Butler,P.E.,P.C., last dated August 7, 2012. I am writing to you presently to let you know that work is scheduled to begin in December and that the contractor plans to use helical anchors to support the proposed low-sill bulkhead rather than batter pilings, as was depicted on"Section 1 —Low Sill Bulkhead" on Sheet 2 of 3 of the approved plans. It is estimated that this design change will result in approximately 50 pilings not being installed in the water in conjunction with the low-sill bulkhead. As the project design could thus be characterized as having a lesser scope than what was approved by the Board, please let me know whether the Board would require the applicant to secure revised engineering plans and submit for a permit modification or if submission of this letter for your file might provide adequate notice of this change. (These floats will not allow for the expansion of the marina use because they will not provide any permanent docking space for customer boats but only for temporary staging activities associated with the preparation and servicing of customer boats prior to launch and delivery to the customer for use). To facilitate installation of the proposed boat launch, relocate existing 10' x 17' shed a minimum distance of 75' from wetlands and relocate an approximately 10' wide section of existing boat racks from west end of boat racks to east end of boat racks. All work is to be accomplished as described above and as depicted on the "Coastal Construction Site Plan"prepared by Jeffrey T. Butler, P.E., P.C., last dated August 7, 2012. The purpose of the proposed project is to stabilize the eroding shorelines forming the basin and to establish a service staging area therein for preparation and servicing of customer boats prior to launch and delivery to customers. Establishment of this area will create the significant environmental benefit of creating more than 2,000 square feet of vegetated intertidal marsh in an eroding area now devoid of wetland vegetation while increasing both safety and efficiencies of marina operations by relocating the existing fork lift travel route away from the customer parking area and shortening its travel distances by two to three hundred feet, thus reducing fuel consumption and ambient noise associated with forklift use in boat launching and servicing activities. Statement of the effect, if any, on the wetlands and tidal waters of the town that may result by reason of such proposed operations (use attachments if appropriate): See attached Statement of Effect. STRONG'S MARINE, INC.,2402 CAMP MINEOLA ROAD EXTENSTION,MATTITUCK Statement of Effect The effect of the proposed project on the tidal waters and wetlands of the Town will be a net benefit. Currently, the shorelines forming the subject basin, which has been present since prior to 1960, are eroding chronically and severely, resulting in the loss of bank vegetation, including mature trees, and the sedimentation and shoaling of the basin and perimeter of the adjacent navigational channel. Therefore, the construction of the proposed low-sill bulkheading will stem this chronic erosion of the shoreline and loss of vegetation by physically stabilizing the toe of the embankment and establishing 2,195 square feet of vegetated intertidal marsh behind it via placement of fill (adjacent dredged spoil) and plantings of intertidal marsh grass, Spartina alterniflora. This intertidal marsh will be established where none presently exists, thus creating a net increase to Town wetlands. A much smaller area of Phragmites will be removed to allow for installation of the proposed boat launch, but compared to the area of marsh to be created, this removal of invasive vegetation is warranted ecologically, as intertidal marsh has the highest primary productivity of any category of tidal wetlands and would introduce presently lacking wetlands functions and values in that area, including providing habitat and a source of organic nutrients for the surrounding marine community. In addition to providing these ecological benefits and combining with the low-sill bulkhead to play a role in erosion control as described above, the created marsh would also serve as a sink and filter for contaminants potentially entering the waterway from the surrounding upland, thus providing a potential benefit to the quality of surface water. The dredging of the basin will have only temporary impacts on the adjacent environment through increased turbidity, which will be controlled by employing a silt curtain during dredging, and the spoil will be used to provide the base for the marsh creation behind the low-sill bulkheading. The proposed staging floats will be placed over unvegetated bottom and will be constructed with untreated decking as required by code. These floats will not allow for the expansion of the marina use because they will not provide any permanent docking space for customer boats but only for temporary staging activities associated with the preparation and servicing of customer boats prior to launch and delivery to the customer for use. Without the ability to establish this staging area, there would be no incentive for the marina to invest in the erosion control and marsh creation, so again, the trade-off creates a net benefit to both the marina operations and to the adjacent environment. The dredging of the basin will have only temporary impacts on the adjacent environment through increased turbidity, which will be controlled by employing a silt curtain during dredging, and the spoil will be used to provide the base for the marsh creation behind the low-sill bulkheading. 