At the time of the filing the variance application, Mr. and Mrs. Faucon were not able to verify the setback of their adjoining house, which is the only house within 300 feet. Our office immediately contacted the builder, who would be representing the Faucons in the variance application. Our secretary asked Mr. Dohrman, the builder, to bring in the measurements for established setbacks of house(s) within 300 feet . (as per Section 100-230) , and on October 31, 1990, Mr. Dohrman. and our secretary both met with the Building Inspectors. to ascertain whether a variance was needed since the adjoining house was also the same front yard setback as that proposed in the permit application. The Building Department agreed to accept Mr. Dohrman's Affidavit with sketch as to the established setback of existing house(s) within 300 feet (Section 100-230}, and the Notice of Disapproval was withdrawn. It is our recommendation that the applicants be refunded their $150.00 filing fee since if the above information was made available prior to the issuance of the Notice of Disapproval_, no variance would have been necessary. lk NOV 2 319 P.
