Main Road, Southold, New York. Present were: President Philip G. Horton Trustee Scott Harris Trustee Anna Hataier Trustee John Nickles Trustee Paul Stoutenburgh Dick Curtis, Suffolk Times Trustee Hataier made ,a motion, seconded by Trustee Harris and carried to approve the minutes of the regular meeting of March 6, 1979 with the following corrections:, 1. On page 333 in the matter of Raymond W. Pluschau the , .amount of 58 feet should be removed and the correction should read "to the ramp" . 2 . On page 333 in the matter of William S. Gardner Mr. Stoutenburgh registered a nay vote and wanted the following reasons for the nay vote entered in the minutes: a, The study concernin:g ,N�tssau Point'.s fresh water states that this kind of cutting into the land encourages salt water intrusion. b. The wetlands destroyed would be approximately one half of the wetlands on his property and if all property owners did the same it would have a devastating effect on the ecology of the area. c. A catwalk with dock over marsh and floating dock would achieve the same exact result but be cheaper and much less detrimental to the area. 3. On page 336 in the matter of the folder distribution, Mr. Nickles wished his negative vote to read that he thinks this would be illegal. On motion made by Trustee Hataier, seconded by Trustee Harris , it was RESOLVED to table the application of Donald DeLalla -to place three spiles off private property of the applicant at Mud Creek in order. to obtain more information. Vote of the Board: Ayes:: `Horton, -Harris, Hataier, Nickles Stoutenburgh 338 - On motion made. by Trustee Harris, seconded by President Horton it was \ RESOLVED to approve the' application. of. Joseph -E.. Hataier to ao place offshore stake with pulley line to onshore stake at Arshamomaque Pond. q Vote of the Board: Ayes: Horton, Harris, Nickles , Stoutenburgh Abstain: Trustee Hataier The reason for the abstention is that Joseph E. Hataier is Trustee Hataier' s son. On motion made by Trustee Stoutenburgh, seconded by Trustee Harris, it was . . . . . . RESOLVED to' approve the application of Douglas ' Rogers , Jr. 'to place offshore stake off public property at Gull Pond with the provision that it be 150 feet away and there is room for boats to ' land. Vote of the Board: Ayes: Horton, Harris, Hataier, Nickles, Stoutenburgh It was the consensus of the _Board that suggestion be made to the Town Board that a sign be made to be placed at the. 150 foot / mark facing towards the ramp at the public.'bulkhead at Gull Pond that this be left open with nonpermanent moorings., On 'motion made by Trustee Hataier, seconded by Trustee Harris., it was RESOLVED 'to approve the application of Dan Grattan, Jr. to place offshore stake with pulley line to onshore stake 'at Sterling Creek, Town Stake #8. Vote of the Board: Ayes: Horton, Harris, Hataier, Nickles Stoutenburgh } On motion made by Trustee Hataier, seconded by Trustee Harris, it was S RESOLVED to approve the application of Henry Ruthinoski , Jr. 3> ; to place offshore stake with pulley line to onshore stake at CNN, Sterling Creek, Town Stake #.9. Vote of the Board: Ayes: Horton, Harris ; Hataier, Nickles, Stoutenburgh 339 On motion made by Trustee 'Stoutenburgh', seconded by Trustee Hataier, it was RESOLVED to approve the application of James Joseph Cancro to place floating dock off private property of the applicant at East Creek. Vote of the Board: Ayes: Horton, Harris, Hataier; Nickles, Stoutenburgh (Mr. Curtis of the Suffolk Times arrived at'this point) The matter of the application of Francis Romano to place retaining wall and docks off private property of the applicant was discussed in regard to the Army Corps of Engineers notice. ' This is not in the jurisdiction of the Town Trustees as it is private property. On motion made by Trustee Harris, seconded by Trustee Hataier, it was RESOLVED to approve Matt-A-Mar Marina for bulkhead, lift and so forth noting that the majority of the fill will come from the upland as suggested by the owner and amend his original application to include drawing and- eliminate the additional- bulk- head that shows on the original application as per letter dated March 12, 1979. Vote of the Board: Ayesz Horton, Harris, Hataier, Nickles , Stoutenburgh On motion made by Trustee Nickles, seconded. by Trustee Hataier it was RESOLVED to close Town Creek, Jockey Creek,' Hallock's Bay, and Arshamomaque Pond (Mill Creek) for .shellfishing as per Dept. of Environmental Conservation regulations on the commencement of the shellfish transplant program and remaining closed until the 'Dept. of Environmental Conservation certifies them to be opened. All signs in the named creeks should read "Closed to Shellfishing. . . . . " Votes-of the Board: Ayes: Horton; Harris, Hataier, Nickles, Stoutenburgh On motion made by Trustee Nickles, seconded by Trustee Stoutenburgh, it was -U 0 RESOLVED that a letter be sent to the "Southold Town Board recommending that the Bay Constable put up signs in every �cr.eek in the' Town of Southold indicating "-Sneed Limit 5 Miles Per Hour - Entire Creek - No Wake" . It is recommended that several signs be put up in each creek. Vote of the Board: Ayes: Horton, Harris, Hataier, Nickles, Stoutenburgh- A letter will be written to the Fleet' s Neck Property Owners Association, Inc.==including a copy-- of the resolution for its information. A letter was received from the Southold Town Bavmen' s Association, Inc. regarding the-proposed condominiums at -th6' i former Sweet' s- Shipyard in - the--Village of-'= Greenport. This= -ar-ea is out of the jurisdiction of the Board of Town Trustees ' amd 'no action was taken. A letter is to be written to Mr. Frank Pileski and Ms. Virginia Van Bokkelen directing them to remove their docks from Rochelle Place,�'at- James Cre.ek--,within: .3.0. .days=.%C`These�pe`opiel placed docks• in the creeks--without-permits. Mr. P-ileski--made an application `and 'was denied because this is -not an exclusive right-of-way., 'If these docks are, not removed the matter will be referred to the Town Attorney for legal action. These is also the possibility that they are in violation of Corps of Engineers, Dept. of Environmental Conservation and the Wetland Ordinance of the Town of Southold. A letter was received from the Orient Truckina and. Construction Co. , Inc. under the signature of Robert J. Douglas, Wharf Director, requesting support to the Army Corps of Engineers of work that the Orient Wharf District proposes at Gardiner' s Bay. This- matter .is .out of the jurisdiction of the Board of Town Trustees and the Trustees do not wish to take a position in the matter. Trustee Nickles reported that he had met with Supervisor Marto.cchia and Carl Eisenschmeid of the Suffolk ' County Public Works Department. The priorities for the dreding projects in The creeks of the Town were reaffirmed. Cedar Beach is the first on the list. The Superintendent of Highways is to be requested to repair the ramp at Narrow River and ask him to contact Ned Adams when it is going to be done. 341 The Supgr,ntendent of Highways is also to be contacted about the town ramp at.,Hog Pond. . At low tide .'it needs something put. in. Another copy of the letter regarding the disposition of the , spoil at Little Creek is to be sent to the:..Department of Public Works. There being no further business to come before the Board, Trustee Harris made a motion, seconded by Trustee Nickles and carried to adjourn the meeting.