617.20 SEQR PROJECT ID NUMBER APPENDIX C STATE ENVIRONMENTAL QUALITY REVIEW SHORT ENVIRONMENTAL ASSESSMENT FORM for UNLISTED ACTIONS Only PART 1-PROJECT INFORMATION (To be completed by A)plicant or Project Sponsor) 1.APPLICANT/SPONSOR 2.PROJECT NAME Strong's Marine,Inc. by En-Consultants 3.PROJECT LOCATION: Municipality Mattituck County Suffolk 4.PRECISE LOCATION:Street Address and Road Intersections.Prominent landmarks etc-or provide map 2402 Camp Mineola Road Ext.,Mattituck,Town of Southold,SCTM#1000-122-9-6.2 5.IS PROPOSED ACTION: ® New Expansion ❑Modification/alteration 6.DESCRIBE PROJECT BRIEFLY: See attached project description 7.AMOUNT OF LAND AFFECTED: Initially 8.73 acres Ultimately 8.73 acres 8.WILL PROPOSED ACTION COMPLY WITH EXISTING ZONING OR OTHER RESTRICTIONS? ®Yes DNo If no,describe briefly: 9.WHAT IS PRESENT LAND USE IN VICINITY OF PROJECT?(Choose as many as apply.) ®Residential11 Industrial N Commercial ❑Agriculture El Park/Forest/Open Space Other(describe) Marine 10.DOES ACTION INVOLVE A PERMIT APPROVAL,OR FUNDING,NOW OR ULTIMATELY FROM ANY OTHER GOVERNMENTAL AGENCY(Federal,State or Local) ®Yes ❑No If yes, list agency name and permit/approval: DEC&US ACE 11.DOES ANY ASPECT OF THE ACTION HAVE A CURRENTLY VALID PERMIT OR APPROVAL? ❑Yes N No If yes, list agency name and permit/approval: 12.AS A RESULT OF PROPOSED ACTION WILL EXISTING PERMIT/APPROVAL REQUIRE MODIFICATION? Establishment of this area will create the significant environmental benefit of creating more than 2,000 square feet of vegetated intertidal marsh in an eroding area now devoid of wetland vegetation while increasing both safety and efficiencies of marina operations by relocating the existing fork lift travel route away from the customer parking area and shortening its travel distances by two to three hundred feet, thus reducing fuel consumption and ambient noise associated with forklift use in boat launching and servicing activities. )OF OF MAILING OF NOTICE A_ _-NCH CERTIFIED MAIL RECEIP .:. INSTRUCTIONS I , All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town.of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its si nig f cant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listing both supporting and non- supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. A copy of the LWRP is available in the following places: online at the Town of Southold's website (southoldtown.northfork.net), the Board of Trustees Office, the a al libraries and the Town Clerk's office. B. DESCRIPTION OF SITE AND PROPOSED ACTION SCTM# 122 - 9 -6.2 AUG 13 2012 PROJECT NAME Strong's Marine,Inc. Southhold Town oar The Application has been submitted to (check appropriate response): Town Board ❑ Planning Board❑ Building Dept. ❑ Board of Trustees Category of Town of Southold agency action (check appropriate response): (a) Action undertaken directly by Town agency (e.g. capital ❑ construction, planning activity, agency regulation, land transaction) (b) Financial assistance (e.g. grant, loan, subsidy) El (c) Permit, approval, license, certification: Nature and extent of action: See attached project description. PROJECT DESCRIPTION: STRONG'S MARINE,INC. 2042 CAMP MINEOLA ROAD EXT.,MATTITUCK Construct approximately 294 linear feet of low-sill vinyl bulkhead (including +34' and +15' returns) along shoreline of eroding embankment; dredge approximately 600 cubic yards of sand/silt spoil from existing ±5,620 sf basin area, including area of Phragmites at head of basin, to a maximum depth of -4'MLW (-3'MSL); place approximately 91 cubic yards of spoil in unvegetated area behind proposed low-sill bulkheading for planting with Spartina alterniflora (12" o.c.) to create approximately 2,195 square feet of intertidal marsh; and place remaining spoil, approximately 509 cubic yards, in spoil disposal area in existing pervious parking area to east of basin. At head of basin, construct+59 linear feet of high-sill bulkhead, including a+33' primary section that will front and support a proposed 20' x 26' concrete boat launch (with 4' x 12' steel pad) and+14' and+12' seaward sections on each side of basin that will tie into+7' sloped sections of wall to connect and transition the high-sill bulkhead into the proposed low-sill bulkheading; and construct two (2) 12' angled landward returns off ends of+33' primary section. Along seaward side of low-sill bulkheading, install 5' wide service staging floats with a total length of 242 linear feet; two (2) irregularly shaped landing floats, each approximately 5' to 6' wide and 13' to 14' long; and two (2) 3' x 15' ramps. Location of action: 2402 Camp Mineola Road Ext.,Mattituck Site acreage: 8.73 acres Present land use: Commercial Marina Present zoning classification: Marine I 2. If an application for the proposed action has been filed with the Town of Southold agency, the following information shall be provided: (a) Name of applicant: Strong's Marine,Inc. (b) Mailing address: P.O.Box 1409 Mattituck,NY 11952 (c) Telephone number: Area Code 631-298-4770 (d) Application number, if any: Will the action be directly undertaken, require funding, or approval by a state or federal agency? Yes ® No❑ If yes, which state or federal agency?USACE,NYSDEC C. Evaluate the project to the following policies by analyzing how the project will further support or not support the policies. Provide all proposed Best Management Practices that will further each policy. Incomplete answers will require that the form be returned for completion. DEVELOPED COAST POLICY Policy 1. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. See LWRP Section III- Policies; Page 2 for evaluation criteria. Yes No ® Not Applicable Attach additional sheets if necessary Policy 2. Protect and preserve historic and archaeological resources of the Town of Southold. See LWRP Section III- Policies Pages 3 through 6 for evaluation criteria ❑ Yes 0 No ® Not Applicable Attach additional sheets if necessary Policy 3. Enhance visual quality and protect scenic resources throughout the Town of Southold. See LWRP Section III - Policies Pages 6 through 7 for evaluation criteria ❑Yes ❑ No ® Not Applicable Attach additional sheets if necessary NATURAL COAST POLICIES Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP Section III- Policies Pages 8 through 16 for evaluation criteria ®Yes ❑ No ❑ Not Applicable Currently, the shorelines of the subject basin, which has been present since prior to 1960,are eroding chronically and severely, resulting in the loss of bank vegetation, including mature trees, and the sedimentation and shoaling of the basin and perimeter of the adjacent navigational channel. Therefore, the construction of the proposed low-sill bulkheading will stem this chronic erosion of the shoreline and loss of vegetation by physically stabilizing the toe of the embankment and establishing 2,195 square feet of vegetated intertidal marsh behind it via placement of fill(adjacent dredged spoil)and plantings of intertidal marsh grass,Spartina alterniflora. The project is thus consistent with Policy 4 in that by using a low-sill bulkhead and marsh plantings,it limits to the minimum scale necessary the hard structural erosion protection component and employs a vegetative non-structural component as well. The use of the adjacent dredged spoil as fill to enhance or in this case create a presently lacking natural protective feature,Le,the intertidal marsh,is further consistent with the methods of erosion control recommended by Policy 4. Attach additional sheets if necessary Policy 5. Protect and improve water quality and supply in the Town of Southold. See LWRP Section III - Policies Pages 16 through 21 for evaluation criteria ®Yes ❑ No ❑ Not Applicable The proposed project is consistent with Policy 5 to the extent that the created marsh will serve as a sink and filter for contaminants potentially entering the waterway from the surrounding upland, thus providing a potential benefit to the quality of surface water. The dredging of the basin will have only temporary impacts on the adjacent waterway through increased turbidity, which will be controlled by employing a silt curtain during dredging and the proposed staging floats will be constructed with untreated decking as required by code. Attach additional sheets if necessary Policy 6. Protect and restore the quality and function of the Town of Southold ecosystems including Significant Coastal Fish and Wildlife Habitats and wetlands. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable The project will be consistent with the goa: ..storing the quality and function of Town wC,, —_1s,most specifically the policy goal of protecting and restoring tidal wetlands, through the creation of 2,195 square feet of vegetated intertidal marsh via placement of fill (adjacent dredged spoil)and plantings of intertidal marsh grass, Spartina alterniflora. This intertidal marsh will be established where none presently exists, thus creating a net increase to Town wetlands. A much smaller area of Phragmites will be removed to allow for installation of the proposed boat launch, but compared to the area of marsh to be created, this removal of invasive vegetation is warranted ecologically,as intertidal marsh has the highest primary productivity of any category of tidal wetlands and would introduce presently lacking wetlands functions and values in that area, including providing habitat and a source of organic nutrients for the surrounding marine community. The created marsh would also serve as a sink and filter for contaminants potentially entering the waterway from the surrounding upland as described above. Attach additional sheets if necessary Policy 7. Protect and improve air quality in the Town of Southold. See LWRP Section III - Policies Pages 32 through 34 for evaluation criteria. ❑ Yes [:] NON Not Applicable Attach additional sheets if necessary Policy 8. Minimize environmental degradation in Town of Southold from solid waste and hazardous substances and wastes. Provide for public access to, and recreational use of, coastal waters, public lands, and public resources of the Town of Southold. See LWRP Section III - Policies; Pages 38 through 46 for evaluation criteria. ® Yes ❑ No❑ Not Applicable The project is consistent with Policy 9 because it no way impedes access to or interferes with the recreational use of coastal waters or public lands. In fact, the project has the potential to indirectly improve the use of the adjacent public navigational channel by stemming the loss of material from the eroding shorelines forming the basin, which is entering the adjacent channel and contributing to the shoaling thereof. Attach additional sheets if necessary WORKING COAST POLICIES Policy 10. Protect Southold's way...-dependent uses and promote sift( _..'F new water-dependent uses in suitable locations. See LWRP Section III - Policies; Pages 47 through 59 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable The project is consistent with Policy 10 because it is designed specifically to enhance the safety and efficiency of the operations of an existing marina and thus ultimately contributes to the goal of protecting an existing an established water-dependent use. Currently, without the proposed staging area, the marina fork lifts must travel from the boat racks an average distance of 350 to 400 feet through the existing customer parking and other areas regularly walked and accessed by customers and their families to launch boats for service. The proposed staging area and new launching pad would obviate the need for the forklift to travel across the customer parking area and reduce the forklift travel distance by approximately 250 feet or roughly 65%to 100 to 150 feet, thus increasing safety within the marina and reducing fuel consumption and ambient noise associated with boat launching and servicing activities. The proposed staging floats will not allow for the expansion of the existing marina use, however, because they will not provide any permanent or transient docking space for customer boats but only for temporary staging activities associated with the preparation and servicing of customer boats prior to launch and delivery to the customer.
